LIRIA E SHPREHJES, PROTESTA DHE P\u00cbRFSHIRJA POLITIKE<br \/>\n1. DREJT\u00cbSIA PENALE P\u00cbR T\u00cb MITUR DHE SHTRESAT VULNERAB\u00cbL<br \/>\n4. Heqja e ndalimit t\u00eb burgimit t\u00eb p\u00ebrjetsh\u00ebm p\u00ebr t\u00eb mitur dhe gra<br \/>\n\u2022 Drafti p\u00ebrmbys nj\u00eb standard human q\u00eb ka qen\u00eb pjes\u00eb e sistemit shqiptar p\u00ebr dekada. Kufizimi i mund\u00ebsive p\u00ebr d\u00ebnime alternative<br \/>\n\u2022 Drafti redukton ndjesh\u00ebm hap\u00ebsirat p\u00ebr z\u00ebvend\u00ebsimin e burgimit me d\u00ebnime me gjob\u00eb, duke ndikuar negativisht mbi mbingarkes\u00ebn n\u00eb burgje dhe rehabilitimin e t\u00eb d\u00ebnuarve.<br \/>\n8. Zgjerimi i konfiskimeve ndaj pal\u00ebve t\u00eb treta<br \/>\n\u2022 Drafti lejon konfiskimin e pasuris\u00eb edhe ndaj personave t\u00eb tret\u00eb, pa lidhje t\u00eb drejtp\u00ebrdrejt\u00eb me vepr\u00ebn penale, nj\u00eb praktik\u00eb kjo q\u00eb cenon r\u00ebnd\u00eb t\u00eb drejt\u00ebn e pron\u00ebs private.<br \/>\n9. Eliminimi i mekanizmave p\u00ebr \u201cheqjen dor\u00eb\u201d nga krimi<br \/>\n\u2022 Drafti e ngushton ose heq mund\u00ebsin\u00eb q\u00eb personi q\u00eb heq dor\u00eb vullnetarisht nga kryerja e vepr\u00ebs t\u00eb mos d\u00ebnohet, duke minuar preventiv\u00ebn pozitive.<br \/>\n10. P\u00ebrjashtimi i t\u00eb d\u00ebnuarve nga e drejta p\u00ebr \u201clirimin me kusht\u201d<\/p>\n<p>\u2022 Drafti ndalon p\u00ebrfundimisht lirimin me kusht p\u00ebr shum\u00eb kategori krimesh, edhe pse personi ka reflektuar apo rehabilituar, duke i kthyer d\u00ebnimet n\u00eb hakmarrje shtet\u00ebrore.<\/p>\n<p>11. Retroaktivitet i mundsh\u00ebm i ligjit penal t\u00eb ri<\/p>\n<p>\u2022 Drafti p\u00ebrfshin formulime q\u00eb mund t\u00eb p\u00ebrdoren p\u00ebr t\u00eb zbatuar ligjin e ri penal n\u00eb m\u00ebnyr\u00eb retroaktive n\u00eb koh\u00eb, n\u00eb kund\u00ebrshtim me parimin e mosveprimit pas n\u00eb koh\u00eb t\u00eb ligjit, si dhe t\u00eb parimit \u201cnullum crimen, nulla poena sine lege\u201d.<\/p>\n<p>13. Reduktimi kritik i vepr\u00ebs penale t\u00eb \u201cshp\u00ebrdorimit t\u00eb detyr\u00ebs\u201d<\/p>\n<p>\u2022 Drafti i ri ngushton ndjesh\u00ebm p\u00ebrkufizimin dhe aplikueshm\u00ebrin\u00eb e k\u00ebsaj vepre penale, duke e b\u00ebr\u00eb praktikisht t\u00eb pamundur nd\u00ebshkimin penal t\u00eb zyrtar\u00ebve q\u00eb abuzojn\u00eb me detyr\u00ebn, p\u00ebrve\u00e7 rasteve flagrante. PROBLEME N\u00cb KLASIFIKIMIN DHE TRAJTIMIN E VEPRAVE MODERNE<br \/>\n19. Munges\u00eb e kapitujve t\u00eb dedikuar p\u00ebr krimet kibernetike<\/p>\n<p>\u2022 Drafti nuk njeh realitetin e rreziqeve teknologjike moderne, duke i trajtuar krimet kibernetike (internet etj) brenda kapitujve t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb krimeve financiar\u00eb.<\/p>\n<p>20. Trajtimi si krime t\u00eb r\u00ebnda i veprave me pasoja t\u00eb vogla<\/p>\n<p>\u2022 Drafti i Kodit Penal nuk ka kufizime p\u00ebr proporcionalitetin n\u00eb d\u00ebnim dhe nd\u00ebshkon edhe rastet me d\u00ebme minimale n\u00eb m\u00ebnyr\u00eb t\u00eb nj\u00ebjt\u00eb me rastet flagrante.<\/p>\n<p>21. Diskrecion i shtuar p\u00ebr organet e drejt\u00ebsis\u00eb, munges\u00eb kontrolli t\u00eb balancuar<\/p>\n<p>\u2022 Rritja e kompetenc\u00ebs s\u00eb organeve hetimore dhe prokuroris\u00eb n\u00eb vend t\u00eb gjykatave n\u00eb fazat vendimmarr\u00ebse krijon rrezik p\u00ebr shtypje institucionale.<\/p>\n<p>22.
