Ahmetaj i ka mohuar akuzat nga arratia.<\/p>\n<p>Sido q\u00eb t\u00eb vej\u00eb puna, n\u00eb rast se Kodi i ri Penal i propozuar nga qeveria p\u00ebr diskutim publik do t\u00eb miratohej, me gjas\u00eb do ta shp\u00ebtonte Ahmetajn nga kjo akuz\u00eb p\u00ebr shkakun\u00a0 e thjesht\u00eb se vepra penale e parashikuar k\u00ebsaj here k\u00ebrkon q\u00eb, prokuroria t\u00eb v\u00ebrtetoj\u00eb jo vet\u00ebm veprimin apo mosveprimin e zyrtarit q\u00eb ka shkaktuar d\u00ebmin, por duhet t\u00eb v\u00ebrtetoj\u00eb q\u00eb zyrtari ka vepruar <strong>me q\u00ebllim kriminal. <\/strong>Dhe duke qen\u00eb se, q\u00ebllimet kriminale gjenden brenda mendjes s\u00eb njeriut t\u00eb dyshuar p\u00ebr shkelje, gjasat jan\u00eb q\u00eb gjykata do t\u00eb detyrohet t\u00eb rr\u00ebzoj\u00eb padin\u00eb si t\u00eb pamb\u00ebshtetur n\u00eb ligj e n\u00eb prova, pasi <strong>q\u00ebllimi kriminal<\/strong> nuk mund t\u00eb v\u00ebrtetohet.<\/p>\n<p>Shp\u00ebrdorimi i detyr\u00ebs dhe shkelja e barazis\u00eb n\u00eb tender\u00eb apo n\u00eb ankande publike jan\u00eb dy ndryshime madhore t\u00eb parashikuara n\u00eb propozimet p\u00ebr ndryshimin e Kodit Penal. Qeveria \u00ebsht\u00eb distancuar nga autor\u00ebsia e ndryshimeve ligjore dhe thot\u00eb se Kodi \u00ebsht\u00eb hartuar nga nj\u00eb grup ekspert\u00ebsh, por deri m\u00eb sot, asnj\u00eb nga ekspert\u00ebt e p\u00ebrmendur nuk ka dal\u00eb publikisht q\u00eb t\u00eb mbroj\u00eb pun\u00ebn e vet.<\/p>\n<p>Nd\u00ebrhyrja n\u00eb k\u00ebto dy nene praktikisht b\u00ebn t\u00eb pavlefsh\u00ebm t\u00eb gjith\u00eb konceptin e abuzimit me detyr\u00ebn nga zyrtar\u00ebt publik\u00eb apo at\u00eb t\u00eb krijimit t\u00eb kushteve t\u00eb pabarabarta p\u00ebr operator\u00ebt ekonomik\u00eb n\u00eb rastet e tender\u00ebve apo ankandeve publike.<\/p>\n<p>\u201c1. Zyrtari publik, i ngarkuar drejtperdrejt apo terthorazi [SIC], me administrimin e fondeve publike,\u00a0 q\u00eb synon, me dashje dhe qellim [SIC] kriminal, t\u2019i shkaktoj\u00eb d\u00ebm ekonomik veprimtaris\u00eb s\u00eb institucionit t\u00eb tij apo nj\u00eb personi tjet\u00ebr, ngaq\u00eb: a) ushtron kompetencat n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme; b) tejkalon autoritetin e tij ligjor duke perdorur fondet jashte destinacionit te tyre, ose c) krijon pengesa p\u00ebr t\u00eb p\u00ebrmbushur nj\u00eb detyr\u00eb q\u00eb rrjedh nga tagrat e tij ligjor\u00eb ose nga nj\u00eb vendim gjyq\u00ebsor, kur veprimi nuk p\u00ebrb\u00ebn ndonj\u00eb vep\u00ebr penale m\u00eb t\u00eb r\u00ebnd\u00eb, d\u00ebnohet me burgim deri n\u00eb kat\u00ebr vjet,\u201d shkruhet n\u00eb projektin e propozuar, i cili ndryshon n\u00eb m\u00ebnyr\u00eb themelore konceptin aktual ligjor t\u00eb abuzimit t\u00eb detyr\u00ebs, e kufizon k\u00ebt\u00eb vep\u00ebr penale n\u00eb fush\u00ebn e administrimit t\u00eb fondeve publike apo k\u00ebrkon q\u00eb prokuror\u00ebt t\u00eb v\u00ebrtetojn\u00eb se zyrtari ka vepruar me \u201c<strong>qellim kriminal\u201d. <\/strong><\/p>\n<p>Ndryshe nga versioni i propozuar, Kodi aktual Penal n\u00eb nenin 248 \u00ebsht\u00eb shum\u00eb m\u00eb lakonik, konciz dhe i qart\u00eb. Aty shkruhet: \u201cKryerja ose moskryerja me dashje e veprimeve a e mosveprimeve n\u00eb kund\u00ebrshtim me ligjin, q\u00eb p\u00ebrb\u00ebn mosp\u00ebrmbushje t\u00eb rregullt t\u00eb detyr\u00ebs, nga personi q\u00eb ushtron funksione publike, kur i kan\u00eb sjell\u00eb atij ose personave t\u00eb tjer\u00eb p\u00ebrfitime materiale ose jomateriale t\u00eb padrejta a kan\u00eb d\u00ebmtuar interesat e ligjsh\u00ebm t\u00eb shtetit, t\u00eb shtetasve dhe t\u00eb personave t\u00eb tjer\u00eb juridik\u00eb, n\u00ebse nuk p\u00ebrb\u00ebn vep\u00ebr tjet\u00ebr penale, d\u00ebnohet me burgim deri n\u00eb shtat\u00eb vjet.\u201d<\/p>\n<p>Si\u00e7 dallohet, hartuesve t\u00eb Kodit t\u00eb ri Penal i jan\u00eb nevojitur 162 fjal\u00eb p\u00ebr t\u00eb z\u00ebvend\u00ebsuar nj\u00eb nen me 71 fjal\u00eb, i cili k\u00ebrkon thjesht\u00eb q\u00eb zyrtari t\u00eb merret p\u00ebrgjegj\u00ebs n\u00eb rast se nj\u00eb veprim apo mosveprim n\u00eb kund\u00ebrshtim me ligjin, i ka shkaktuar d\u00ebm shtetit apo shtetasve n\u00eb p\u00ebrfitime materiale apo jomateriale t\u00eb atij vet\u00eb ose t\u00eb t\u00eb tjer\u00ebve.<\/p>\n<p><strong>Jo m\u00eb shkelje t\u00eb barazis\u00eb me tender\u00eb<\/strong><\/p>\n<p>Kodi aktual Penal parashikon n\u00eb nenin 258 vepr\u00ebn penale t\u00eb shkeljes s\u00eb barazis\u00eb n\u00eb tender\u00eb apo ankande publike ku parashikohet se krijimi i kushteve t\u00eb pabarabarta n\u00eb tender\u00eb apo ankande, n\u00eb \u00e7far\u00ebdolloj forme apo pavar\u00ebsisht q\u00ebllimit t\u00eb shkel\u00ebsit t\u00eb ligjit, d\u00ebnohet me gjob\u00eb ose me burgim deri n\u00eb tre vjet.<\/p>\n<p>Ndryshe nga neni aktual, propozimi n\u00eb kodin e ri n\u00eb nenin 324 parashikon q\u00eb zyrtar\u00ebt e prokurimeve publike do t\u00eb mund t\u00eb mbahen p\u00ebrgjegj\u00ebs vet\u00ebm n\u00eb rastet kur shkelja e m\u00ebsip\u00ebrme \u00ebsht\u00eb b\u00ebr\u00eb \u201cp\u00ebr q\u00ebllim p\u00ebrfitimi\u201d.<\/p>\n<p>\u201cKryerja e q\u00ebllimt\u00eb e veprimeve te pabarabarta nga personi i ngarkuar me funksione shtet\u00ebrore apo n\u00eb sh\u00ebrbim publik, <strong>q\u00eb p\u00ebr q\u00ebllim p\u00ebrfitimi, p\u00ebr q\u00ebllim p\u00ebrfitimi <\/strong>[SIC], shmangin gar\u00ebn reale, konkurrimin e ndersh\u00ebm dhe cenojn\u00eb barazin\u00eb e kandidat\u00ebve, operator\u00eb ekonomik\u00eb, n\u00eb procedurat e k\u00ebrkuara nga ligji n\u00eb nj\u00eb prokurim publik, marrja e masave me q\u00ebllim p\u00ebr t\u00eb diskriminuar apo favorizuar subjekte t\u00eb ve\u00e7anta tregtare, kur prokurimi \u00ebsht\u00eb n\u00eb vler\u00ebn e kufirit t\u00eb prokurimeve me vler\u00eb t\u00eb vog\u00ebl sipas parashikimeve t\u00eb legjislacionit t\u00eb fush\u00ebs, apo kur p\u00ebr t\u00eb nj\u00ebjtat arsye \u00ebsht\u00eb vendosur apo ndikuar t\u00eb vendoset fitues i procesit nj\u00eb subjekt i pamerituar, kur me pare jane marre masa administrative perkatese, d\u00ebnohet me burgim nga nj\u00eb deri n\u00eb pes\u00eb vjet,\u201d thuhet n\u00eb propozimin aktual.<\/p>\n<p>M\u00ebnyra e formulimit t\u00eb k\u00ebtij neni \u00ebsht\u00eb dalluesh\u00ebm nj\u00eb nonsens\u00a0 juridik p\u00ebr shkak se, n\u00ebse nj\u00eb zyrtar ka p\u00ebrfituar nga shkelja e barazis\u00eb n\u00eb tender\u00eb apo ankande, ai d\u00ebnohet p\u00ebr korrupsion nd\u00ebrsa, n\u00eb munges\u00eb t\u00eb v\u00ebrtetimit nga prokuror\u00ebt t\u00eb <strong>q\u00ebllimit t\u00eb p\u00ebrfitimit <\/strong>zyrtari mund t\u00eb b\u00ebj\u00eb shkelje sa t\u00eb doj\u00eb pa u shqet\u00ebsuar se do t\u00eb d\u00ebnohet, p\u00ebr sa koh\u00eb arrin t\u00eb fsheh\u00eb p\u00ebrfitimet e mundshme.<\/p>\n<p>Kodi i ri Penal \u00ebsht\u00eb kritikuar deri m\u00eb tani si \u201carbitrar\u201d, \u201cinkuizitor\u201d dhe \u201cjo n\u00eb p\u00ebrputhje me standardet nd\u00ebrkomb\u00ebtare\u201d sa i p\u00ebrket pjes\u00ebs s\u00eb veprave t\u00eb shumta penale q\u00eb qytetar\u00ebt mund t\u00eb kryejn\u00eb, sipas k\u00ebtij kodi, jo p\u00ebrmes veprimit, por p\u00ebrmes t\u00eb folurit apo t\u00eb shkruarit. Kodi \u00ebsht\u00eb kritikuar gjithashtu si i paqart\u00eb, si nj\u00eb hap pas n\u00eb disa drejtime apo nj\u00eb i till\u00eb q\u00eb do t\u00eb shkaktoj\u00eb konfuzion t\u00eb panevojsh\u00ebm apo edhe q\u00eb do t\u00eb v\u00eb n\u00eb rrezik funksionimin t\u00ebr\u00ebsor t\u00eb drejt\u00ebsis\u00eb penale t\u00eb vendit.<\/p>\n<p>Disa kan\u00eb v\u00ebn\u00eb gjithashtu n\u00eb pik\u00ebpyetje nevoj\u00ebn p\u00ebr hartimin e nj\u00eb Kodi t\u00eb ri, n\u00eb nj\u00eb vend ku nuk ka pasur s\u00eb fundmi ndonj\u00eb ndryshim regjimi dhe n\u00eb t\u00eb cilin, kodi aktual, i miratuar fillimisht n\u00eb vitin 1995, \u00ebsht\u00eb p\u00ebrpunuar p\u00ebr tre dekada me radh\u00eb nga sistemi i drejt\u00ebsis\u00eb p\u00ebrmes praktik\u00ebs gjyq\u00ebsore, vendimeve unifikuese t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb apo interpretimeve t\u00eb Gjykat\u00ebs Kushtetuese apo edhe nga vet\u00eb parlamenti, duke hequr shum\u00eb nene negative, duke rishkruar apo riinterpretuar nene t\u00eb tjera apo duke shtuar nene, jo gjithmon\u00eb n\u00eb m\u00ebnyr\u00eb fort t\u00eb arsyeshme, por n\u00eb shumic\u00ebn e rasteve, p\u00ebrmes nj\u00eb procesi diskutimi t\u00eb detajuar p\u00ebr \u00e7do nen e \u00e7do fjal\u00eb.<\/p>\n<p>Puna e tre dekadave ka gjasa do t\u00eb duhet t\u00eb nis\u00eb nga e para, pasi sistemi i drejt\u00ebsis\u00eb do t\u00eb duhet t\u00eb shqyrtoj\u00eb formulime gjuh\u00ebsore krejt\u00ebsisht t\u00eb ndryshme, t\u00eb shprehura n\u00eb nj\u00eb gjuh\u00eb q\u00eb, sipas profesor Artan Fug\u00ebs, \u201cmund t\u00eb interpretohen si nj\u00eb fizarmonik\u00eb, si nj\u00eb llastik.\u201d<\/p>\n<p>P\u00ebrve\u00e7 k\u00ebtyre, ekzistenca e neneve q\u00eb duksh\u00ebm bien ndesh me disa nga \u00e7\u00ebshtjet m\u00eb t\u00eb debatuara n\u00eb Gjykat\u00ebn Evropiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut, si\u00a0 liria e shprehjes apo pac\u00ebnueshm\u00ebria e dinjitetit t\u00eb autoriteteve shtet\u00ebrore si presidenti i republik\u00ebs, ngre pik\u00ebpyetje serioze mbi nivelin e profesionalizmit t\u00eb atyre t\u00eb cil\u00ebve qeveria i referohet si \u201cgrup ekspert\u00ebsh\u201d, asnj\u00ebri prej t\u00eb cil\u00ebve nuk ka dal\u00eb deri m\u00eb sot t\u00eb mbroj\u00eb at\u00eb q\u00eb normalisht duhej t\u00eb ishte krenaria e karrier\u00ebs s\u00eb \u00e7do juristi.<\/p>\n<p><strong>Me fuqi p\u00ebr \u00e7\u00ebshtjet aktuale<\/strong><\/p>\n<p>Nj\u00eb nga parimet themelore t\u00eb t\u00eb drejt\u00ebs penale \u00ebsht\u00eb q\u00eb, n\u00ebse qytetari q\u00eb ka kryer nj\u00eb shkelje p\u00ebrballet me ndryshimin e legjislacionit\u00a0 q\u00eb parashikon shkeljen e kryer prej tij para gjykimit t\u00eb form\u00ebs s\u00eb prer\u00eb, interesi i tij prevalon. Kjo do t\u00eb thot\u00eb q\u00eb, n\u00eb rastet kur vepra penale e rishikuar mbart d\u00ebnim m\u00eb t\u00eb lart\u00eb se sa parashikohej n\u00eb koh\u00ebn\u00a0 kur u krye shkelja, shkel\u00ebsi gjykohet sipas ligjit t\u00eb vjet\u00ebr. Nd\u00ebrsa n\u00eb rast se ligji i ri e favorizon at\u00eb n\u00eb krahasim me t\u00eb m\u00ebparshmin, ai g\u00ebzon t\u00eb drejt\u00ebn t\u00eb gjykohet sipas ligjit t\u00eb ri. Kjo do t\u00eb thot\u00eb q\u00eb, t\u00eb gjith\u00eb zyrtar\u00ebt q\u00eb aktualisht p\u00ebrballen me akuza penale apo jan\u00eb n\u00ebn hetim p\u00ebr vepra penale, do t\u00eb mund t\u00eb zgjedhin opsionin m\u00eb me leverdi p\u00ebr ta, si p\u00ebr sa i p\u00ebrket thelbit ashtu edhe mas\u00ebs s\u00eb d\u00ebnimit. P\u00ebr shembull, vepra penale e korrupsionit pasiv parashikohet n\u00eb projektkodin e propozuar t\u00eb d\u00ebnohet me 3 deri n\u00eb 8 vjet heqje lirie. Por p\u00ebr t\u00eb gjitha shkeljet e mundshme t\u00eb b\u00ebra para hyrjes n\u00eb fuqi t\u00eb k\u00ebtij kodi, do t\u00eb mund t\u00eb zgjedhin t\u00eb gjykohen nga kodi aktual q\u00eb parashikon d\u00ebnim nga 2 deri n\u00eb tet\u00eb vjet. Nd\u00ebrsa zyrtar\u00ebt e akuzuar p\u00ebr shkelje t\u00eb barazis\u00eb n\u00eb tender\u00eb ka gjasa do t\u00eb k\u00ebrkojn\u00eb t\u00eb gjykohen apo t\u00eb rigjykohen n\u00eb baz\u00eb t\u00eb kodit t\u00eb ri penal, duke p\u00ebrfituar n\u00eb praktik\u00eb nj\u00eb form\u00eb amnistie t\u00eb pashpallur.<\/p>\n<p>Parimi i p\u00ebrdorimit t\u00eb ligjit m\u00eb favorizues p\u00ebr subjektin sqarohet shprehimisht n\u00eb projektkodin penal t\u00eb prezantuar n\u00eb nenin 9 ku shkruhet: Ligji i ri q\u00eb nuk d\u00ebnon vepr\u00ebn penale ka fuqi prapavepruese. Procedimi penal i filluar pushon, nd\u00ebrsa n\u00eb rast se personi \u00ebsht\u00eb d\u00ebnuar, ekzekutimi i d\u00ebnimit nuk mund t\u00eb filloj\u00eb dhe, n\u00eb qoft\u00eb se ka filluar, pushon\u201d.
