Mir\u00ebpo, edhe gjat\u00eb vitit 2024, puna e k\u00ebtij institucioni \u00ebsht\u00eb shoq\u00ebruar me vonesa, mosfunksionalitet t\u00eb plot\u00eb dhe munges\u00eb ndikimi real n\u00eb forcimin e integritetit t\u00eb sistemit gjyq\u00ebsor, n\u00eb ve\u00e7anti t\u00eb gjyqtar\u00ebve dhe prokuror\u00ebve.<\/p>\n<p class=\"TableParagraph\">N\u00ebse do t\u00eb b\u00ebnim nj\u00eb analiz\u00eb t\u00eb k\u00ebtij institucioni sipas \u201c3E-ve\u201d ,eficienc\u00ebs, ekonomicitetit dhe efektivitetit, at\u00ebher\u00eb Inspektori i Lart\u00eb i Drejt\u00ebsis\u00eb do t\u00eb \u201cmbetej n\u00eb klas\u00eb\u201d.<\/p>\n<p class=\"TableParagraph\">Po jap disa shifra t\u00eb thjeshta: n\u00eb faqen 13 t\u00eb raportit konfirmohet se gjysma e ankesave mbarten nga viti n\u00eb vit, rreth 1480 ankesa t\u00eb mbartura p\u00ebr vitin 2025. Ankesat e mbartura nga viti 2023 n\u00eb 2024 ishin 1363. Ankesat e depozituara gjat\u00eb vitit 2024 jan\u00eb 1491. Pra, n\u00eb total kemi 2854 ankesa, nga t\u00eb cilat institucioni shqyrton 1374 pra, \u201cl\u00ebviz n\u00eb vend\u201d. N\u00eb numrin total t\u00eb ankesave, gjysma nuk shqyrtohen.<\/p>\n<p class=\"TableParagraph\">Kalojm\u00eb tek ankesat e shqyrtuara: 993 jan\u00eb ankesa t\u00eb arkivuara pas shqyrtimit fillestar, pra jasht\u00eb juridiksionit t\u00eb institucionit; 327 jan\u00eb ankesa t\u00eb arkivuara pas shqyrtimit, ku nuk jan\u00eb gjetur shkelje; dhe vet\u00ebm 54 jan\u00eb p\u00ebrfunduar me hetim disiplinor, nga t\u00eb cilat 23 kan\u00eb p\u00ebrfunduar me vendim. Pra, nga 1374 ankesa n\u00eb total, rezulton q\u00eb vet\u00ebm 2% p\u00ebrfundojn\u00eb me shkelje ose, n\u00ebse marrim parasysh vet\u00ebm ankesat e trajtuara n\u00eb thelb, p\u00ebrqindja arrin n\u00eb rreth 5%.<\/p>\n<p class=\"TableParagraph\">Kjo shif\u00ebr tregon eficienc\u00eb dhe efektivitet shum\u00eb t\u00eb ul\u00ebt t\u00eb k\u00ebtij institucioni.<\/p>\n<p class=\"TableParagraph\"><strong>I. Zvarritje skandaloze t\u00eb hetimeve disiplinore<\/strong><\/p>\n<p class=\"TableParagraph\">Nj\u00eb nga problemet m\u00eb t\u00eb dukshme ka qen\u00eb zvarritja e hetimeve disiplinore ndaj gjyqtar\u00ebve dhe prokuror\u00ebve. ILD ka treguar munges\u00eb t\u00eb theksuar transparence n\u00eb trajtimin e ankesave dhe vonesa t\u00eb pajustifikuara n\u00eb p\u00ebrfundimin e procedurave. Kjo ka sjell\u00eb perceptimin publik se institucioni po humbet funksionin e tij kryesor: at\u00eb t\u00eb garantimit t\u00eb p\u00ebrgjegjshm\u00ebris\u00eb dhe integritetit n\u00eb sistemin e drejt\u00ebsis\u00eb.<\/p>\n<p class=\"TableParagraph\">Nj\u00eb pjes\u00eb e konsiderueshme e ankesave t\u00eb ardhura pran\u00eb ILD-s\u00eb n\u00eb vitin 2024 kan\u00eb mbetur n\u00eb faz\u00eb verifikimi paraprak p\u00ebr periudha t\u00eb gjata kohore, shpesh pa afate t\u00eb qarta p\u00ebr p\u00ebrfundimin e procedur\u00ebs. N\u00eb shum\u00eb raste, hetimet disiplinore kan\u00eb zgjatur m\u00eb shum\u00eb se nj\u00eb vit, edhe pse ligji parashikon afate t\u00eb p\u00ebrcaktuara p\u00ebr shqyrtimin e rasteve.<\/p>\n<p class=\"TableParagraph\">K\u00ebto vonesa t\u00eb r\u00ebnda kan\u00eb prodhuar dy pasoja kryesore:<\/p>\n<p class=\"TableParagraph\">Dob\u00ebsimin e mekanizmit t\u00eb p\u00ebrgjegjshm\u00ebris\u00eb. Kur nj\u00eb hetim disiplinor zgjatet pafund\u00ebsisht, efekti nd\u00ebshkues dhe parandalues i tij zhduket. Kjo d\u00ebmton seriozisht integritetin e sistemit gjyq\u00ebsor, pasi krijon p\u00ebrshtypjen se gjyqtar\u00ebt dhe prokuror\u00ebt nuk mbajn\u00eb p\u00ebrgjegj\u00ebsi reale p\u00ebr veprimet e tyre.<\/p>\n<p class=\"TableParagraph\">R\u00ebnien e ndjeshme t\u00eb besimit publik tek sistemi i drejt\u00ebsis\u00eb. Vonesat e gjata dhe mungesa e transparenc\u00ebs e b\u00ebjn\u00eb qytetarin t\u00eb ndiej\u00eb se kontrolli i brendsh\u00ebm i drejt\u00ebsis\u00eb nuk funksionon.<\/p>\n<p class=\"TableParagraph\">Th\u00ebn\u00eb ndryshe, kemi nj\u00eb \u201csorosifikim\u201d t\u00eb drejt\u00ebsis\u00eb, q\u00eb d\u00ebmton t\u00eb gjith\u00eb imazhin e reform\u00ebs n\u00eb drejt\u00ebsi, e cila u nd\u00ebrtua gjoja me premtimin p\u00ebr \u201cdrejt\u00ebsi t\u00eb p\u00ebrgjegjshme dhe t\u00eb ndershme\u201d.<\/p>\n<p class=\"TableParagraph\"><strong>II. Perceptimi i ndikimit t\u00eb jasht\u00ebm dhe mungesa e pavar\u00ebsis\u00eb s\u00eb plot\u00eb<\/strong><\/p>\n<p class=\"TableParagraph\">Edhe pse ILD \u00ebsht\u00eb formalisht institucion i pavarur, n\u00eb praktik\u00eb jan\u00eb ngritur dyshime mbi ndikime politike apo grup-interesash, ve\u00e7an\u00ebrisht n\u00eb p\u00ebrzgjedhjen e rasteve q\u00eb hetohen dhe n\u00eb m\u00ebnyr\u00ebn se si publikohen rezultatet.<\/p>\n<p class=\"TableParagraph\">Nj\u00eb nga problemet m\u00eb t\u00eb dukshme gjat\u00eb vitit 2024 ka qen\u00eb mungesa e transparenc\u00ebs n\u00eb m\u00ebnyr\u00ebn se si Inspektori i Lart\u00eb i Drejt\u00ebsis\u00eb ka trajtuar ankesat dhe hetimet disiplinore. Problem madhor ka qen\u00eb edhe mungesa e stafit t\u00eb kualifikuar: nga 101 punonj\u00ebs t\u00eb miratuar, institucioni ka vet\u00ebm 84 punonj\u00ebs pra, 16% m\u00eb pak.<\/p>\n<p class=\"TableParagraph\">Raportet publike kan\u00eb qen\u00eb t\u00eb p\u00ebrgjithshme, pa detaje mbi arsyet pse disa dosje trajtohen me prioritet dhe t\u00eb tjera mbeten pezull p\u00ebr muaj t\u00eb t\u00ebr\u00eb. Kjo munges\u00eb qart\u00ebsie ka ushqyer bindjen se vendimmarrjet nuk jan\u00eb gjithmon\u00eb t\u00eb bazuara n\u00eb prova, por shpesh ndoshta n\u00eb shumic\u00ebn e rasteve n\u00eb ndikime t\u00eb jashtme, kryesisht politike.<\/p>\n<p class=\"TableParagraph\">N\u00eb media dhe n\u00eb opinionin publik jan\u00eb p\u00ebrmendur raste kur hetime t\u00eb ndjeshme ndaj zyrtar\u00ebve t\u00eb lart\u00eb t\u00eb drejt\u00ebsis\u00eb jan\u00eb pezulluar ose zvarritur, nd\u00ebrsa ankesat ndaj gjyqtar\u00ebve t\u00eb zakonsh\u00ebm jan\u00eb ndjekur me ritme t\u00eb shpejta. Ky disproporcion ka d\u00ebmtuar imazhin e ILD-s\u00eb si nj\u00eb organ neutral.<\/p>\n<p class=\"TableParagraph\">Edhe pse ILD \u00ebsht\u00eb formalisht nj\u00eb institucion i pavarur kushtetues, sidomos gjat\u00eb vitit 2024 jan\u00eb shtuar dyshimet se vendimmarrjet e tij mund t\u00eb jen\u00eb ndikuar nga faktor\u00eb politik\u00eb ose grupe interesi brenda vet\u00eb sistemit gjyq\u00ebsor. K\u00ebto ndikime nuk shfaqen gjithmon\u00eb n\u00eb form\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb, por shpesh p\u00ebrmes:<\/p>\n<p class=\"TableParagraph\">presioneve t\u00eb brendshme mbi stafin hetimor, filtrimit t\u00eb informacionit q\u00eb publikohet, ose p\u00ebrzgjedhjes strategjike t\u00eb rasteve q\u00eb sh\u00ebrbejn\u00eb p\u00ebr \u201cbalanc\u00eb\u201d politike.<\/p>\n<p class=\"TableParagraph\">Kjo sjellje ka krijuar munges\u00eb besueshm\u00ebrie dhe ka forcuar perceptimin se ILD nuk \u00ebsht\u00eb imun ndaj ndikimeve politike, ashtu si\u00e7 parashikohej n\u00eb konceptimin fillestar t\u00eb reform\u00ebs n\u00eb drejt\u00ebsi.<\/p>\n<p class=\"TableParagraph\"><strong>III. ILD pa staf t\u00eb kualifikuar, me munges\u00eb transparence dhe komunikimi me publikun<\/strong><\/p>\n<p class=\"TableParagraph\">Nj\u00eb tjet\u00ebr problem madhor gjat\u00eb vitit 2024 ka qen\u00eb mungesa e stafit t\u00eb kualifikuar dhe kapaciteteve t\u00eb pamjaftueshme teknike p\u00ebr hetime t\u00eb plota dhe t\u00eb shpejta. ILD ka funksionuar shpesh me staf t\u00eb reduktuar, pa ekspert\u00eb t\u00eb mjaftuesh\u00ebm t\u00eb hetimit disiplinor dhe pa mb\u00ebshtetje teknologjike t\u00eb p\u00ebrshtatshme p\u00ebr menaxhimin e informacionit.<\/p>\n<p class=\"TableParagraph\">Kjo situat\u00eb ka penguar nd\u00ebrtimin e nj\u00eb mekanizmi efektiv t\u00eb kontrollit t\u00eb brendsh\u00ebm t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb dhe ka kufizuar ndikimin e ILD-s\u00eb n\u00eb parandalimin e shkeljeve.<\/p>\n<p class=\"TableParagraph\">Gjat\u00eb vitit 2024, raportimet publike t\u00eb ILD-s\u00eb kan\u00eb qen\u00eb t\u00eb kufizuara n\u00eb p\u00ebrmbajtje dhe tep\u00ebr t\u00eb p\u00ebrgjithshme, duke mos ofruar t\u00eb dh\u00ebna konkrete mbi numrin e ankesave t\u00eb trajtuara, vendimet e marra, masat disiplinore t\u00eb propozuara apo ndikimin e hetimeve n\u00eb p\u00ebrmir\u00ebsimin e etik\u00ebs gjyq\u00ebsore.<\/p>\n<p class=\"TableParagraph\">Kjo munges\u00eb transparence ka ndikuar n\u00eb uljen e m\u00ebtejshme t\u00eb besimit t\u00eb publikut dhe ka krijuar perceptimin se institucioni funksionon m\u00eb shum\u00eb n\u00eb m\u00ebnyr\u00eb formale sesa reale.<\/p>\n<p class=\"TableParagraph\">Nj\u00eb sfid\u00eb e vazhdueshme e humbur gjat\u00eb vitit 2024 ka qen\u00eb koordinimi i dob\u00ebt nd\u00ebrinstitucional, sidomos me K\u00ebshillin e Lart\u00eb Gjyq\u00ebsor (KLGJ) dhe K\u00ebshillin e Lart\u00eb t\u00eb Prokuroris\u00eb (KLP). N\u00eb shum\u00eb raste, ILD ka d\u00ebrguar rekomandime p\u00ebr masa disiplinore q\u00eb jan\u00eb rr\u00ebzuar ose zvarritur nga k\u00ebto institucione, duke krijuar ng\u00ebr\u00e7 institucional dhe mosfunksionim t\u00eb zinxhirit t\u00eb p\u00ebrgjegjshm\u00ebris\u00eb n\u00eb drejt\u00ebsi.<\/p>\n<p class=\"TableParagraph\"><strong>IV. Munges\u00eb vizioni strategjik p\u00ebr p\u00ebrmir\u00ebsimin e sistemit t\u00eb drejt\u00ebsis<\/strong>\u00eb<\/p>\n<p class=\"TableParagraph\">N\u00eb vend q\u00eb t\u00eb ishte nj\u00eb institucion proaktiv, q\u00eb propozon ndryshime ligjore apo administrative p\u00ebr forcimin e integritetit n\u00eb drejt\u00ebsi, ILD edhe gjat\u00eb vitit 2024 \u00ebsht\u00eb perceptuar si nj\u00eb institucion reaktiv, q\u00eb vepron vet\u00ebm pas ankesave individuale.<\/p>\n<p class=\"TableParagraph\">Mungesa e nj\u00eb strategjie afatgjat\u00eb p\u00ebr parandalimin e shkeljeve dhe edukimin etik t\u00eb gjyqtar\u00ebve e prokuror\u00ebve e ka b\u00ebr\u00eb pun\u00ebn e institucionit m\u00eb shum\u00eb procedurale sesa reformuese.<\/p>\n<p class=\"TableParagraph\">N\u00eb vend q\u00eb t\u00eb shnd\u00ebrrohej n\u00eb nj\u00eb instrument efikas p\u00ebr forcimin e integritetit n\u00eb sistemin gjyq\u00ebsor, ILD tregoi munges\u00eb t\u00eb nj\u00eb plani afatgjat\u00eb zhvillimi dhe reformimi t\u00eb brendsh\u00ebm. Institucioni nuk paraqiti nj\u00eb strategji t\u00eb qart\u00eb institucionale q\u00eb t\u00eb p\u00ebrcaktonte prioritetet kryesore p\u00ebr hetimet disiplinore, m\u00ebnyrat p\u00ebr parandalimin e shkeljeve dhe instrumentet p\u00ebr forcimin e etik\u00ebs n\u00eb gjyq\u00ebsor e prokurori.<\/p>\n<p class=\"TableParagraph\">N\u00eb munges\u00eb t\u00eb nj\u00eb dokumenti t\u00eb till\u00eb, puna e ILD-s\u00eb u kufizua n\u00eb menaxhimin rutin\u00eb t\u00eb ankesave, pa ndikim t\u00eb matsh\u00ebm n\u00eb p\u00ebrmir\u00ebsimin e sistemit. ILD nuk ka nd\u00ebrmarr\u00eb asnj\u00ebher\u00eb, madje as gjat\u00eb vitit 2024, fushata nd\u00ebrgjegj\u00ebsimi p\u00ebr rritjen e nivelit etik dhe t\u00eb integritetit t\u00eb gjyqtar\u00ebve dhe prokuror\u00ebve.<\/p>\n<p class=\"TableParagraph\">Institucioni veproi kryesisht si nj\u00eb organ reagues, q\u00eb nd\u00ebrhyn vet\u00ebm pas paraqitjes s\u00eb ankesave nga publiku apo institucionet e tjera. Mungesa e iniciativave proaktive p\u00ebr t\u00eb identifikuar problematika t\u00eb p\u00ebrs\u00ebritura n\u00eb sistem, p\u00ebr t\u00eb b\u00ebr\u00eb analiza t\u00eb thelluara mbi shkeljet etike apo p\u00ebr t\u00eb propozuar ndryshime ligjore, e b\u00ebri institucionin t\u00eb mbyllur n\u00eb vetvete dhe t\u00eb paq\u00ebndruesh\u00ebm n\u00eb ndikim publik.<\/p>\n<p class=\"TableParagraph\">N\u00eb thelb, ILD nuk funksionoi si \u201cmotor i p\u00ebrgjegjshm\u00ebris\u00eb\u201d, por si nj\u00eb zyr\u00eb administrative q\u00eb menaxhon raste t\u00eb izoluara, pa nj\u00eb qasje sistemike.<\/p>\n<p class=\"TableParagraph\">N\u00eb t\u00ebr\u00ebsi, viti 2024 tregoi se Inspektori i Lart\u00eb i Drejt\u00ebsis\u00eb mbeti nj\u00eb hallk\u00eb tejet problematike dhe d\u00ebshtake n\u00eb zbatimin real t\u00eb reform\u00ebs n\u00eb drejt\u00ebsi.<\/p>\n<p class=\"TableParagraph\">Pavar\u00ebsisht r\u00ebnd\u00ebsis\u00eb s\u00eb tij ligjore, ILD nuk arriti t\u00eb funksionoj\u00eb si nj\u00eb garant i v\u00ebrtet\u00eb i p\u00ebrgjegjshm\u00ebris\u00eb s\u00eb sistemit gjyq\u00ebsor, p\u00ebr shkak t\u00eb ndikimeve politike, vonesave, munges\u00ebs s\u00eb transparenc\u00ebs, koordinimit t\u00eb dob\u00ebt dhe kapaciteteve t\u00eb pamjaftueshme. \u200e<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nga Bujar Leskaj Reforma n\u00eb drejt\u00ebsi synonte q\u00eb Inspektori i Lart\u00eb i Drejt\u00ebsis\u00eb (ILD), i cili duhej t\u00eb ishte nj\u00eb prej mekanizmave ky\u00e7 p\u00ebr p\u00ebrgjegjshm\u00ebrin\u00eb dhe etik\u00ebn e gjyqtar\u00ebve e prokuror\u00ebve, \u00e7ka parashikohej edhe n\u00eb nenet 147 pika d, dh, e, \u00eb e Kushtetut\u00ebs, t\u00eb realizohej plot\u00ebsisht.
