Procesi mbetet ende larg objektivave t\u00eb vendosura nga vet\u00eb ligjv\u00ebn\u00ebsi dhe partner\u00ebt nd\u00ebrkomb\u00ebtar\u00eb.<\/p>\n<p>Nj\u00eb nga mang\u00ebsit\u00eb m\u00eb t\u00eb m\u00ebdha t\u00eb KLGJ-s\u00eb gjat\u00eb vitit 2024 ishte mungesa e theksuar e trup\u00ebs gjyq\u00ebsore n\u00eb t\u00eb gjitha nivelet e sistemit. Procesi i vetingut, dor\u00ebheqjet, pezullimet dhe vonesat n\u00eb em\u00ebrimet e reja krijuan boshll\u00ebqe t\u00eb m\u00ebdha n\u00eb gjykata, sidomos n\u00eb Gjykat\u00ebn e Apelit t\u00eb Tiran\u00ebs dhe n\u00eb gjykatat administrative.<\/p>\n<p><strong><em>I. Shtim i ndjesh\u00ebm i <\/em><\/strong><strong><em>stokut t\u00eb \u00e7\u00ebshtjeve t\u00eb pashqyrtuara<\/em><\/strong><\/p>\n<p>Sipas t\u00eb dh\u00ebnave t\u00eb vet\u00eb KLGJ-s\u00eb, n\u00eb fund t\u00eb vitit 2024 kishte nj\u00eb munges\u00eb prej mbi 25% t\u00eb gjyqtar\u00ebve t\u00eb nevojsh\u00ebm p\u00ebr funksionimin normal t\u00eb gjykatave. Procesi i vetingut la pas nj\u00eb munges\u00eb t\u00eb madhe burimesh njer\u00ebzore, q\u00eb KLGJ nuk arriti ta kompensoj\u00eb n\u00eb koh\u00eb me em\u00ebrime t\u00eb reja gjat\u00eb vitit 2024. Kjo situat\u00eb solli (i) shtim t\u00eb ndjesh\u00ebm t\u00eb stokut t\u00eb \u00e7\u00ebshtjeve t\u00eb pashqyrtuara, (ii) zvarritje t\u00eb theksuara t\u00eb proceseve gjyq\u00ebsore dhe r\u00ebnie t\u00eb thell\u00eb t\u00eb besimit t\u00eb publikut tek efi\u00e7ienca e sistemit.<\/p>\n<p>Edhe pse Harta e Re Gjyq\u00ebsore hyri n\u00eb zbatim p\u00ebrfundimtar n\u00eb vitin 2023, viti 2024 nxori n\u00eb pah nj\u00eb s\u00ebr\u00eb v\u00ebshtir\u00ebsish praktike. Procesi i bashkimit t\u00eb disa gjykatave n\u00eb t\u00eb gjith\u00eb territorin e Shqip\u00ebris\u00eb, n\u00eb kuad\u00ebr t\u00eb Hart\u00ebs p\u00ebrfaq\u00ebson nj\u00eb nga ndryshimet m\u00eb t\u00eb m\u00ebdha dhe nj\u00ebkoh\u00ebsisht m\u00eb t\u00eb debatueshme t\u00eb reform\u00ebs n\u00eb drejt\u00ebsi.<\/p>\n<p>Edhe pse synimi kryesor i saj ishte p\u00ebrmir\u00ebsimi i eficienc\u00ebs s\u00eb sistemit gjyq\u00ebsor dhe shp\u00ebrndarja m\u00eb racionale e burimeve, zbatimi praktik gjat\u00eb viteve 2023\u20132024 provoi d\u00ebshtimin e saj, duke sjell\u00eb nj\u00eb s\u00ebr\u00eb problematikash t\u00eb theksuara, q\u00eb kan\u00eb ndikuar n\u00eb p\u00ebrkeq\u00ebsimin e funksionimit t\u00eb gjykatave dhe ka d\u00ebmtuar qasjen e qytetar\u00ebve ndaj drejt\u00ebsis\u00eb.<\/p>\n<p>N\u00eb vend q\u00eb t\u00eb sillte efikasitet, bashkimi i gjykatave gjat\u00eb 2024-s krijoi bllokime administrative dhe ngadal\u00ebsim t\u00eb ndjesh\u00ebm t\u00eb ritmit t\u00eb gjykimeve, duke v\u00ebn\u00eb n\u00eb pik\u00ebpyetje p\u00ebrfitimet reale t\u00eb reform\u00ebs.Nga ana tjet\u00ebr, u rrit ndjesh\u00ebm stresi profesional dhe rreziku i vendimeve t\u00eb nxituara nga gjyqtar\u00ebt q\u00eb mbartin disa funksione paralelisht.<\/p>\n<p>Nj\u00eb nd\u00ebr pasojat m\u00eb t\u00eb ndjeshme t\u00eb bashkimit t\u00eb gjykatave \u00ebsht\u00eb larg\u00ebsia e re q\u00eb qytetar\u00ebt duhet t\u00eb p\u00ebrshkojn\u00eb p\u00ebr t\u00eb marr\u00eb sh\u00ebrbime gjyq\u00ebsore. P\u00ebr shembull, banor\u00ebt e rretheve q\u00eb m\u00eb par\u00eb kishin gjykata funksionale, si Kruja, Lushnja, Lezha, Puka apo P\u00ebrmeti, tani duhet t\u00eb udh\u00ebtojn\u00eb drejt qyteteve t\u00eb tjera, shpesh dhjet\u00ebra kilometra larg, p\u00ebr t\u00eb ndjekur proceset e tyre.<\/p>\n<p>Kjo ka sjell\u00eb kosto shtes\u00eb financiare p\u00ebr udh\u00ebtim dhe akomodim, humbje kohe p\u00ebr pal\u00ebt dhe d\u00ebshmitar\u00ebt dhe v\u00ebshtir\u00ebsi p\u00ebr shtresat n\u00eb nevoj\u00eb p\u00ebr t\u00eb ndjekur \u00e7\u00ebshtjet gjyq\u00ebsore. N\u00eb shum\u00eb raste, qytetar\u00ebt jan\u00eb detyruar t\u00eb braktisin apo shtyjn\u00eb ndjekjen e proceseve, p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb mund\u00ebsive t\u00eb tyre ekonomike.<\/p>\n<p><strong><em>II. KLGJ e vonoi vet\u00eb shtimin e gjyqtar\u00ebve. Lejoi mbingarkes\u00eb t\u00eb shtuar n\u00eb gjykatat prit\u00ebse<\/em><\/strong><\/p>\n<p>KLGJ, q\u00eb ka n\u00eb dor\u00eb karrier\u00ebn, vler\u00ebsimin dhe l\u00ebvizjet e gjyqtar\u00ebve, u tregua edhe gjat\u00eb vitit 2024 tejet i ngadalt\u00eb dhe me munges\u00eb t\u00eb theksuar transparence n\u00eb procedurat e em\u00ebrimeve.<\/p>\n<p>N\u00eb disa raste, proceset u zvarrit\u00ebn p\u00ebr muaj t\u00eb t\u00ebr\u00eb, p\u00ebr shkak t\u00eb mosmarr\u00ebveshjeve brenda vet\u00eb K\u00ebshillit, munges\u00ebs s\u00eb kuorumit apo debatit mbi kriteret e p\u00ebrzgjedhjes. Kjo vones\u00eb ndikoi n\u00eb (i) vakanca t\u00eb zgjatura n\u00eb gjykata ky\u00e7e, n\u00eb (ii) rritje t\u00eb ndjesis\u00eb s\u00eb pasiguris\u00eb tek gjyqtar\u00ebt dhe n\u00eb (iii) n\u00eb mosfunksionim t\u00eb plot\u00eb, sidomos t\u00eb gjykatave t\u00eb apelit, q\u00eb mbet\u00ebn me num\u00ebr t\u00eb kufizuar gjyqtar\u00ebsh.<\/p>\n<p>Nga ana tjet\u00ebr, bashkimi i disa gjykatave ka \u00e7uar n\u00eb shtim t\u00eb menj\u00ebhersh\u00ebm t\u00eb numrit t\u00eb \u00e7\u00ebshtjeve n\u00eb gjykatat prit\u00ebse, pa u shoq\u00ebruar me shtim proporcional t\u00eb gjyqtar\u00ebve, sekretar\u00ebve dhe infrastruktur\u00ebs.<\/p>\n<p>Kjo ka rezultuar n\u00eb rritje t\u00eb stokut t\u00eb \u00e7\u00ebshtjeve t\u00eb pashqyrtuara, vonesa n\u00eb caktimin e seancave, n\u00eb zvarritje t\u00eb vendimeve dhe n\u00eb ulje t\u00eb cil\u00ebsis\u00eb s\u00eb shqyrtimit gjyq\u00ebsor.<\/p>\n<p>N\u00eb disa raste, p\u00ebr shembull, n\u00eb Gjykat\u00ebn e Shkodr\u00ebs dhe t\u00eb Vlor\u00ebs, raportet e vitit 2024 treguan se ngarkesa p\u00ebr \u00e7do gjyqtar ishte rritur me 30\u201340%, krahasuar me vitin paraardh\u00ebs.<\/p>\n<p>Shum\u00eb nga gjykatat q\u00eb u shnd\u00ebrruan n\u00eb \u201cqendra prit\u00ebse\u201d nuk pat\u00ebn edhe gjat\u00eb vitit 2024 kapacitete fizike dhe logjistike p\u00ebr t\u00eb p\u00ebrballuar fluksin e ri. N\u00eb disa prej tyre mungonin zyrat p\u00ebr gjyqtar\u00ebt dhe stafin, sallat e seancave gjyq\u00ebsore ishin t\u00eb pamjaftueshme, nd\u00ebrsa kushtet e pritjes p\u00ebr qytetar\u00ebt mbet\u00ebn t\u00eb pap\u00ebrshtatshme.<\/p>\n<p>Transferimi i dosjeve fizike nga gjykatat e mbyllura ka qen\u00eb nj\u00eb proces i gjat\u00eb dhe i ngadalsh\u00ebm, duke krijuar konfuzion dhe vonesa n\u00eb regjistrimin e \u00e7\u00ebshtjeve.<\/p>\n<p>Nj\u00eb tjet\u00ebr problem i r\u00ebnd\u00ebsish\u00ebm ishte mungesa e nj\u00eb sistemi t\u00eb unifikuar elektronik q\u00eb t\u00eb ndihmonte n\u00eb integrimin e \u00e7\u00ebshtjeve dhe t\u00eb t\u00eb dh\u00ebnave nd\u00ebrmjet gjykatave t\u00eb bashkuara.<br \/>\nSistemi ICMS (Information Case Management System) funksionon n\u00eb m\u00ebnyr\u00eb t\u00eb pjesshme dhe jo t\u00eb standardizuar, duke b\u00ebr\u00eb q\u00eb proceset e transferimit t\u00eb t\u00eb dh\u00ebnave dhe menaxhimit t\u00eb \u00e7\u00ebshtjeve t\u00eb b\u00ebhen manualisht.<\/p>\n<p>E gjitha kjo krijon rrezik t\u00eb lart\u00eb p\u00ebr (i) humbje ose d\u00ebmtime t\u00eb dokumentacionit, (ii) munges\u00eb transparence dhe vonesa n\u00eb raportimet statistikore.<\/p>\n<p>Procesi i zbatimit t\u00eb hart\u00ebs s\u00eb re gjyq\u00ebsore pati edhe gjat\u00eb vitit 2024 munges\u00ebn e nj\u00eb konsultimi t\u00eb gjer\u00eb me grupet e interesit, p\u00ebrfshir\u00eb shoq\u00ebrin\u00eb civile, avokat\u00ebt dhe komunitetet lokale. Shum\u00eb vendime ishin t\u00eb nxituara, nd\u00ebrsa komunikimi i K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor me publikun ishte i kufizuar.<\/p>\n<p>Kjo munges\u00eb transparence ka ndikuar n\u00eb uljen e besimit t\u00eb qytetar\u00ebve tek q\u00ebllimi i reform\u00ebs n\u00eb drejt\u00ebsi dhe ka krijuar perceptimin se bashkimi i gjykatave nuk u b\u00eb p\u00ebr leht\u00ebsimin e qytetar\u00ebve, por p\u00ebr kursim buxhetor.<\/p>\n<p><strong><em>III. Probleme t\u00eb r\u00ebnda me aksesin n\u00eb drejt\u00ebsi dhe barazin\u00eb territoriale<\/em><\/strong><\/p>\n<p>N\u00eb thelb, bashkimi i gjykatave ka prekur parimin e aksesit t\u00eb barabart\u00eb n\u00eb drejt\u00ebsi. Qytetar\u00ebt q\u00eb jetojn\u00eb n\u00eb zona rurale apo t\u00eb thella jan\u00eb sot m\u00eb t\u00eb penalizuar p\u00ebr t\u00eb ndjekur proceset gjyq\u00ebsore.<br \/>\nN\u00eb disa zona, mungesa e transportit publik dhe kostot e larta e kan\u00eb b\u00ebr\u00eb drejt\u00ebsin\u00eb m\u00eb pak t\u00eb arritshme . Ky zhvillim bie ndesh n\u00eb m\u00ebnyr\u00eb skandaloze me standardet e Bashkimit Europian p\u00ebr drejt\u00ebsi gjith\u00ebp\u00ebrfshir\u00ebse dhe efektive.<\/p>\n<p>Ndryshimet n\u00eb juridiksion, rritja e fluksit dhe puna n\u00eb kushte t\u00eb mbingarkuara kan\u00eb ndikuar n\u00eb cil\u00ebsin\u00eb e vendimmarrjes dhe n\u00eb motivimin e personelit. KLGJ nuk garantoi paralelisht edhe gjat\u00eb vitit t\u00eb kaluar, investime infrastrukturore dhe teknologjike, p\u00ebr ta b\u00ebr\u00eb Hart\u00ebn e re funksionale n\u00eb praktik\u00eb.<\/p>\n<p>Gjat\u00eb vitit 2024, K\u00ebshilli u p\u00ebrball me vonesat n\u00eb p\u00ebrfundimin e procesit t\u00eb rekrutimit t\u00eb inspektor\u00ebve gjyq\u00ebsor\u00eb, sekretar\u00ebve gjyq\u00ebsor\u00eb dhe personelit mb\u00ebshtet\u00ebs, \u00e7ka ndikoi negativisht n\u00eb ecurin\u00eb e pun\u00ebs. Po ashtu, proceset e vler\u00ebsimit t\u00eb gjyqtar\u00ebve dhe karrier\u00ebs s\u00eb tyre mbet\u00ebn t\u00eb pjesshme, duke krijuar pasiguri n\u00eb promovime dhe transferime.<\/p>\n<p><strong><em>IV. Munges\u00eb buxheti, digjitalizim i vonuar dhe infrastruktur\u00eb tejet e amortizuar<\/em><\/strong><\/p>\n<p>Nj\u00eb tjet\u00ebr problem i theksuar gjat\u00eb vitit 2024 ishte financimi i pamjaftuesh\u00ebm i sistemit gjyq\u00ebsor. Shum\u00eb gjykata funksionuan n\u00eb ambiente t\u00eb amortizuara, me munges\u00eb sallash gjykimi dhe pajisjesh bazike, nd\u00ebrsa investimet p\u00ebr teknologji dhe arkiva mbet\u00ebn minimale. Gjykatat u p\u00ebrball\u00ebn me munges\u00eb zyrash, kushte jo dinjitoze pune dhe vonesa n\u00eb proceset e digjitalizimit.<\/p>\n<p>P\u00ebrkund\u00ebr r\u00ebnd\u00ebsis\u00eb q\u00eb merr teknologjia n\u00eb administrimin e drejt\u00ebsis\u00eb moderne, digjitalizimi i gjykatave mbeti n\u00eb nivele t\u00eb ul\u00ebta. Sistemi elektronik p\u00ebr menaxhimin e \u00e7\u00ebshtjeve (ICMS) funksionoi pjes\u00ebrisht dhe jo n\u00eb m\u00ebnyr\u00eb t\u00eb nj\u00ebtrajtshme n\u00eb t\u00eb gjitha gjykatat.<\/p>\n<p>Kjo munges\u00eb uniformiteti pengoi (i) monitorimin efektiv t\u00eb \u00e7\u00ebshtjeve, (ii) transparenc\u00ebn p\u00ebr publikun dhe (iii) shkurtimin e koh\u00ebs s\u00eb procedurave.<\/p>\n<p><strong><em>V. Transparenc\u00eb dhe komunikim publik i kufizuar<\/em><\/strong><\/p>\n<p>Nj\u00eb tjet\u00ebr mang\u00ebsi e KLGJ-s\u00eb gjat\u00eb vitit 2024 ishte mungesa e komunikimit t\u00eb qart\u00eb dhe t\u00eb rregullt me publikun dhe median. Raportet vjetore, vendimet dhe proceset e r\u00ebnd\u00ebsishme shpesh nuk u publikuan n\u00eb koh\u00eb, nd\u00ebrsa p\u00ebrfshirja e shoq\u00ebris\u00eb civile n\u00eb diskutimet mbi politikat e drejt\u00ebsis\u00eb mbeti formale. Raportimet p\u00ebr performanc\u00ebn e gjykatave munguan ose ishin t\u00eb paqarta.<\/p>\n<p>E gjith\u00eb kjo situat\u00eb ka rritur perceptimin se KLGJ po vepron me burokraci t\u00eb mbyllur, pa llogaridh\u00ebnie t\u00eb mjaftueshme ndaj publikut, gj\u00eb q\u00eb bie ndesh me transparenc\u00ebn q\u00eb reforma n\u00eb drejt\u00ebsi duhet t\u00eb sillte. Kjo ka ndikuar n\u00eb perceptimin e ul\u00ebt t\u00eb transparenc\u00ebs dhe llogaridh\u00ebnies s\u00eb institucionit tek qytetari dhe publiku.<\/p>\n<p>xxx<\/p>\n<p>Reforma n\u00eb drejt\u00ebsi n\u00ebn drejtimin e KLGJ-s\u00eb, n\u00eb zbatim praktik gjat\u00eb vitit 2024, tregoi mang\u00ebsi dhe kufizime t\u00eb dukshme, q\u00eb rrezikojn\u00eb d\u00ebshtimin e plot\u00eb t\u00eb saj.<\/p>\n<p>K\u00ebshilli i Lart\u00eb Gjyq\u00ebsor, si institucioni p\u00ebrgjegj\u00ebs p\u00ebr administrimin e sistemit gjyq\u00ebsor, nuk arriti t\u00eb siguroj\u00eb ritmin dhe koherenc\u00ebn q\u00eb k\u00ebrkon nj\u00eb proces kaq kompleks. Problemet me munges\u00ebn e gjyqtar\u00ebve, mbingarkes\u00ebn e gjykatave, digjitalizimin e ngadalt\u00eb, nd\u00ebrhyrjet dhe ndikimin e fort\u00eb t\u00eb sektit Rama n\u00eb qeverisje, si dhe munges\u00ebn e transparenc\u00ebs, e kan\u00eb degraduar reform\u00ebn n\u00eb drejt\u00ebsi m\u00eb shum\u00eb n\u00eb nj\u00eb proces administrativ, sesa nj\u00eb transformim real n\u00eb funksion t\u00eb qytetar\u00ebve.<\/p>\n<p>KLGJ edhe gjat\u00eb vitit 2024 nuk arriti t\u00eb rikthej\u00eb efi\u00e7ienc\u00ebn, profesionalizmin dhe besimin e \u00a0humbur publik n\u00eb gjyq\u00ebsorin, duke rrezikuar q\u00eb reforma t\u00eb humbas\u00eb q\u00ebllimin e saj kryesor, nd\u00ebrtimin e nj\u00eb drejt\u00ebsie t\u00eb pavarur, t\u00eb shpejt\u00eb dhe t\u00eb drejt\u00eb p\u00ebr \u00e7do qytetar shqiptar.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nga Bujar Leskaj Viti 2024 d\u00ebshmoi se K\u00ebshilli i Lart\u00eb i Gjyq\u00ebsorit pati nj\u00eb s\u00ebr\u00eb problematikash t\u00eb thella strukturore dhe funksionale, t\u00eb cilat, nj\u00eblloj si vitet e m\u00ebparshme, e kufizuan ndjesh\u00ebm efektivitetin e institucionit dhe soll\u00ebn realizimin shum\u00eb t\u00eb keq t\u00eb reform\u00ebs n\u00eb drejt\u00ebsi.
