Si i fshehu Balluku ankesat e kompanive dhe favorizoi turqit"},"content":{"rendered":"<p><strong>Emisioni Vetting<\/strong><\/p>\n<p>M\u00eb 19 Qershor 2020, Ministria e Infrastruktur\u00ebs dhe Energjis\u00eb do t\u00eb hapte gar\u00ebn nd\u00ebrkomb\u00ebtare p\u00ebr rishikimin e studimit t\u00eb fizibilitetit dhe hartimin e projektit inxhinierik \u201cNd\u00ebrtimi i Tunelit t\u00eb Llogaras\u00eb\u201d me fond limit 624 milion\u00eb lek\u00eb ose 6 milion\u00eb euro. N\u00eb gar\u00ebn p\u00ebr projektimin e tunelit mor\u00ebn pjes\u00eb 8 kompani, nga t\u00eb cilat 6 u skualifikuan automatikisht nga Ministria e Infrastruktur\u00ebs, p\u00ebr mosplot\u00ebsim kushtesh.<\/p>\n<p>M\u00eb tetor 2020, institucioni publik do t\u00eb shpallte fitues konsorciumin e kompanive \u201cSEED Consulting\u201d, \u201cInfraKonsult\u201d, \u201ciC Consulenten Ziviltechniker GESmbh\u201d, \u201cELEA iC d.o.o\u201d dhe \u201cIBE d.d svetovanje, projektiranje in inzeniring\u201d, me ofert\u00eb 618 milion\u00eb lek\u00eb ose rreth 6 milion\u00eb euro.<\/p>\n<p>N\u00eb gar\u00eb u kualifikuan edhe bashkimi i kompanive \u201cSWS Engineering\u201d spa , \u201cLLAZO\u201d shpk dhe \u201cNET-GROUP\u201d me ofert\u00eb 540 milion\u00eb lek\u00eb. Kjo e fundit \u00ebsht\u00eb kompania e Valter Begajt, ish-ortaku i ish Drejtorit t\u00eb ARRSH-s\u00eb, Evis Berberi, q\u00eb t\u00eb dy t\u00eb arrestuar dhe n\u00ebn hetim nga SPAK p\u00ebr tenderat e fituar nga Autoriteti Rrugor Shqiptar.<\/p>\n<p>Pas p\u00ebrfundimit t\u00eb gar\u00ebs p\u00ebr studimin e fizibilitetit, m\u00eb 14 dhjetor 2020, Ministria e Infrastruktur\u00ebs dhe Energjis\u00eb do t\u00eb hapte gar\u00ebn p\u00ebr tenderin e par\u00eb p\u00ebr \u201cNd\u00ebrtimin e Tunelit t\u00eb Llogaras\u00eb\u201d n\u00eb seksionin rrugor Orikum-Himar\u00eb pjes\u00eb e Autostrad\u00ebs SH8 (Vlor\u00eb \u2013 Sarand\u00eb) me fond limit 19 miliard\u00eb lek\u00eb ose 190 milion\u00eb euro.<\/p>\n<p><span style=\"font-style: inherit; font-weight: inherit;\">Ky tunel parashikohet t\u00eb ket\u00eb nj\u00eb gjat\u00ebsi prej rreth 6 kilometrash dhe nis nga ura e Sh\u00ebn Eliz\u00ebs n\u00eb zon\u00ebn e Dukatit deri n\u00eb ur\u00ebn e Palas\u00ebs. Sipas p\u00ebrllogaritjeve, duke kaluar p\u00ebrmes k\u00ebtij tuneli, me nj\u00eb shpejt\u00ebsi 50-80 km\/or\u00eb, koha p\u00ebr t\u00eb kaluar nga nj\u00eb an\u00eb e Llogaras\u00eb n\u00eb tjetr\u00eben do t\u00eb jet\u00eb 7- 10 minuta. Tuneli do t\u00eb lidhet n\u00eb hyrje dhe dalje t\u00eb tij nga dy ura. Kalimi i automjeteve t\u00eb transportit rrugor n\u00eb k\u00ebt\u00eb tunel do t\u00eb jet\u00eb me pages\u00eb.<\/span><\/p>\n<p>Sipas avokatit Leonard Karaj zbulohet se kemi mosrealizim punimesh me vler\u00eb deri n\u00eb 3 miliard\u00eb lek\u00eb, q\u00eb lidhen me urat.<\/p>\n<p>\u201c<em style=\"font-weight: inherit;\">N\u00eb projekt jan\u00eb p\u00ebrcaktuar qart\u00eb dy ura t\u00eb val\u00ebzuara, nj\u00eb n\u00eb hyrje dhe nj\u00eb n\u00eb dalje t\u00eb tunelit. K\u00ebto ishin m\u00eb tep\u00ebr dy ura q\u00eb do t\u2019i jepnin bukurin\u00eb asaj vepre dhe kushtojn\u00eb 25-30 milion\u00eb euro. Urat rezultojn\u00eb brenda projektit, por nuk jan\u00eb realizuar n\u00ebse shkoni n\u00eb vendin ku \u00ebsht\u00eb zhvilluar projekti<\/em>\u201d, u shpreh avokati Karaj.<\/p>\n<p>Por n\u00eb dokumentet e tenderit t\u00eb par\u00eb \u00ebsht\u00eb specifikuar se kompania q\u00eb do t\u00eb shpallet fituese, do t\u00eb ket\u00eb n\u00eb dispozicion 37 muaj ose, nj\u00eb muaj m\u00eb shum\u00eb se tre vite p\u00ebr t\u00eb realizuar kontrat\u00ebn.<\/p>\n<p>Gara p\u00ebr tenderin, i cili m\u00eb von\u00eb do t\u00eb anulohej, do t\u00eb shfaqte indiciet e para p\u00ebr korrupsion. \u201cVetting\u201d do t\u00eb zbulonte me fakte se si n\u00eb k\u00ebt\u00eb gar\u00eb do t\u00eb diskriminoheshin kompani q\u00eb kan\u00eb fuqin\u00eb dhe eksperienc\u00ebn p\u00ebr t\u00eb realizuar projekte t\u00eb tilla. Konkretisht, sipas dokumenteve, kompania garuese duhet t\u00eb demonstroj\u00eb kapacitetin teknik p\u00ebr realizimin e tunelit, si dhe t\u00eb plot\u00ebsoj\u00eb disa kushte specifike. Sipas Dokumenteve Standarteve t\u00eb Tenderit (DST) kompania garuese duhet t\u00eb demonstronte p\u00ebrvoj\u00ebn e suksesshme si kontraktor kryesor p\u00ebr nj\u00eb kontrat\u00eb ose kontrata q\u00eb p\u00ebrfshijn\u00eb minimalisht nd\u00ebrtimin e 4 (kat\u00ebr) urave me gjat\u00ebsi p\u00ebr ur\u00eb prej t\u00eb pakt\u00ebn 120 m.<\/p>\n<p>N\u00eb k\u00ebt\u00eb faz\u00eb vjen edhe nj\u00eb pyetje: P\u00ebrse nj\u00eb kompani garuese n\u00eb k\u00ebt\u00eb tender duhet t\u00eb ket\u00eb nd\u00ebrtuar patjet\u00ebr nj\u00eb projekt me 4 ura, me gjat\u00ebsi 120 m, kur projektin mund ta realizoj\u00eb edhe n\u00ebse ka nd\u00ebrtuar nj\u00eb ur\u00eb me gjat\u00ebsi 500 m?<\/p>\n<p>Nga dosja e SPAK evidentohet se shum\u00eb kompani kan\u00eb b\u00ebr\u00eb ankesa p\u00ebr tenderin e par\u00eb t\u00eb anuluar para se t\u00eb aplikonin pasi kishte kritere diskriminuese, por k\u00ebto nuk jan\u00eb marr\u00eb parasysh nga Autoriteti Rrugor Shqiptar. Nga komunikimet midis zv.kryeministres Balluku dhe ish drejtorit t\u00eb ARRSH-s\u00eb zbulohet se p\u00ebr tenderin e par\u00eb t\u00eb tunelit t\u00eb Llogaras\u00eb, Balluku do t\u00eb urdh\u00ebronte Berberin ta anulonte.<\/p>\n<p>Vet\u00eb Ligji nr. 162\/2020 i Prokurimeve Publike ka si synim t\u00eb siguroj\u00eb mir\u00ebp\u00ebrdorimin e fondeve publike dhe t\u00eb nxis\u00eb pjes\u00ebmarrjen e kompanive private n\u00eb procedurat e tenderave. E th\u00ebn\u00eb shkurt, t\u00eb realizohen projektet sipas kushteve t\u00eb p\u00ebrcaktuara me \u00e7mimin m\u00eb ekonomik. Madje, ky ligji ka nj\u00eb nen specifik p\u00ebr rastin e diskriminimit t\u00eb operator\u00ebve ekonomik\u00eb.<\/p>\n<p>Vet\u00ebm duke konstatuar kriteret specifike q\u00eb jan\u00eb vendosur te tenderi p\u00ebr nd\u00ebrtimin e urave, \u201cVetting\u201d ka zbuluar faktin se kemi t\u00eb b\u00ebjm\u00eb me shkelje t\u00eb nenit 2 t\u00eb ligjit t\u00eb Prokurimeve Publike.<\/p>\n<p>Kjo pasi Ministria e Infrastruktur\u00ebs parashikonte dor\u00ebzimin e ofertave p\u00ebr nd\u00ebrtimin e tunelit t\u00eb Llogoras\u00eb me 12 shkurt 2021, por e shtyu k\u00ebt\u00eb afat deri n\u00eb 1 mars 2021. Nga dokumentet e siguruara nga \u201cVetting\u201d, Ministria ka b\u00ebr\u00eb disa ndryshime p\u00ebrsa u takon kritereve p\u00ebr kompanit\u00eb q\u00eb jan\u00eb t\u00eb interesuara p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb gar\u00eb.<\/p>\n<p>Konkretisht, kan\u00eb ndodhur disa ndryshime n\u00eb kapitullin 12, ku gjenden kushtet specifike t\u00eb kualifikimit q\u00eb lidhen me kapacitetet financiare dhe ekonomike. Aty shpjegohet se p\u00ebr EBITDA-n, q\u00eb \u00ebsht\u00eb fitimi p\u00ebrpara interesave, taksave, zhvler\u00ebsimit dhe amortizimit, p\u00ebr pes\u00eb vitet e fundit, pra p\u00ebr periudh\u00ebn 2015-2019, ishte vendosur nj\u00eb shif\u00ebr prej 50 milion\u00eb eurosh. N\u00eb k\u00ebt\u00eb rast, ky kriter \u00ebsht\u00eb ndryshuar dhe \u00ebsht\u00eb ulur n\u00eb 20 milion\u00eb euro.<\/p>\n<p>Por Ministria nuk \u00ebsht\u00eb ndalur me kaq, pasi ka vendosur edhe sqarime t\u00eb tjera p\u00ebr pjes\u00ebn e realizimit t\u00eb nj\u00eb projekti t\u00eb ngjash\u00ebm. N\u00ebse n\u00eb fillim t\u00eb tenderit k\u00ebrkohej q\u00eb kompanit\u00eb t\u00eb provonin se n\u00eb 5 vitet e fundit kishin nd\u00ebrtuar nj\u00eb gjat\u00ebsi prej 8 kilometrash tunel, atyre, n\u00eb arnimin e projektit, u k\u00ebrkohet t\u00eb provojn\u00eb se projektin e kan\u00eb zbatuar me nj\u00eb afat prej 3 vitesh.<\/p>\n<p>Megjithat\u00eb, grupi i prokurimit t\u00eb tenderit n\u00ebn drejtimin e ministres Balluku nuk \u00ebsht\u00eb ndalur me kaq. N\u00ebse n\u00eb fillim t\u00eb projektit k\u00ebrkohej q\u00eb kompania t\u00eb kishte realizuar pun\u00eb t\u00eb ngjashme me nj\u00eb vler\u00eb sa 70% e fondit limit t\u00eb kontrat\u00ebs, ajo ulet n\u00eb 50% t\u00eb fondit limit t\u00eb kontrat\u00ebs.<\/p>\n<p>Pra, kompania duhet t\u00eb ket\u00eb realizuar projekte me vler\u00eb 9,5 miliard\u00eb lek\u00eb ose 95 milion\u00eb euro gjat\u00eb 5 viteve t\u00eb fundit.<\/p>\n<p>Edhe pse Ministria ndryshoi kushtet, p\u00ebrs\u00ebri asnj\u00ebra nga kompanit\u00eb nuk arriti q\u00eb t\u00eb shpallej fituese p\u00ebr k\u00ebt\u00eb projekt.<\/p>\n<p>Nj\u00eb muaj m\u00eb pas, n\u00eb prill 2021, Ministria e Infrastruktur\u00ebs do t\u00eb anulonte tenderin pasi asnj\u00eb nga ofertat e paraqitura nga kompanit\u00eb nuk p\u00ebrputhej me kriteret e p\u00ebrcaktuara te dokumentet.<\/p>\n<p>Por kjo nuk \u00ebsht\u00eb hera e par\u00eb q\u00eb tenderat e m\u00ebdhenj prodhojn\u00eb situata t\u00eb tilla, t\u00eb ndryshimeve t\u00eb m\u00ebdha, q\u00eb shpesh p\u00ebrkojn\u00eb vet\u00ebm me k\u00ebrkesat q\u00eb vijn\u00eb nga vet\u00eb grupet e interesit. Dyshimet p\u00ebr korrupsion me fondet publike p\u00ebrforcohen nga ndryshimi i dokumenteve, por edhe nga zgjatja e afateve t\u00eb k\u00ebtij tenderi.<\/p>\n<p>Disa muaj pas anulimit t\u00eb tenderit p\u00ebr tunelin e Llogaras\u00eb, Ministria e Infrastruktur\u00ebs do t\u00eb rishpallte p\u00ebrs\u00ebri tenderin me fond limit 18.9 miliard\u00eb lek\u00eb. N\u00eb gar\u00eb k\u00ebsaj radhe do t\u00eb merrnin pjes\u00eb 4 grupe kompanish. Pas studimit t\u00eb dokumenteve t\u00eb tenderit, Open Data Albania e sh\u00ebnoi me flamur t\u00eb kuq.<\/p>\n<p>Kjo pasi m\u00eb 8 tetor 2021, Ministria e Infrastruktur\u00ebs do t\u00eb skualifikonte t\u00eb gjith\u00eb pjes\u00ebmarr\u00ebsit, me p\u00ebrjashtim t\u00eb konsorciumit t\u00eb kompanive turke \u201cINTEKAR YAPI TURIZM ELEKTRIK INSAAT\u201d dhe \u201cASL INSAAT TAAHHUT\u201d, t\u00eb cil\u00ebt u shpall\u00ebn automatikisht fituese me ofert\u00eb 17 miliard\u00eb lek\u00eb ose 200 milion\u00eb euro me TVSH.<\/p>\n<p>Sipas Open Data, ky tender paraqet rrezik t\u00eb mundsh\u00ebm p\u00ebr korrupsion, p\u00ebr shkak t\u00eb skualifikimit t\u00eb paqart\u00eb t\u00eb konkurrent\u00ebve. Bie n\u00eb sy fakti se, grupi i kompanive shqiptare dhe t\u00eb huaj, \u201cJV CONCORD ENGINEERING AND CONTRACTING\u201d, \u201cALB BUILDING\u201d shpk dhe \u201cALB STAR\u201d, kishin ofert\u00eb m\u00eb t\u00eb ul\u00ebt se kompanit\u00eb turke me vler\u00eb 15.8 miliard\u00eb lek\u00eb.
