{"id":129783,"date":"2025-12-01T09:24:02","date_gmt":"2025-12-01T09:24:02","guid":{"rendered":"https:\/\/rdnews.al\/?p=129783"},"modified":"2025-12-01T09:24:02","modified_gmt":"2025-12-01T09:24:02","slug":"mjerimi-i-komisionit-te-venecias-ne-zyren-e-rames","status":"publish","type":"post","link":"https:\/\/rdnews.al\/index.php\/2025\/12\/01\/mjerimi-i-komisionit-te-venecias-ne-zyren-e-rames\/","title":{"rendered":"Mjerimi i Komisionit t\u00eb Venecias n\u00eb zyr\u00ebn e Ram\u00ebs!"},"content":{"rendered":"<p><strong>Sami NEZA<\/strong><\/p>\n<p>Si\u00e7 ka vepruar edhe n\u00eb raste t\u00eb tjera kur kryeministri Rama citon nd\u00ebrkomb\u00ebtar\u00ebt p\u00ebr hesap t\u00eb interesave t\u00eb tij, edhe k\u00ebsaj rradhe ka deformuar n\u00eb kuptim e n\u00eb sintaks\u00eb at\u00eb \u00e7far\u00eb sanksionon Venecia n\u00eb dokumentat e veta.<br \/>\nN\u00ebse merr n\u00eb dor\u00eb t\u00eb nj\u00ebjtin dokument q\u00eb ka p\u00ebrdor\u00eb Rama p\u00ebr perifrazimet e tij \u201cRaport : Mbi marr\u00ebdh\u00ebniet midis p\u00ebrgjegj\u00ebsis\u00eb politike dhe penale t\u00eb ministrave\u201d, publikim i vitit 2013, \u00ebsht\u00eb qart\u00eb se Kryeministri ka shkoqur pjes\u00eb prej raportit t\u00eb Komisionit t\u00eb Venecias duke i vendosur n\u00eb kontekst favorizues p\u00ebr veten dhe z\u00ebv\u00ebnd\u00ebsen e tij Balluku.<br \/>\nKomisioni i Venecias e pranon n\u00eb m\u00ebnyr\u00eb t\u00eb qart\u00eb q\u00eb an\u00ebtar\u00ebt e qeveris\u00eb (ministra, kryeminist\u00ebr) mund t\u00eb jen\u00eb subjekt i p\u00ebrgjegj\u00ebsis\u00eb penale dhe masave nga gjykatat, por brenda kufijve t\u00eb parashikuar nga kushtetuta, rregullat p\u00ebr imunitetin dhe parimi i ndarjes s\u00eb pushteteve.<br \/>\nVendimi i GJKKO p\u00ebr Ballukun nuk adreson imunitetin e saj.<br \/>\nKomisioni thekson se ministrat i n\u00ebnshtrohen n\u00eb parim ligjit penal t\u00eb zakonsh\u00ebm dhe procedurave t\u00eb zakonshme gjyq\u00ebsore, p\u00ebrve\u00e7 rasteve kur kan\u00eb imunitet t\u00eb parashikuar posa\u00e7\u00ebrisht.<br \/>\nN\u00eb Shqip\u00ebri nuk ka imunitet t\u00eb posa\u00e7\u00ebm p\u00ebr ministrat n\u00eb kuptimin e mbrojtjes p\u00ebrpara p\u00ebrgjegj\u00ebsive penale.<br \/>\nRaporti shpjegon se n\u00eb shum\u00eb vende evropiane ekzistojn\u00eb rregulla t\u00eb posa\u00e7me p\u00ebr p\u00ebrgjegj\u00ebsin\u00eb penale t\u00eb ministrave, por k\u00ebto nuk duhet t\u00eb pengojn\u00eb ndjekjen penale kur shkeljet jan\u00eb serioze. Nd\u00ebrsa flet p\u00ebr Imuniteti e zyrtar\u00ebve dhe kufizimet ndaj gjykatave, Komisioni i Venecias, rekomandon q\u00eb imunitetet p\u00ebr zyrtar\u00eb t\u00eb lart\u00eb t\u00eb jen\u00eb t\u00eb kufizuara, t\u00eb qarta dhe gjithmon\u00eb me mund\u00ebsi heqjeje p\u00ebrmes procedurash t\u00eb paanshme.<br \/>\nNga standardet e Komisionit del qart\u00eb se ministrat dhe kryeministri mund t\u00eb procedohen penalisht dhe t\u00eb d\u00ebnohen nga gjykatat, si \u00e7do zyrtar tjet\u00ebr, n\u00ebse kushtetuta dhe ligjet e vendit parashikojn\u00eb k\u00ebt\u00eb dhe, kur ka imunitet, ai mund t\u00eb hiqet n\u00ebp\u00ebrmjet procedur\u00ebs s\u00eb parashikuar.<br \/>\nT\u00eb tilla ligje jan\u00eb n\u00eb Shqip\u00ebri dhe SPAK E GJKKO jan\u00eb mb\u00ebshtetur tek ato p\u00ebr vendimin ndaj Ballukut.<br \/>\nDokumenti i m\u00ebsip\u00ebrm thekson se Gjykatat penale jan\u00eb forumi normal p\u00ebr t\u00eb gjykuar vepra penale t\u00eb ministrave, nd\u00ebrsa p\u00ebr p\u00ebrgjegj\u00ebsin\u00eb politike (si heqja nga detyra) mekanizmi kryesor mbetet parlamenti p\u00ebrmes mocioneve t\u00eb mosbesimit ose procedurave t\u00eb tjera kushtetuese.<br \/>\nS\u00ebrish nuk kemi interferim pushtetesh mes gjykat\u00ebs e prokuroris\u00eb me ekzekutivin, aq m\u00eb pak me legjislativin.<br \/>\nKomisioni thekson se p\u00ebrgjegj\u00ebsia politike (para parlamentit, elektoratit) \u00ebsht\u00eb m\u00eb e gjer\u00eb dhe nuk mund t\u00eb z\u00ebvend\u00ebsoj\u00eb p\u00ebrgjegj\u00ebsin\u00eb penale kur ka dyshim p\u00ebr vepra penale. Veprimet q\u00eb jan\u00eb thjesht vendime politike t\u00eb diskutueshme nuk duhet t\u00eb kriminalizohen, nd\u00ebrsa shkeljet serioze t\u00eb ligjit (korrupsion, abuzim detyre etj.) duhet t\u00eb ndiqen penalisht.<br \/>\n\u00cbsht\u00eb pik\u00ebrisht ajo q\u00eb ka b\u00ebr\u00eb SPAK dhe GJKKO, kund\u00ebr t\u00eb cilave \u00ebsht\u00eb ngritur Kryeninistri.<br \/>\nSanksionet (d\u00ebnime me burg, gjoba, ndalim funksionesh publike etj.) duhet t\u00eb jen\u00eb efektive dhe proporcionale, duke p\u00ebrfshir\u00eb mund\u00ebsin\u00eb e heqjes nga detyra n\u00ebse parashikohet nga ligji penal ose kushtetuta.<br \/>\nPezullimi nga detyra \u00ebsht\u00eb parashikim i ligjit penal shqiptar dhe i cili \u00ebsht\u00eb zbatuar n\u00eb rastin e Ballukut.<br \/>\nI vetmi moment ku Komisioni i Venecias ndalet pak duke diferencuar ministrat b\u00ebn fjal\u00eb p\u00ebr akuzat shp\u00ebrdorim detyre duke konsideruar se akuza t\u00eb tilla jan\u00eb ve\u00e7an\u00ebrisht problematike, pasi jan\u00eb t\u00eb ekspozuara ndaj p\u00ebrdorimit politik dhe mund t\u00eb shkelin nenin 7 t\u00eb ECHR-s\u00eb( Gjykata Evropiane e t\u00eb Drejtave t\u00eb Njeriut) dhe standardet e shtetit t\u00eb s\u00eb drejt\u00ebs.<br \/>\nMegjithat\u00eb komisioni thekson se akuza t\u00eb tilla duhet t\u00eb interpretohen ngusht\u00eb dhe t\u00eb zbatohen me prag t\u00eb lart\u00eb, duke k\u00ebrkuar kritere shtes\u00eb si dhe duhet t\u00eb merret parasysh natyra e ve\u00e7ant\u00eb e politik\u00ebs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sami NEZA Si\u00e7 ka vepruar edhe n\u00eb raste t\u00eb tjera kur kryeministri Rama citon nd\u00ebrkomb\u00ebtar\u00ebt p\u00ebr hesap t\u00eb interesave t\u00eb tij, edhe k\u00ebsaj rradhe ka deformuar n\u00eb kuptim e n\u00eb sintaks\u00eb at\u00eb \u00e7far\u00eb sanksionon Venecia n\u00eb dokumentat e veta.
