N\u00eb shqyrtimin e \u00e7\u00ebshtjes q\u00eb i p\u00ebrket k\u00ebrkes\u00ebs s\u00eb Kryeministrit t\u00eb Shqip\u00ebris\u00eb, me objekt zgjidhjen e mosmarr\u00ebveshjes s\u00eb kompetencave nd\u00ebrmjet Kryeministrit e K\u00ebshillit t\u00eb Ministrave dhe GJKKO-s\u00eb s\u00eb Shkall\u00ebs s\u00eb Par\u00eb; interpretimin e pik\u00ebs 3 t\u00eb nenit 103 t\u00eb Kushtetut\u00ebs; si dhe shfuqizimin e dy vendimeve gjyq\u00ebsore p\u00ebr caktimin dhe vazhdimin e mas\u00ebs ndaluese t\u00eb pezullimit t\u00eb ushtrimit t\u00eb detyr\u00ebs s\u00eb z\u00ebvend\u00ebskryeministres dhe ministres s\u00eb Infrastruktur\u00ebs dhe Energjis\u00eb, ne, gjyqtar\u00ebt Marsida Xhaferllari, Ilir Toska dhe Asim Vokshi jemi kund\u00ebr vendimit t\u00eb shumic\u00ebs p\u00ebr pezullimin e vendimeve gjyq\u00ebsore, p\u00ebr arsyet e m\u00ebposhtme.<\/p>\n<p>2. K\u00ebrkuesi ka parashtruar se masa ndaluese e pezullimit t\u00eb ushtrimit t\u00eb detyr\u00ebs prek interesa t\u00eb lart\u00eb shtet\u00ebror\u00eb, shoq\u00ebror\u00eb, por edhe t\u00eb vet\u00eb individ\u00ebve. Sipas k\u00ebrkuesit, masa duhet pezulluar p\u00ebr t\u00eb mbrojtur sistemin e qeverisjes dhe p\u00ebr t\u00eb ruajtur funksionalitetin e plot\u00eb t\u00eb K\u00ebshillit t\u00eb Ministrave, i cili ushtron \u00e7do funksion shtet\u00ebror, q\u00eb nuk u \u00ebsht\u00eb dh\u00ebn\u00eb organeve t\u00eb pushteteve t\u00eb tjera shtet\u00ebrore ose t\u00eb qeverisjes vendore. Sipas tij, masa e pezullimit nga detyra sjell pasoja t\u00eb pariparueshme p\u00ebr qeverisjen e vendit, duke krijuar vakum institucional, mosfunksionim t\u00eb K\u00ebshillit t\u00eb Ministrave dhe pamund\u00ebsi p\u00ebr ushtrimin e p\u00ebrgjegj\u00ebsive dhe t\u00eb kompetencave q\u00eb Kushtetuta e legjislacioni n\u00eb fuqi i njeh ekskluzivisht pushtetit ekzekutiv.<\/p>\n<p>Gjithashtu, ka argumentuar k\u00ebrkuesi, \u00ebsht\u00eb n\u00eb interes shtet\u00ebror q\u00eb kompetencat e Kryeministrit, t\u00eb Presidentit dhe t\u00eb Kuvendit t\u00eb vazhdojn\u00eb t\u00eb prodhojn\u00eb efektet juridike. L\u00ebnia n\u00eb fuqi e vendimit gjyq\u00ebsor do t\u00eb thellonte konfliktin e kompetencave nd\u00ebrmjet pushtetit gjyq\u00ebsor, n\u00eb nj\u00ebr\u00ebn an\u00eb, dhe pushteteve legjislative dhe ekzekutive, n\u00eb an\u00ebn tjet\u00ebr, duke cenuar m\u00eb tej parimin e ndarjes e t\u00eb balancimit t\u00eb pushteteve. Pezullimi i nj\u00eb ministri ose z\u00ebvend\u00ebskryeministri nj\u00ebkoh\u00ebsisht pezullon veprimtarin\u00eb e pushtetit ekzekutiv n\u00eb fush\u00ebn e p\u00ebrgjegj\u00ebsis\u00eb s\u00eb ministrit dhe t\u00eb z\u00ebvend\u00ebskryeministrit t\u00eb pezulluar.<\/p>\n<p>Ai krijon vakum institucional n\u00eb realizimin e pushtetit ekzekutiv, por edhe t\u00eb vet\u00eb pushtetit legjislativ, pasi pamund\u00ebson propozimin e projektakteve me r\u00ebnd\u00ebsi komb\u00ebtare p\u00ebr integrimin n\u00eb Bashkimin Evropian. Po k\u00ebshtu, ka argumentuar k\u00ebrkuesi, vendimi prek edhe interesat individual\u00eb t\u00eb qytetar\u00ebve, t\u00eb cil\u00ebt preken n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb nga pezullimi i funksionimit t\u00eb Ministris\u00eb s\u00eb Infrastruktur\u00ebs dhe Energjis\u00eb, si dhe t\u00eb vet\u00eb K\u00ebshillit t\u00eb Ministrave.<\/p>\n<p>3. Sipas nenit 45, pika 1, t\u00eb ligjit organik t\u00eb Gjykat\u00ebs, kjo e fundit kryesisht ose me k\u00ebrkes\u00eb t\u00eb pal\u00ebve, kur vler\u00ebson se zbatimi i ligjit ose i aktit mund t\u00eb sjell\u00eb pasoja q\u00eb prekin interesa shtet\u00ebror\u00eb, shoq\u00ebror\u00eb ose t\u00eb individ\u00ebve, sipas rastit, me vendim t\u00eb Mbledhjes s\u00eb Gjyqtar\u00ebve ose n\u00eb seanc\u00eb plenare urdh\u00ebron pezullimin e tij. Ky rregullim ligjor \u00ebsht\u00eb elaboruar nga Gjykata, e cila n\u00eb jurisprudenc\u00ebn e saj ka pohuar se n\u00eb kushtet kur pezullimi \u00ebsht\u00eb nj\u00eb mas\u00eb e jasht\u00ebzakonshme, vendosja e tij lidhet me vler\u00ebsimin e pasojave ose efekteve t\u00eb zbatimit t\u00eb aktit. K\u00ebto pasoja jo vet\u00ebm duhet t\u00eb jen\u00eb reale, pra n\u00eb realizim e sip\u00ebr, por edhe t\u00eb r\u00ebnda, n\u00eb at\u00eb mas\u00eb q\u00eb shkojn\u00eb tej mas\u00ebs normale t\u00eb kufizimit, n\u00eb ve\u00e7anti n\u00eb pik\u00ebpamje t\u00eb urgjenc\u00ebs (shih vendimin nr. 1, dat\u00eb 25.01.2024 t\u00eb Gjykat\u00ebs Kushtetuese).<\/p>\n<p>4. P\u00ebr sa m\u00eb lart, p\u00ebrkund\u00ebr vler\u00ebsimit t\u00eb shumic\u00ebs p\u00ebr pezullimin e vendimeve gjyq\u00ebsore, ne, gjyqtar\u00ebt n\u00eb pakic\u00eb, \u00e7mojm\u00eb se nuk plot\u00ebsohen kushtet e nenit 45 t\u00eb ligjit organik t\u00eb Gjykat\u00ebs, pasi nuk verifikohet prania e pasojave t\u00eb pariparueshme n\u00eb mas\u00eb t\u00eb r\u00ebnd\u00eb, pra n\u00eb at\u00eb mas\u00eb q\u00eb t\u00eb shkoj\u00eb p\u00ebrtej mas\u00ebs normale t\u00eb kufizimit, n\u00eb ve\u00e7anti n\u00eb pik\u00ebpamje t\u00eb urgjenc\u00ebs. N\u00eb k\u00ebt\u00eb kuptim, argumenti i k\u00ebrkuesit se K\u00ebshilli i Ministrave del jasht\u00eb funksionit p\u00ebr shkak t\u00eb pezullimit nga detyra t\u00eb nj\u00eb prej an\u00ebtar\u00ebve t\u00eb tij nuk \u00ebsht\u00eb bind\u00ebs p\u00ebr sa koh\u00eb b\u00ebhet fjal\u00eb p\u00ebr organ kolegjial, i cili i merr vendimet n\u00eb m\u00ebnyr\u00eb kolegjiale, me shumic\u00ebn e votave. Po k\u00ebshtu, jemi t\u00eb mendimit se k\u00ebrkuesi nuk tregon q\u00eb nuk ka mjete t\u00eb tjera n\u00eb dispozicion m\u00eb pak t\u00eb d\u00ebmshme p\u00ebr t\u00eb adresuar situat\u00ebn e krijuar.<\/p>\n<p>5. N\u00eb k\u00ebt\u00eb pik\u00eb, v\u00ebm\u00eb n\u00eb dukje se n\u00eb asnj\u00eb rast m\u00eb par\u00eb, Gjykata nuk ka vendosur pezullimin e ekzekutimit t\u00eb vendimeve gjyq\u00ebsore jo vet\u00ebm kur jan\u00eb ende n\u00eb ankim e sip\u00ebr nga pal\u00ebt sipas mjeteve t\u00eb zakonshme t\u00eb ankimit n\u00eb dispozicion t\u00eb tyre, por edhe kur ato jan\u00eb b\u00ebr\u00eb p\u00ebrfundimtare p\u00ebr efekt t\u00eb kontrollit kushtetues, pra kur kan\u00eb ezauruar rrug\u00ebn e rregullt t\u00eb ankimit gjyq\u00ebsor n\u00eb gjykatat m\u00eb t\u00eb larta. Megjithat\u00eb, rasti konkret \u00ebsht\u00eb edhe m\u00eb delikat, pasi b\u00ebhet fjal\u00eb p\u00ebr vendime gjyq\u00ebsore t\u00eb cilat jan\u00eb ende n\u00eb proces kontrolli nga sistemi i gjykatave t\u00eb zakonshme, aktualisht n\u00eb gjykat\u00ebn e posa\u00e7me t\u00eb shkall\u00ebs s\u00eb dyt\u00eb. N\u00eb k\u00ebt\u00eb pik\u00ebpamje, vendimet gjyq\u00ebsore duhet t\u00eb ndjekin rrug\u00ebn ligjore procedurale t\u00eb ankimit n\u00eb gjykatat e zakonshme dhe nd\u00ebrhyrja nga Gjykata me vendim p\u00ebr pezullimin e efekteve t\u00eb tyre n\u00eb vetvete d\u00ebmton miradministrimin e drejt\u00ebsis\u00eb. Me fjal\u00eb t\u00eb tjera, vendimi i shumic\u00ebs prima facie nd\u00ebrhyn n\u00eb veprimtarin\u00eb e gjykatave, duke krijuar nj\u00eb situat\u00eb q\u00eb nuk pajtohet me nenin 145, pika 3, t\u00eb Kushtetut\u00ebs q\u00eb mbron n\u00eb nivel kushtetues integritetin e veprimtaris\u00eb s\u00eb gjykatave nga \u00e7do nd\u00ebrhyrje gjat\u00eb koh\u00ebs q\u00eb \u00e7\u00ebshtja \u00ebsht\u00eb n\u00eb juridiksion gjyq\u00ebsor, me pasoj\u00eb sanksionimin sipas ligjit. Gjykata ka theksuar se n\u00ebn frym\u00ebn e dispozitave t\u00eb Kushtetut\u00ebs p\u00ebr pavar\u00ebsin\u00eb e gjyq\u00ebsorit dhe ndarjen e pushteteve, elementet e pavar\u00ebsis\u00eb, t\u00eb cilat n\u00eb thelb prekin vet\u00eb funksionin e dh\u00ebnies s\u00eb drejt\u00ebsis\u00eb nuk duhet t\u00eb cenohen (shih vendimin nr. 81, dat\u00eb 21.11.2024 t\u00eb Gjykat\u00ebs Kushtetuese). Pavar\u00ebsia n\u00ebnkupton jo vet\u00ebm nj\u00eb q\u00ebndrim t\u00eb caktuar ndaj ushtrimit t\u00eb funksionit gjyq\u00ebsor, por nj\u00eb pozit\u00eb ose marr\u00ebdh\u00ebnie n\u00eb raport me t\u00eb tjer\u00ebt q\u00eb bazohet n\u00eb ekzistenc\u00ebn e kushteve dhe garancive objektive (shih vendimin nr. 14, dat\u00eb 22.05.2006 t\u00eb Gjykat\u00ebs Kushtetuese).<\/p>\n<p>6. N\u00ebn k\u00ebt\u00eb optik\u00eb, ne, gjyqtar\u00ebt n\u00eb pakic\u00eb, \u00e7mojm\u00eb se n\u00eb kontekstin e fakteve t\u00eb paraqitura nga k\u00ebrkuesi, pezullimi i vendimeve gjyq\u00ebsore t\u00eb shkall\u00ebs s\u00eb par\u00eb, q\u00eb presin t\u00eb shqyrtohen n\u00eb apel shkakton pasoja t\u00eb tilla, q\u00eb jo vet\u00ebm nuk zgjidhin ndonj\u00eb mosmarr\u00ebveshje kushtetuese, por d\u00ebmtojn\u00eb ekuilibrin e drejt\u00eb kushtetues q\u00eb duhet t\u00eb ekzistoj\u00eb midis interesave q\u00eb jan\u00eb t\u00eb pranish\u00ebm n\u00eb \u00e7\u00ebshtjen konkrete (nga nj\u00ebra an\u00eb miradministrimi dhe pavar\u00ebsia e pushtetit gjyq\u00ebsor, nd\u00ebrsa nga ana tjet\u00ebr ushtrimi i rregullt i kompetencave nga organet kushtetuese, Kryeministri, K\u00ebshilli i Ministrave, Prokuroria e Posa\u00e7me dhe Gjykata e Posa\u00e7me).<\/p>\n<p>P\u00ebr rrjedhoj\u00eb, jemi t\u00eb mendimit se Mbledhja e Gjyqtar\u00ebve duhet t\u00eb kishte vendosur rr\u00ebzimin e k\u00ebrkes\u00ebs p\u00ebr pezullimin e ekzekutimit t\u00eb vendimeve gjyq\u00ebsore, objekt kund\u00ebrshtimi.<\/p>\n<p>7. P\u00ebrve\u00e7 sa m\u00eb sip\u00ebr, ne, gjyqtar\u00ebt Marsida Xhaferllari dhe Asim Vokshi, \u00e7mojm\u00eb se vendimet gjyq\u00ebsore nuk duhet t\u00eb ishin pezulluar edhe p\u00ebr faktin se jemi kund\u00ebr kalimit t\u00eb \u00e7\u00ebshtjes p\u00ebr shqyrtim n\u00eb seanc\u00eb plenare, me argumentin se nuk plot\u00ebsohen kriteret paraprake t\u00eb pranueshm\u00ebris\u00eb.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>VENDOSI: 1.
