E sheh si nj\u00eb nga format m\u00eb konkrete t\u00eb liris\u00eb njer\u00ebzore. Prona private nuk \u00ebsht\u00eb thjesht pasuri; \u00ebsht\u00eb p\u00ebrgjegj\u00ebsi, kufi ndaj arbitraritetit, dhe arsyeja pse nj\u00eb njeri e lidh jet\u00ebn e vet me nj\u00eb vend. Sa m\u00eb e qart\u00eb dhe e mbrojtur \u00ebsht\u00eb prona, aq m\u00eb e fort\u00eb b\u00ebhet edhe e mira e p\u00ebrbashk\u00ebt, sepse shoq\u00ebria nuk mbahet vet\u00ebm me moral, mbahet me rregulla t\u00eb parashikueshme dhe me t\u00eb drejta q\u00eb nuk negociohen \u00e7do kat\u00ebr vjet.<\/p>\n<p>N\u00eb Shqip\u00ebri, kjo e drejt\u00eb \u00ebsht\u00eb trajtuar si \u00e7\u00ebshtje dyt\u00ebsore p\u00ebr dekada, dhe padrejt\u00ebsia e komunizmit mbi pron\u00ebn \u00ebsht\u00eb kthyer n\u00eb faj t\u00eb akumuluar n\u00eb disa breza. Kur prona \u00ebsht\u00eb e paqart\u00eb, \u00e7do marr\u00ebdh\u00ebnie b\u00ebhet e paqart\u00eb: investimi, kredia, trash\u00ebgimia, zhvillimi urban, bujq\u00ebsia. Dhe kur gjith\u00e7ka \u00ebsht\u00eb e paqart\u00eb, fiton ai q\u00eb ka akses, jo ai q\u00eb ka t\u00eb drejt\u00eb.<\/p>\n<p>Kjo qeveri e ka p\u00ebrdorur pik\u00ebrisht k\u00ebt\u00eb mjegull si metod\u00eb qeverisjeje. Ne nuk kemi \u201cmunges\u00eb pronash\u201d; kemi nj\u00eb mekaniz\u00ebm t\u00eb gjat\u00eb ku prona zhvendoset gradualisht drejt oligarkis\u00eb dhe klient\u00ebve qeveritar\u00eb, jo p\u00ebrmes tregut, por p\u00ebrmes shtetit: me VKM, me status \u201cstrategjik\u201d, me legalizime selektive, me kontrata q\u00eb tjet\u00ebrsojn\u00eb toka publike e pastaj i kthejn\u00eb n\u00eb \u201czhvillim\u201d privat. Kjo \u00ebsht\u00eb arsyeja pse \u00e7\u00ebshtja e pron\u00ebs nuk \u00ebsht\u00eb vet\u00ebm plag\u00eb historike, por edhe nj\u00eb nga burimet kryesore t\u00eb modelit oligarkik q\u00eb e ka kapur ekonomin\u00eb shqiptare.<\/p>\n<p>N\u00ebse duam ta mbyllim k\u00ebt\u00eb kapitull, duhet t\u00eb nisim nga ajo q\u00eb nuk \u00ebsht\u00eb b\u00ebr\u00eb n\u00eb k\u00ebto dekada: t\u00eb ndalojm\u00eb prodhimin e padrejt\u00ebsive t\u00eb reja nd\u00ebrkoh\u00eb q\u00eb nuk jan\u00eb korrigjuar t\u00eb vjetrat. Duhet t\u00eb kuptojme r\u00ebnd\u00ebsin\u00eb e shenjt\u00ebrin\u00eb e pron\u00ebs, t\u00eb besojm\u00eb v\u00ebrtet n\u00eb t\u00eb dhe t\u00eb shkojm\u00eb drejt nj\u00eb pakti shoq\u00ebror q\u00eb do t\u00eb zgjidh\u00eb problemin e do te evitoj\u00eb shkeljes e pron\u00ebs n\u00eb t\u00eb ardhmen. Ndoshta idet\u00eb specifike n\u00eb k\u00ebt\u00eb pjes\u00eb te Manifestit nuk do ndahen nga t\u00eb gjith\u00eb, mbase nuk jan\u00eb zgjidhja e plot\u00eb. Por shpresoj t\u00eb hap\u00eb nj\u00eb debat t\u00eb sh\u00ebndetsh\u00ebm p\u00ebr zgjidhjet e djathta.<\/p>\n<ol>\n<li>Prandaj, hapi i par\u00eb \u00ebsht\u00eb nj\u00eb moratorium i qart\u00eb mbi pronat dhe p\u00ebr \u00e7do akt q\u00eb vazhdon t\u00eb krijoj\u00eb pronar\u00eb t\u00eb rinj mbi prona t\u00eb pasqaruara.<\/li>\n<li>Pastaj vjen inventarizimi, si nj\u00eb proces shtet\u00ebror i madh, me p\u00ebrgjegj\u00ebsi politike, ku toka e Shqip\u00ebris\u00eb shihet si hart\u00eb juridike dhe historike: \u00e7far\u00eb ishte n\u00eb 1945, \u00e7far\u00eb \u00ebsht\u00eb sot, kush e ka, si e ka, ku jan\u00eb mbivendosjet, ku jan\u00eb falsifikimet, ku jan\u00eb \u201cboshll\u00ebqet\u201d q\u00eb sot shfryt\u00ebzohen si mund\u00ebsi p\u00ebr grabitje. Pa k\u00ebt\u00eb rrjedh\u00eb t\u00eb plot\u00eb t\u00eb \u00e7do parcele, shteti mbetet i verb\u00ebr, nd\u00ebrsa t\u00eb fort\u00ebt shohin qart\u00eb. Kjo k\u00ebrkon vullnet politik. Nga k\u00ebtu nis zgjidhja e v\u00ebrtet\u00eb.<\/li>\n<li>Parimi i par\u00eb duhet t\u00eb jet\u00eb kthimi fizik i pron\u00ebs sa her\u00eb \u00ebsht\u00eb e mundur, ose kompensimi n\u00eb natyr\u00eb. Kthimi fizik mbyll konfliktin, ul fatur\u00ebn financiare dhe kthen rendin n\u00eb nj\u00eb m\u00ebnyr\u00eb q\u00eb kompensimi financiar shpesh nuk e b\u00ebn dot. P\u00ebr k\u00ebt\u00eb, fondi i pronave shtet\u00ebrore duhet t\u00eb vihet realisht n\u00eb dispozicion t\u00eb procesit, me identifikim t\u00eb pronave t\u00eb disponueshme, vler\u00ebsim t\u00eb drejt\u00eb dhe oferta q\u00eb jan\u00eb t\u00eb pranueshme p\u00ebr pronar\u00ebt legjitim sipas natyr\u00ebs s\u00eb pron\u00ebs.<\/li>\n<li>Kur kthimi fizik nuk \u00ebsht\u00eb i mundur, kompensimi duhet t\u00eb jet\u00eb i drejt\u00eb dhe i bazuar n\u00eb vler\u00ebn e tregut, jo n\u00eb harta vlerash q\u00eb prodhohen p\u00ebr t\u00eb ulur detyrimin e shtetit. Dhe p\u00ebr t\u00eb mos e kthyer k\u00ebt\u00eb n\u00eb barr\u00eb t\u00eb pamundur p\u00ebr buxhetin, duhet t\u00eb p\u00ebrdoren edhe skema alternative kompensimi: instrumente financiare, obligacione, pjes\u00ebmarrje n\u00eb fonde investimi, apo forma t\u00eb tjera q\u00eb e b\u00ebjn\u00eb kompensimin t\u00eb realizuesh\u00ebm pa e shnd\u00ebrruar n\u00eb premtim t\u00eb p\u00ebrjetsh\u00ebm.<\/li>\n<li>Por ka edhe nj\u00eb dimension q\u00eb zakonisht shmanget: prona nuk zgjidhet vet\u00ebm me kthim e kompensim, zgjidhet edhe duke i dh\u00ebn\u00eb nj\u00eb mekaniz\u00ebm shoq\u00ebris\u00eb p\u00ebr t\u00eb p\u00ebrballuar fatur\u00ebn e padrejt\u00ebsis\u00eb historike pa e transferuar at\u00eb gjithmon\u00eb te taksapaguesi i zakonsh\u00ebm. K\u00ebtu hyn koncepti i reparacionit dhe i fondit t\u00eb garancis\u00eb: aty ku zhvillimi urban rrit vler\u00ebn e tok\u00ebs, shteti duhet t\u00eb krijoj\u00eb mekanizma q\u00eb nj\u00eb pjes\u00eb e k\u00ebtij p\u00ebrfitimi t\u00eb shkoj\u00eb p\u00ebr mbylljen e detyrimeve ndaj pronar\u00ebve legjitim. Kjo mund t\u00eb b\u00ebhet edhe me instrumente t\u00eb lidhura me lejet e nd\u00ebrtimit, me p\u00ebrfshirje t\u00eb pronar\u00ebve n\u00eb p\u00ebrfitim, ose me sip\u00ebrfaqe nd\u00ebrtimore t\u00eb administruara si garanci deri n\u00eb shlyerjen e detyrimit. E r\u00ebnd\u00ebsishme \u00ebsht\u00eb parimi: detyrimi nuk zhduket, por as nuk lihet t\u00eb tretet n\u00eb retorik\u00eb; lidhet me fatin ekonomik t\u00eb tok\u00ebs dhe me p\u00ebrfitimet q\u00eb krijon zhvillimi.<\/li>\n<li>P\u00ebr k\u00ebt\u00eb arsye, kuadri ligjor aktual duhet rishikuar n\u00eb themel. Ka ligje dhe akte q\u00eb sot prodhojn\u00eb pasiguri dhe mbivendosje: legalizime t\u00eb reja, VKM q\u00eb krijojn\u00eb pronar\u00eb t\u00eb rinj, ligje \u201cstrategjike\u201d q\u00eb e shnd\u00ebrrojn\u00eb interesin privat n\u00eb pretekst publik, dhe nj\u00eb ligj trajtimi pronash q\u00eb ka provuar se nuk e mbyll dot procesin. Nevojitet kodifikim i qart\u00eb, standarde t\u00eb qarta dhe afate reale, sepse prona nuk mund t\u00eb mbetet projekt i p\u00ebrhersh\u00ebm administrativ.<\/li>\n<li>Duhen par\u00eb tokat q\u00eb kan\u00eb subjekt i ligjit 7501. N\u00ebse nuk jan\u00eb p\u00ebrdorur p\u00ebr q\u00ebllimin e caktuar p\u00ebr t\u00eb cilin jan\u00eb marr\u00eb, at\u00ebher\u00eb ka r\u00ebn\u00eb pron\u00ebsia. N\u00ebse tokat jan\u00eb braktisur nga pronar\u00ebt e rinj, at\u00ebher\u00eb do duhet t\u2019u kthehen pronar\u00ebve legjitim\u00eb. Mund t\u00eb ket\u00eb dhe zgjidhje t\u00eb tjera t\u00eb propozuara si ndarja e pron\u00ebsis\u00eb s\u00eb tok\u00ebs dhe asaj t\u00eb nd\u00ebrtes\u00ebs p\u00ebr ato q\u00eb jan\u00eb t\u00eb z\u00ebna. E r\u00ebnd\u00ebsishme \u00ebsht\u00eb q\u00eb si shoq\u00ebri t\u00eb biem dakord p\u00ebr parimet q\u00eb do \u00e7ojn\u00eb n\u00eb propozimet konkrete.<\/li>\n<li>Edhe institucionet duhet t\u00eb kthehen n\u00eb normalitet. Kadastra nuk \u00ebsht\u00eb vend ku qytetari shkon p\u00ebr t\u00eb \u201czgjidhur pun\u00eb\u201d, por regjist\u00ebr publik ku e drejta pasqyrohet e plot\u00eb dhe e verifikueshme. Duhet regjist\u00ebr elektronik publik, hart\u00eb digjitale e titujve dhe nj\u00eb sh\u00ebrbim q\u00eb e mbyll procesin pa parapagime absurde dhe pa riaplikime q\u00eb lodhin qytetarin deri n\u00eb dor\u00ebzim.<\/li>\n<\/ol>\n<p>Dhe s\u00eb fundmi: ligji 7501 nuk zhb\u00ebhet, por ai nuk mund t\u00eb sh\u00ebrbej\u00eb si alibi p\u00ebr mashtrime. Inventarizimi dhe historiku i parcel\u00ebs duhet t\u00eb nxjerr\u00eb edhe abuzimet e q\u00ebllimshme, falsifikimet, AMTP-t\u00eb e p\u00ebrfituara padrejt\u00ebsisht ose t\u00eb pap\u00ebrdorura sipas q\u00ebllimit t\u00eb ligjit. N\u00eb k\u00ebto raste, titulli nuk mund t\u00eb mbrohet vet\u00ebm sepse ka kaluar koh\u00eb. Siguria juridike nuk nd\u00ebrtohet mbi padrejt\u00ebsin\u00eb e konsoliduar; nd\u00ebrtohet mbi kthimin e rregullit.<\/p>\n<p>Ky \u00ebsht\u00eb nj\u00eb proces i dhimbsh\u00ebm, ku do t\u00eb ket\u00eb pak\u00ebnaq\u00ebsi dhe kund\u00ebrshti. Por, ne si shoq\u00ebri duhet t\u00eb jemi t\u00eb vet\u00ebdijsh\u00ebm q\u00eb ka ardhur koha p\u00ebr ta zgjidhur k\u00ebt\u00eb padrejt\u00ebsi 80-vje\u00e7are me nj\u00eb pakt t\u00eb madh shoq\u00ebror q\u00eb \u00e7on n\u00eb nj\u00eb paqe t\u00eb madhe shoq\u00ebrore.<\/p>\n<p>Prona \u00ebsht\u00eb nyja ku takohen liria, ekonomia dhe q\u00ebndrimi. Nj\u00eb shoq\u00ebri q\u00eb nuk e zgjidh pron\u00ebn, normalizon arbitraritetin; dhe nj\u00eb shoq\u00ebri q\u00eb normalizon arbitraritetin, e ka t\u00eb v\u00ebshtir\u00eb t\u2019i k\u00ebrkoj\u00eb f\u00ebmij\u00ebve t\u00eb vet t\u00eb q\u00ebndrojn\u00eb.<\/p>\n<p>Prandaj, p\u00ebr ne, \u00e7\u00ebshtja e pron\u00ebs nuk \u00ebsht\u00eb \u201cnj\u00eb angari e vjet\u00ebr\u201d. \u00cbsht\u00eb prova m\u00eb e qart\u00eb n\u00ebse Shqip\u00ebria do t\u00eb jet\u00eb shtet me ligj, apo territor ku ligji p\u00ebrdoret p\u00ebr t\u00eb justifikuar t\u00eb fortin.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nga Nikola KEDHI &#8211; Cikli II (vazhdim) IIA &#8211; E djathta nuk e sheh pron\u00ebn si mall q\u00eb shp\u00ebrndahet nga pushteti.
