Ajo k\u00ebrkon q\u00eb t\u00eb v\u00ebndosen p\u00ebrpara p\u00ebrgjegj\u00ebsis\u00eb personat q\u00eb kan\u00eb t\u00eb ardhura t\u00eb konsiderueshme, por shmangin pages\u00ebn e taksave dhe nuk justifikojn\u00eb pasurin\u00eb.<\/p>\n<p>N\u00eb 5 prioritet ky\u00e7e q\u00eb Fondi i ka l\u00ebn\u00eb qeveris\u00eb n\u00eb mbyllje t\u00eb vizit\u00ebs n\u00eb Shqip\u00ebri, \u00ebsht\u00eb reduktimi i informalitetit n\u00eb sektorin e nd\u00ebrtimit, reduktimin e cash-it, taksimi i pasuris\u00eb, lufta ndaj informalitetit n\u00eb tregun e pun\u00ebs dhe forcimi i kapaciteteve t\u00eb administrat\u00ebs fiskale.<\/p>\n<p>M\u00eb 4 korrik 2022, n\u00eb deklarat\u00ebn n\u00eb takimin e 13-t\u00eb t\u00eb N\u00ebnkomitetit p\u00ebr Tregtin\u00eb, Industrin\u00eb, Doganat dhe Tatimet midis BE-s\u00eb dhe Shqip\u00ebris\u00eb, Komisioni Evropian shprehu \u201c&#8230;shqet\u00ebsime serioze p\u00ebr draftin aktual t\u00eb ligjit p\u00ebr amnistin\u00eb fiskale. Kjo amnisti do t\u00eb dob\u00ebsoj\u00eb kontrollet e Shqip\u00ebris\u00eb kund\u00ebr pastrimit t\u00eb parave, nd\u00ebrkoh\u00eb q\u00eb do t\u00eb b\u00ebnte pak p\u00ebr t\u00eb rritur aft\u00ebsin\u00eb e administrat\u00ebs tatimore p\u00ebr t\u00eb p\u00ebrmir\u00ebsuar perputhshmerine e ardhshme tatimore me ligjet. P\u00ebr m\u00eb tep\u00ebr, p\u00ebr shkak se rezident\u00ebt jotatimor\u00eb, p\u00ebrfshir\u00eb shqiptar\u00ebt q\u00eb jetojn\u00eb n\u00eb BE ose n\u00eb Ballkanin Per\u00ebndimor, p\u00ebrfshihen n\u00eb objektin e amnistis\u00eb dhe u k\u00ebrkohet t\u00eb importojn\u00eb para p\u00ebr t\u00eb p\u00ebrfituar nga amnistia, drafti aktual i ligjit ngre shqet\u00ebsime serioze p\u00ebr an\u00ebtar\u00ebt e BE-s\u00eb. shtetet dhe partner\u00ebt e tjer\u00eb dhe nj\u00eb rrezik thelb\u00ebsor reputacioni p\u00ebr vendin.\u201d(https:\/\/www.eeas.europa.eu\/delegations\/albania\/13th-subcommittee-meeting-trade-industry-customs-and-taxation-between-eu-and_en?s=214).<\/p>\n<p><strong>Pse FMN dhe BE jan\u00eb kund\u00ebr<\/strong><br \/>\nAf\u00ebrsisht dy vite m\u00eb par\u00eb, n\u00eb qershor 2020, Delegacioni i Bashkimit Evropian n\u00eb Tiran\u00eb, n\u00eb nj\u00eb dokument pune t\u00eb tijin, parashtronte n\u00ebnd\u00eb \u00e7\u00ebshtje t\u00eb r\u00ebnd\u00ebsishme t\u00eb konstatuara prej tij, gjat\u00eb vler\u00ebsimit t\u00eb projektligjit p\u00ebr \u201cAmnistin\u00eb Fiskale dhe Penale p\u00ebr subjektet e deklarimit vullnetar t\u00eb pasuris\u00eb\u201d, t\u00eb cilin sekti n\u00eb qeverisje kishte synim ta miratonte q\u00eb n\u00eb qershor 2020.<\/p>\n<p>N\u00eb k\u00ebt\u00eb dokument, BE konstatonte:<\/p>\n<p>1. Riatdhesimi i aseteve duhet t\u00eb b\u00ebhet n\u00ebp\u00ebrmjet transfertave bankare nd\u00ebrkomb\u00ebtare n\u00eb vend, q\u00eb t\u00eb n\u00ebnkuptohet se parat\u00eb mund t\u00eb l\u00ebvizin fizikisht. N\u00ebse t\u00eb ardhurat jan\u00eb jasht\u00eb vendit, transferimi i tyre mbi nj\u00eb kufi t\u00eb caktuar duhet t\u00eb deklarohet n\u00eb zyr\u00ebn doganore n\u00eb kufi. Ekziston rreziku q\u00eb projektligji t\u00eb krijoj\u00eb nj\u00eb \u201cdritare mund\u00ebsie\u201d p\u00ebr evazionin fiskal dhe pastrimin e parave t\u00eb huaja.<\/p>\n<p>2. Projektligji rrezikon t\u00eb siguroj\u00eb mosnd\u00ebshkim t\u00eb panevojsh\u00ebm p\u00ebr subjektet q\u00eb posedojn\u00eb pasuri t\u00eb paligjshme.<\/p>\n<p>3. Asnj\u00eb konsultim adekuat me pal\u00ebt e interesit nuk u zhvillua p\u00ebrpara se sa drafti t\u00eb dor\u00ebzohej n\u00eb Kuvend. Urgjenca e qeveris\u00eb nuk duket t\u00eb jet\u00eb e justifikuar. Draftit i mungon nj\u00eb vler\u00ebsim i nevojsh\u00ebm i aseteve t\u00eb pritshme q\u00eb do t\u00eb formalizohen dhe t\u00eb ardhurat e pritshme q\u00eb do t\u00eb gjenerohen.<\/p>\n<p>4. Objekti i amnistis\u00eb shkon p\u00ebrtej asaj t\u00eb legjislacionit t\u00eb ngjash\u00ebm t\u00eb zbatuar n\u00eb vende t\u00eb tjera. Qeveria duhet t\u00eb synoj\u00eb vet\u00ebm evazionin fiskal t\u00eb kryer nga personat q\u00eb mund t\u00eb jen\u00eb n\u00eb Shqip\u00ebri, dhe jo evazionin e emigranteve ne shtetet anetare te BE-se dhe ne shtetet e tjera.<\/p>\n<p>5. Nj\u00eb amnisti e till\u00eb tatimore do t\u00eb ishte shum\u00eb e v\u00ebshtir\u00eb p\u00ebr t&#8217;u zbatuar, pasi p\u00ebrkufizimi i aktiveve p\u00ebrfshin element\u00eb t\u00eb till\u00eb si pasuri t\u00eb paluajtshme n\u00eb Shqip\u00ebri dhe jasht\u00eb Shqip\u00ebris\u00eb, para t\u00eb gatshme n\u00eb monedh\u00eb komb\u00ebtare ose t\u00eb huaj, monedh\u00eb dixhitale, sende me vler\u00eb prej ari ose gur\u00ebsh t\u00eb \u00e7muar. \u00cbsht\u00eb e v\u00ebshtir\u00eb t\u00eb garantohet se a) ato nuk vijn\u00eb nga veprimtari kriminale; b) deklarohen nga pronari i tyre aktual (p\u00ebrfitues) dhe c) rezulton nga t\u00eb ardhurat q\u00eb nuk i p\u00ebrkasin nj\u00eb periudhe tatimore q\u00eb ose \u00ebsht\u00eb ende subjekt i deklarimit tatimor ose subjekt i nj\u00eb kontrolli tatimor t\u00eb njoftuar tashm\u00eb.<\/p>\n<p>6. Shqip\u00ebria s\u00eb pari duhet t\u00eb nd\u00ebrtoj\u00eb nj\u00eb administrat\u00eb fiskale profesionale, e cila do t\u00eb bllokonte mund\u00ebsit\u00eb p\u00ebr pastrim parash dhe korrupsion.<\/p>\n<p>7. P\u00ebr t\u00eb qen\u00eb e besueshme dhe p\u00ebr t\u00eb shmangur konkurrenc\u00ebn e pandershme nga ata q\u00eb deri m\u00eb tani kan\u00eb mbajtur pasurin\u00eb e tyre jasht\u00eb sistemit, amnistia fiskale duhet t\u00eb kombinohet me rritjen e kontrollit dhe sanksioneve ndaj tatimpaguesve q\u00eb nuk respektojn\u00eb detyrimet.<\/p>\n<p>8. P\u00ebr Bankat dhe Moneyval \u00ebsht\u00eb e paqart\u00eb se si do t\u00eb zbatohet Ligji Kund\u00ebr Pastrimit t\u00eb Parave n\u00eb kuad\u00ebr t\u00eb k\u00ebsaj amnistie.<\/p>\n<p>9. \u00cbsht\u00eb i paqart\u00eb funksionimi i Nj\u00ebsis\u00eb Speciale q\u00eb do t\u00eb zbatoj\u00eb ligjin.<\/p>\n<p>Ende deri sot, qeveria nuk ka trajtuar n\u00eb detaje dhe nuk ka dh\u00ebn\u00eb asnj\u00eb p\u00ebrgjigje p\u00ebr \u00e7\u00ebshtjet e ngritura nga Bashkimi Evropian, lidhur me amnistin\u00eb fiskale.<\/p>\n<p><strong>II. Amnistia fiskale legalizon parat\u00eb e korrupsionit dhe parat\u00eb e pasurit\u00eb kriminale<\/strong><\/p>\n<p>Megjith\u00eb k\u00ebshill\u00ebn e vyer t\u00eb FMN-s\u00eb n\u00eb maj t\u00eb k\u00ebtij viti dhe v\u00ebrejtjet konstruktive t\u00eb Delegacionit Evropian dhe t\u00eb Bank\u00ebs Bot\u00ebrore dy vite m\u00eb par\u00eb, sekti Rama vendosi t\u2019i shkoj\u00eb deri n\u00eb fund d\u00ebshir\u00ebs s\u00eb pap\u00ebrmbajtur t\u00eb tij p\u00ebr t\u00eb legalizuar parat\u00eb e korrupsionit t\u00eb politikan\u00ebve dhe ministrave e ish-ministrave t\u00eb qeveris\u00eb, si dhe parat\u00eb dhe pasurite e v\u00ebna n\u00eb rrug\u00eb kriminale.    <\/p>\n<p>Projektligji i kaluar p\u00ebr diskutim publik ka n\u00eb themel legalizimin e deklarimeve vullnetare t\u00eb individ\u00ebve, pa pyetur p\u00ebr origjin\u00ebn,  n\u00eb vler\u00ebn deri n\u00eb 2 milion\u00eb euro, kundrejt nj\u00eb tatimi 7-10%.<\/p>\n<p>Lind pyetja, p\u00ebrse qeveria vendos nj\u00eb tavan 2 milion\u00eb euro p\u00ebr t\u2019u amnistuar? Cilat para dhe kapitale ka parasysh brenda k\u00ebtij tavani? Asnj\u00eb qytetar shqiptar q\u00eb ka punuar n\u00eb m\u00ebnyr\u00eb t\u00eb ndershme, n\u00eb emigracion ose brenda vendit, nuk mund t\u00eb gjeneroj\u00eb kaq shum\u00eb t\u00eb ardhura. Kush \u00ebsht\u00eb ai biznes i rregullt ose q\u00eb punon pjes\u00ebrisht n\u00eb ekonomin\u00eb gri, i aft\u00eb t\u00eb grumbulloj\u00eb deri n\u00eb 2 milion\u00eb euro, duke i mbajtur t\u00eb fshehura k\u00ebto para apo kapitale? K\u00ebto jan\u00eb para t\u00eb ekonomis\u00eb kriminale, q\u00eb tentojn\u00eb t\u00eb futen n\u00eb kanalet bankare, n\u00ebp\u00ebrmjet ligjit m\u00eb t\u00eb diskutuesh\u00ebm mbi faljen masive fiskale n\u00eb historin\u00eb e vendit ton\u00eb.<\/p>\n<p>P\u00ebr biznesin e konsoliduar dhe serioz shqiptar, projektligji i tanish\u00ebm i Amnistis\u00eb Fiskale \u00ebsht\u00eb amoral, p\u00ebr shkak se targeton linja dhe individ\u00eb q\u00eb ushtrojn\u00eb aktivitete amorale. Amnistia do t\u00eb ishte e pranueshme, n\u00ebse do t\u00eb fillonte nga gjobat dhe kamat\u00ebvonesat e biznesit, t\u00eb krijuara nga pamund\u00ebsia p\u00ebr t\u00eb deklaruar n\u00eb koh\u00eb gjat\u00eb viteve t\u00eb kriz\u00ebs, t\u00ebrmetit dhe pandemis\u00eb. P\u00ebr shkak se kjo amnisti nuk e \u00e7liron regjistrin pasiv t\u00eb bizneseve, ajo nuk \u00ebsht\u00eb e pranueshme p\u00ebr aktivitetet e moralshme.<\/p>\n<p><strong>III. Modeli i propozuar i amnistis\u00eb nuk e ndihmon ekonomin\u00eb, por e shkat\u00ebrron at\u00eb<\/strong><\/p>\n<p>Ky model amnistie, i pangjash\u00ebm me asnj\u00eb model t\u00eb m\u00ebparsh\u00ebm t\u00eb aplikuar n\u00eb vendet e rajonit apo n\u00eb shtetet an\u00ebtare t\u00eb Bashkimit Evropian, nuk p\u00ebrb\u00ebn nj\u00eb rrug\u00eb t\u00eb gjenerimit t\u00eb fondeve t\u00eb ekonomis\u00eb gri dhe t\u00eb paformalizuar t\u00eb vendit, por ndihmon ekonomin\u00eb dhe pasurit\u00eb e v\u00ebna nga korrupsioni, dhe jo parat\u00eb dhe pasurit\u00eb e emigrant\u00ebve, t\u00eb cil\u00ebt i p\u00ebrdor si fasad\u00eb.<\/p>\n<p>Shoq\u00ebrit\u00eb e kriminalizuara jan\u00eb ato ku t\u00eb rinjt\u00eb duan vet\u00ebm t\u00eb largohen, sapo gjejn\u00eb nj\u00eb mund\u00ebsi. Nisma e sotme e amnistis\u00eb fiskale do t\u00eb ket\u00eb nj\u00eb p\u00ebrdorim tjet\u00ebr fundor: pastrimin e parave t\u00eb korrupsionit n\u00eb nivelet e larta t\u00eb politik\u00ebs shqiptare. Kjo nuk \u00ebsht\u00eb rruga e progresit ekonomik t\u00eb vendit, as e kap\u00ebrcimit t\u00eb gjendjes s\u00eb v\u00ebshtir\u00eb nga rritja e \u00e7mimeve dhe lufta n\u00eb Ukrain\u00eb. \u00c7do ide apo projekt, i cili k\u00ebrkon legalizimin e pasuris\u00eb dhe paras\u00eb, pa p\u00ebrjashtuar qart\u00eb dhe me forc\u00eb pasurin\u00eb dhe paran\u00eb kriminale, p\u00ebrb\u00ebn nj\u00eb hap t\u00eb r\u00ebnd\u00eb prapa n\u00eb zhvillimin normal t\u00eb shoq\u00ebris\u00eb dhe ekonomis\u00eb s\u00eb nj\u00eb vendi. \u00cbsht\u00eb nj\u00eb qasje krejt\u00ebsisht e pabazuar n\u00eb eksperiencat e shoq\u00ebrive t\u00eb zhvilluara.<\/p>\n<p>Shoq\u00ebrit\u00eb q\u00eb nuk e kan\u00eb luftuar krimin dhe korrupsionin jan\u00eb shkat\u00ebrruar prej tyre. Ato jan\u00eb shoq\u00ebri ku askush nuk ka arsye p\u00ebr t\u00eb investuar apo p\u00ebr t\u00eb prodhuar, p\u00ebr t\u2019u arsimuar apo p\u00ebr t\u00eb sjell\u00eb risit\u00eb e teknologjis\u00eb s\u00eb informacionit dhe t\u00eb inteligjenc\u00ebs artificiale.<\/p>\n<p>Edhe pse projektligji \u00ebsht\u00eb paraqitur si nj\u00eb nism\u00eb p\u00ebr t\u00eb formalizuar pasuri, ai krijon nj\u00eb autostrad\u00eb p\u00ebr legalzimin e paras\u00eb dhe pasurive kriminale dhe shuan mund\u00ebsin\u00eb p\u00ebr t\u00eb ndjekur parat\u00eb e krijuara nga aktivitete dhe burime t\u00eb ndryshme n\u00eb brend\u00ebsi t\u00eb vendit.<\/p>\n<p>Duke m\u00ebnjanuar nevoj\u00ebn p\u00ebr t\u00eb deklaruar burimin e pasuris\u00eb, me k\u00ebt\u00eb projektligj, i cili shum\u00eb shpejt(n\u00eb m\u00eb pak se nj\u00eb muaj) do t\u00eb kthehet n\u00eb ligj, politikan\u00eb dhe funksionar\u00eb t\u00eb lart\u00eb t\u00eb administrat\u00ebs publike sot kan\u00eb nj\u00eb rrug\u00eb tejet t\u00eb thjesht\u00eb dhe ligjore p\u00ebr t\u00eb formalizuar pasurit\u00eb e tyre, n\u00ebp\u00ebrmjet kontakteve p\u00ebrtej familjes s\u00eb ngusht\u00eb. Asnj\u00eb nen i projektligjit nuk garanton se k\u00ebto leht\u00ebsi nuk mund t\u00eb p\u00ebrdoren nga personat n\u00eb fjal\u00eb. E kund\u00ebrta \u00ebsht\u00eb m\u00eb e mundshme: ligji \u00ebsht\u00eb menduar dhe q\u00ebndisur pik\u00ebrisht p\u00ebr k\u00ebt\u00eb arsye.<\/p>\n<p><strong>IV. Kjo amnisti fiskale do t\u00eb sjell\u00eb nj\u00eb stuhi t\u00eb ekonomis\u00eb informale<\/strong><\/p>\n<p>Nj\u00eb ligj i till\u00eb, n\u00ebse do miratohej, do t\u00eb krijonte efekte shkat\u00ebrrimtare. Ligji do t\u00eb zhdukte p\u00ebrfundimisht \u00e7do lloj iluzioni se shoq\u00ebria shqiptare mund t\u00eb kthehet n\u00eb nj\u00eb ekonomi moderne, e bazuar n\u00eb konkurrenc\u00ebn e barabart\u00eb, ku vler\u00ebsohet puna dhe sip\u00ebrmarrja, e ku f\u00ebmij\u00ebt rriten q\u00eb n\u00eb mosh\u00eb t\u00eb hershme, me modele suksesi t\u00eb sh\u00ebndosha.<\/p>\n<p>Me k\u00ebt\u00eb ligj, ekonomia shqiptare rrezikon fort t\u00eb krijoj\u00eb nj\u00eb var\u00ebsi kronike ndaj parave t\u00eb pista. Mjafton t\u00eb shikosh ekonomit\u00eb dhe shoq\u00ebrit\u00eb e vendeve nga Kolumbia n\u00eb Afganistan, ku modelet e pastrimit t\u00eb parave jan\u00eb t\u00eb shumta.<\/p>\n<p>Kjo amnisti e propozuar, n\u00eb modelin se si \u00ebsht\u00eb p\u00ebrgatitur, nuk i ndihmon realisht emigrant\u00ebt dhe parat\u00eb e tyre t\u00eb padeklaruara.
