{"id":67111,"date":"2023-12-22T09:31:01","date_gmt":"2023-12-22T09:31:01","guid":{"rendered":"https:\/\/rdnews.al\/?p=67111"},"modified":"2023-12-22T10:18:44","modified_gmt":"2023-12-22T10:18:44","slug":"vendimi-i-gjyktes-kushtetuese-nje-colpo-di-gracia-per-rendin-kushtetues","status":"publish","type":"post","link":"https:\/\/rdnews.al\/index.php\/2023\/12\/22\/vendimi-i-gjyktes-kushtetuese-nje-colpo-di-gracia-per-rendin-kushtetues\/","title":{"rendered":"Vendimi i Gjykt\u00ebs Kushtetuese nj\u00eb colpo di gracia p\u00ebr rendin kushtetues!"},"content":{"rendered":"<p><strong>Nga Sali BERISHA<\/strong><\/p>\n<p>Gjykata Kushtetuese n\u00eb vendimin e saj t\u00eb dat\u00ebs 20. 12. 2023 p\u00ebr t\u00eb justifikuar hedhjen posht\u00eb t\u00eb k\u00ebrkes\u00ebs s\u00eb 1\/5 s\u00eb deputet\u00ebve p\u00ebr shqyrtimin e marrjes me urdh\u00ebr politik nga prokuroria dhe gjykata t\u00eb kompetencave t\u00eb Kuvendit q\u00eb rrjedhin nga neni 73 pika 2 e kushtetut\u00ebs n\u00eb rastin e vendosjes s\u00eb masave t\u00eb siguris\u00eb pa miratimin e kuvendit ndaj kryetarit t\u00eb PD, deputetit Sali Berisha, shkruan se \u201cKushtetuta ka mir\u00ebp\u00ebrcaktuar rastet kur grupeve t\u00eb deputet\u00ebve u jan\u00eb njohur t\u00eb drejta si entitete dhe n\u00eb k\u00ebt\u00eb drejtim, 1\/5 e deputet\u00ebve dhe Kuvendi jan\u00eb subjekte kushtetuese t\u00eb ndryshme, q\u00eb nuk mund t\u00eb barazohen me nj\u00ebri tjetrin\u201d.<\/p>\n<p>Ky pretendim \u00ebsht\u00eb nj\u00eb trillim i turpsh\u00ebm dhe i pashembullt pasi sipas nenit 131 t\u00eb Kushtetut\u00ebs q\u00eb p\u00ebrcakton subjektet q\u00eb v\u00ebn\u00eb n\u00eb l\u00ebvizje Gjykat\u00ebn Kushtetuese, Kuvendi dhe organet e tij drejtuese nuk jan\u00eb subjekte q\u00eb v\u00ebn\u00eb n\u00eb l\u00ebvizje Gjykat\u00ebn Kushtetuese. Kjo pra \u00ebsht\u00eb nj\u00eb shpikje, nj\u00eb trillim primitiv dhe i turpsh\u00ebm. Atentat i v\u00ebrtet\u00eb ndaj Kushtetut\u00ebs.<\/p>\n<p>Me k\u00ebt\u00eb skandal t\u00eb paimagjinuesh\u00ebm q\u00eb ka b\u00ebr\u00eb dje me urdh\u00ebr politik Gjykata Kushtetuese ka p\u00ebrdhosur Kushtetut\u00ebn, jurisprudenc\u00ebn e sotme t\u00eb Gjykat\u00ebs Kushtetuese, e deri tek vet Gjykat\u00ebn dhe ligjin e saj organik. Ajo nga nj\u00eb mbrojt\u00ebse e kushtetu\u00ebs \u00ebsht\u00eb shnd\u00ebrruar n\u00eb nj\u00eb seksion mjeran i Rilindjes s\u00eb Edi Ram\u00ebs.<br \/>\nP\u00ebr t\u00eb kuptuar m\u00eb mir\u00eb k\u00ebt\u00eb superskandal t\u00eb individ\u00ebve pa ligj dhe moral profesional duhet t\u2019ju referohemi neneve t\u00eb kushtetut\u00ebs q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me k\u00ebt\u00eb \u00e7\u00ebshtje.<\/p>\n<p>S\u00eb pari \u00ebsht\u00eb e domosdoshme t\u00eb njihemi me,<br \/>\nNenin 7 t\u00eb Kushtetut\u00ebs i cili sanksionon se:<br \/>\n\u201cSistemi i qeverisjes n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb bazohet n\u00eb ndarjen dhe balancimin nd\u00ebrmjet pushteteve ligjv\u00ebn\u00ebs, ekzekutiv dhe gjyq\u00ebsor.\u201d<br \/>\nPra ky nen flet p\u00ebr pushtet ligjv\u00ebn\u00ebs, ekzekutiv, gjyq\u00ebsor.<br \/>\nSi\u00e7 shikoni neni nuk b\u00ebn fjal\u00eb p\u00ebr pushtet t\u00eb Kuvendit, t\u00eb organeve t\u00eb tij drejtuese, por vet\u00ebm pushtet ligjv\u00ebn\u00ebs.<br \/>\nTani le t\u00eb shohim se kush ka t\u00eb drejt\u00ebn kushtetuese t\u00eb v\u00eb n\u00eb l\u00ebvizje Gjykat\u00ebn Kushtetuese dometh\u00ebn\u00eb t\u2019i paraqes\u00eb ankesa p\u00ebr shqyrtim k\u00ebsaj gjykate, Kuvendi apo 1\/5 e deputet\u00ebve.<br \/>\nSipas nenit 134, (Ndryshuar me ligjin nr. 76\/2016, dat\u00eb 22.7.2016),<br \/>\n1. Gjykata Kushtetuese vihet n\u00eb l\u00ebvizje me k\u00ebrkes\u00eb t\u00eb:<br \/>\na) Presidentit t\u00eb Republik\u00ebs;<br \/>\nb) Kryeministrit;<br \/>\nc) jo m\u00eb pak se nj\u00eb t\u00eb pest\u00ebs s\u00eb deputet\u00ebve;<br \/>\n\u00e7) Avokatit t\u00eb Popullit;<br \/>\nd) Kryetarit t\u00eb Kontrollit t\u00eb Lart\u00eb t\u00eb Shtetit;<br \/>\ndh) \u00e7do gjykat\u00eb, sipas nenit 145, pika 2, t\u00eb k\u00ebsaj Kushtetute;<br \/>\ne) \u00e7do komisioneri t\u00eb krijuar me ligj p\u00ebr mbrojtjen e t\u00eb drejtave dhe lirive themelore t\u00eb garantuara nga Kushtetuta;<br \/>\n\u00eb) K\u00ebshillit t\u00eb Lart\u00eb Gjyq\u00ebsor dhe K\u00ebshillit t\u00eb Lart\u00eb t\u00eb Prokuroris\u00eb;<br \/>\nf) organeve t\u00eb qeverisjes vendore;<br \/>\ng) organeve t\u00eb bashk\u00ebsive fetare;<br \/>\ngj) partive politike;<br \/>\nh) organizatave;<br \/>\ni) individ\u00ebve.<\/p>\n<p>2. Subjektet e parashikuara nga n\u00ebnparagraf\u00ebt \u201cd\u201d, \u201cdh\u201d, \u201ce\u201d, \u201c\u00eb\u201d, \u201cf\u201d, \u201cg\u201d, \u201cgj\u201d, \u201ch\u201d dhe<br \/>\n\u201ci\u201d, t\u00eb paragrafit 1, t\u00eb k\u00ebtij neni, mund t\u00eb b\u00ebjn\u00eb k\u00ebrkes\u00eb vet\u00ebm p\u00ebr \u00e7\u00ebshtje q\u00eb lidhen me interesat e tyre.<\/p>\n<p>Nga leximi i k\u00ebtij neni del se kushtetuta n\u00eb paragrafin 1 pika \u201cc\u201d ia ka dh\u00ebn\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb jo m\u00eb pak se 1\/5 s\u00eb deputet\u00ebve dhe n\u00eb asnj\u00eb pik\u00eb apo g\u00ebrm\u00eb t\u00eb tij n\u00eb mbi 100 fjal\u00eb t\u00eb k\u00ebtij nenit nuk ekziston fjala kuvend. Pra qart\u00eb Kushtetuta nuk ja ka dh\u00ebn\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb i cili p\u00ebrb\u00ebhet nga deputet\u00ebt, organet drejtuese dhe stafet i tij. Kushtetuta nuk i ka njohur t\u00eb drejt\u00ebn p\u00ebr v\u00ebnien n\u00eb l\u00ebvizje asnj\u00ebrit prej organeve drejtuese t\u00eb tij si t\u00eb tilla dmth kryesis\u00eb, byros\u00eb, komisioneve apo kryesis\u00eb s\u00eb grupeve parlamentare ndon\u00ebse ajo i njeh k\u00ebto organe si organe kushtetuese. Ajo nuk ja jep k\u00ebt\u00eb t\u00eb drejt\u00eb Kryatares\/ Kryetarit t\u00eb kuvendit ndon\u00ebse n\u00eb hierarkin\u00eb shtet\u00ebrore ai apo ajo \u00ebsht\u00eb num\u00ebri dy i shtetit dhe sigurisht kurr\u00eb nuk mund ta harronte. K\u00ebt\u00eb t\u00eb drejt\u00eb pra kryetari\/ja e kuvendit e ka, por vet\u00ebm si nj\u00eb ligjv\u00ebn\u00ebse dhe vet\u00ebm n\u00eb rastse ai ose ajo firmosin si t\u00eb barabart\u00eb s\u00eb bashku me 1\/5 e deputet\u00ebve t\u00eb kuvendit. P\u00ebr t\u00eb kuptuar m\u00eb mir\u00eb k\u00ebt\u00eb p\u00ebrjashtim q\u00eb i b\u00ebn kushtetuta kuvendit n\u00eb kuptimin e organeve drejtuese t\u00eb tij le t\u2019i referohemi p\u00ebrs\u00ebri Nenit 134 i cili thot\u00eb n\u00eb pik\u00ebn dh: \u201ck\u00ebt\u00eb t\u00eb drejt\u00eb ja njeh \u00e7do gjykate, sipas nenit 134 pika 2, t\u00eb k\u00ebsaj Kushtetute\u201d. Po t\u00eb rikthehemi tek neni 7 i Kushtetues aty flitet p\u00ebr pushtet ligjv\u00ebn\u00ebs dhe gjyq\u00ebsore kurse n\u00eb nenin 134 n\u00eb pik\u00ebn c nuk flitet p\u00ebr kuvend por p\u00ebr 1\/5 e deputet\u00ebve ( ligjevensve) nd\u00ebrsa n\u00eb pik\u00ebn \u2018dh\u2019 t\u00eb k\u00ebtij neni flitet p\u00ebr gjykat\u00eb si institucion dhe jo p\u00ebr pushtet gjyq\u00ebsor.<\/p>\n<p>Kushtetuta duke njohur t\u00eb drejt\u00ebn e 1\/5 s\u00eb deputet\u00ebve para se gjithash ka respektuar nj\u00eb parim universal at\u00eb t\u00eb respektimit t\u00eb t\u00eb drejt\u00ebs s\u00eb pakic\u00ebs natyrisht jo t\u00eb \u00e7do pakice por t\u00eb asaj q\u00eb grupon s\u00eb paku 1\/5 e deputet\u00ebve. Kjo natyrisht nuk p\u00ebrjashton q\u00eb k\u00ebta mund t\u00eb jen\u00eb edhe m\u00eb shum\u00eb madje mundet edhe t\u00eb gjith\u00eb deputet.<br \/>\nDuke mohuar me vendimin e saj t\u00eb drejt\u00ebn, kushtetuese t\u00eb pakushtezuar t\u00eb pakic\u00ebs dhe duke e transferuar k\u00ebt\u00eb t\u00eb drejt\u00eb de facto tek Kuvendi, Gjykata Kushtetuese ka p\u00ebrmbysur Kushtetut\u00ebn, pluralizmin demokratik parlamentar, pra kryen nj\u00eb akt t\u00eb r\u00ebnd\u00eb pu\u00e7ist ndaj rendit kushtetues dhe \u00ebsht\u00eb shnd\u00ebrruar n\u00eb nj\u00eb veg\u00ebl t\u00eb vendosjes s\u00eb rregjimit monist t\u00eb Edi Ram\u00ebs n\u00eb Shqiperi.<\/p>\n<p>P\u00ebrve\u00e7 k\u00ebsaj Gjykata Kushtetuese n\u00eb zbatim t\u00eb urdh\u00ebrit politik dhunon r\u00ebnd\u00eb Kushtetut\u00ebn, mashtron n\u00eb amoralitet t\u00eb plot\u00eb ligjor kur paraqet 1\/5 e deputet\u00ebve si subjekt me t\u00eb drejt\u00eb t\u00eb kusht\u00ebzuar n\u00eb paraqitjen e k\u00ebrkesave ndaj saj. Ajo me k\u00ebt\u00eb pohim skandaloz del qartazi kund\u00ebr nenit 134 t\u00eb kushtetut\u00ebs dhe n\u00eb vendimin e saj thot\u00eb t\u00eb kund\u00ebrten e asaj \u00e7ka sanksionon Kushtetuta n\u00eb nenin 134. Ky nen nuk ia ka l\u00ebn\u00eb Gjykat\u00ebs t\u00eb caktoj se cilat jan\u00eb subjektet q\u00eb mund t\u00eb ven\u00eb n\u00eb l\u00ebvizje Gjykat\u00ebn me t\u00eb drejt\u00eb t\u00eb kusht\u00ebzuar dometh\u00ebn\u00eb q\u00eb mund t\u00eb v\u00eb n\u00eb l\u00ebvizje at\u00eb p\u00ebr interesa t\u00eb aktiviteteve t\u00eb tyre dhe cilat subjekte kan\u00eb te drejte t\u00eb pakusht\u00ebzuar dmth q\u00eb nuk kan\u00eb kufizime t\u00eb lidhura me interesa t\u00eb aktivitetit t\u00eb tyre, por mund t\u2019a v\u00ebn\u00eb n\u00eb l\u00ebvizje p\u00ebr \u00e7\u00ebshtje me r\u00ebnd\u00ebsi shoq\u00ebrore q\u00eb ata vet\u00eb e vler\u00ebsojn\u00eb se duhet t\u2019i parqesin n\u00eb Gjykat\u00ebn Kushtetuese. P\u00ebr t\u00eb dalluar k\u00ebto subjekte Kushtetuta n\u00eb paragrafin 2 t\u00eb nenit 134 sanksionon se:<\/p>\n<p>\u201cSubjektet e parashikuara nga n\u00ebnparagraf\u00ebt \u201cd\u201d, \u201cdh\u201d, \u201ce\u201d, \u201c\u00eb\u201d, \u201cf\u201d, \u201cg\u201d, \u201cgj\u201d, \u201ch\u201d dhe \u201ci\u201d, t\u00eb paragrafit 1, t\u00eb k\u00ebtij neni, mund t\u00eb b\u00ebjn\u00eb k\u00ebrkes\u00eb vet\u00ebm p\u00ebr \u00e7\u00ebshtje q\u00eb lidhen me interesat e tyre. Kurse subjekteve t\u00eb tjera si Presidentit t\u00eb Republik\u00ebs, Kryeministrit, 1\/5 s\u00eb grupit t\u00eb deputetve dhe Avokatit t\u00eb Popullit Kushtetuta p\u00ebrjashton nga kusht\u00ebzimi i t\u00eb drejt\u00ebs kushtetuese t\u00eb paraqitjes t\u00eb k\u00ebrkes\u00ebs n\u00eb Gjykat\u00ebn Kushtetuese \u2018vet\u00ebm p\u00ebr \u00e7\u00ebshtje q\u00eb lidhen me interesat e tyre. K\u00ebta subjekte kan\u00eb t\u00eb drejt\u00ebn kushtetuese t\u00eb pa pakusht\u00ebzuar p\u00ebr t\u2019ju drejtuar gjykat\u00ebs. K\u00ebshtu gjykt\u00ebsit e Gjykat\u00ebs Kushtetuese me vendimin e tyre kan\u00eb shkelmuar jo vet\u00ebm mbi kushtetut\u00ebn, por edhe mbi t\u00eb gjith\u00eb jurisprudenc\u00ebn e k\u00ebsaj gjykate, mbi veten e tyre por edhe mbi vet vendimin e tyre q\u00eb pranuan dy jav\u00eb m\u00eb par\u00eb n\u00eb p\u00ebrputhje me nenin 134\/1c k\u00ebrkes\u00ebn e grupit t\u00eb 1\/5 t\u00eb deputet\u00ebve p\u00ebr protokollin midis qeveris\u00eb shqiptare dhe qeveris\u00eb Italiane p\u00ebr emigracionin. Ky standart i p\u00ebrdorur n\u00eb vendimin e djesh\u00ebm nuk mund t\u00eb quhet ndryshe ve\u00e7se m\u00eb s\u00eb paku mashtrim, pafytyr\u00ebsi ligjore me pasoja dramatike per vendin.<\/p>\n<p>Por tani le t\u00eb ndalemi n\u00eb aktin tjeter pu\u00e7ist t\u00eb vendimit t\u00eb Gjykates Kushtetuese n\u00eb t\u00eb cilin thuhet: \u201cP\u00ebr rrjedhoj\u00eb, k\u00ebrkuesi, grupi i deputet\u00ebve, nuk legjitimohet t\u2019i drejtohet Gjykat\u00ebs Kushtetuese, pasi referuar mosmarrveshjes s\u00eb pretenduar t\u00eb kompetencave, ai nuk \u00ebsht\u00eb subjekt n\u00eb konflikt. Pra nuk rezulton t\u2019i jet\u00eb marr\u00eb ndonj\u00eb komptenc\u00eb, apo t\u00eb jet\u00eb c\u00ebnuar drejtp\u00ebrdrejt\u00eb n\u00eb ndonj\u00eb kompetenc\u00eb. Grupi i 1\/5 t\u00eb deputet\u00ebve, pavar\u00ebsisht se \u00ebsht\u00eb pjes\u00eb e ushtrimit t\u00eb veprimtaris\u00eb legjislative t\u00eb Kuvendit, nuk n\u00ebnkupton q\u00eb ai \u00ebsht\u00eb subjekti kushtetues p\u00ebr t\u00eb cilin b\u00ebn fjal\u00eb neni 73, pika 2 i Kushtetut\u00ebs. Pra, ai nuk mund t\u00eb veproj\u00eb n\u00eb em\u00ebr dhe me tagrat e kuvendit.<br \/>\nE v\u00ebrtata \u00ebsht\u00eb krejt tjet\u00ebr.<\/p>\n<p>Por kush e v\u00eb n\u00eb l\u00ebvizje gjykat\u00ebn p\u00ebr k\u00ebt\u00eb konflikt midis pushteteve. Sipas kushtetut\u00ebs nenit 134\/\u00e7 kjo e drejt\u00eb i njihet nga kushtetuta 1\/5 se deputetve dhe jo kuvendit apo drejtueseve te tij. Sipas ketij vendimi meqen\u00ebse Gjykata i heq t\u00eb drejt\u00ebn 1\/5 s\u00eb deputet\u00ebve p\u00ebr t\u2019u ankuar n\u00eb Gjykat\u00ebn Kushtetuese dhe sipas vet\u00eb Kushtetut\u00ebs, Kuvendi nuk e ka k\u00ebt\u00eb t\u00eb drejt\u00eb t\u00eb ankohet n\u00eb Gjykt\u00ebn Kushtetuese del se pushtetin ligjv\u00ebn\u00ebs dometh\u00ebn\u00eb t\u00eb drejtat kushtetuese t\u00eb deputeve mund t\u2019i marr\u00eb kushdo dhe askush t\u00eb mos mund t\u00eb ankohet.<\/p>\n<p>Sipas nenit 131 t\u00eb kushtetut\u00ebs pika \u00e7, Gjykata Kushtetuese vendos p\u00ebr: mosmarr\u00ebveshjet e kompetenc\u00ebs nd\u00ebrmjet pushteteve, si dhe nd\u00ebrmjet pushtetit qendror dhe qeverisjes vendore;<br \/>\nE nj\u00ebjta gj\u00eb konfirmohet edhe n\u00eb ligjin organik t\u00eb Gjykat\u00ebs Kushtetuese. K\u00ebshtu, n\u00eb nenin 54 t\u00eb k\u00ebtij ligji thuhet se: \u201cN\u00eb mb\u00ebshtetje t\u00eb nenit 131 pika \u00e7 t\u00eb Kushtetut\u00ebs, Gjykata Kushtetuese shqyrton mosmarr\u00ebveshjet e kompetenc\u00ebs nd\u00ebrmjet pushteteve, si dhe nd\u00ebrmjet pushtetit qendror dhe qeverisjes vendore dhe kur mosmarrveshja ka lidhje t\u00eb drejt\u00eb p\u00ebr drejt\u00eb me ushtrimin e veprimtaris\u00eb s\u00eb tyre\u201d<\/p>\n<p>Ajo q\u00eb shkruan gjykata se k\u00ebto komptetenca i jan\u00eb c\u00ebnuar kuvendit dhe jo deputet\u00ebve kjo \u00ebsht\u00eb nj\u00eb dhun\u00eb logjike dhe ligjore. Jan\u00eb c\u00ebnuar nga Prokuroria Speciale dhe Gjykata kompetencat kushtetuese t\u00eb deputet\u00ebve p\u00ebr t\u2019u shprehur dhe ushtruar pushtetin e tyre sipas procedur\u00ebs q\u00eb ka p\u00ebrcaktuar ligji p\u00ebr dh\u00ebnien e autorizimit p\u00ebr heqjen e imunitetit t\u00eb deputetit. Po n\u00eb k\u00ebt\u00eb linj\u00eb komisioni monist i mandateve p\u00ebr motive politike vendosi t\u00eb legjitimoj\u00eb nj\u00eb vendim t\u00eb paligjsh\u00ebm t\u00eb motivuar politikisht gjykat\u00ebs dhe prokuroris\u00eb speciale. P\u00ebr m\u00eb tep\u00ebr, ky komision nuk shqyrtoi asnj\u00eb prov\u00eb, fakt apo dokument, mbasi prokuror\u00ebt n\u00eb komision paraqit\u00ebn vet\u00ebm vendimin e Gjykat\u00ebs dhe prokuroria nj\u00eb dokument 6-7 faqesh, nd\u00ebrkoh\u00eb q\u00eb n\u00eb \u00e7do rast tjet\u00ebr para k\u00ebtij rasti jan\u00eb paraqitur qindra e madje mij\u00ebra faqe.<\/p>\n<p>Si p\u00ebrfundim mund t\u00eb themi se me vendimin e fundit t\u00eb saj politik Gjykata Kushtetuese i dha nj\u00eb kolpo di gracia Rendit Kushtetues t\u00eb vendit dhe firomosi vendosjen e monizmit t\u00eb plot\u00eb t\u00eb Edi Ram\u00ebs n\u00eb Shqip\u00ebri.
