Nj\u00ebzetenj\u00eb muaj m\u00eb von\u00eb, 50-vje\u00e7ari nga Kamza u d\u00ebnua nga Gjykata e Tiran\u00ebs me 4 muaj burg p\u00ebr nd\u00ebrtim pa leje. Ndaj tij u vendos dhe nj\u00eb gjob\u00eb 500 mij\u00eb lek\u00eb nga Bashkia Kam\u00ebz.<\/p>\n<p>Shpejt\u00ebsia me t\u00eb cil\u00ebn autoritetet gjurmuan dhe sanksionuan shkeljen ligjore t\u00eb Fluturimit \u00ebsht\u00eb e pazakont\u00eb. Vet\u00ebm disa kilometra larg nga Kamza, af\u00ebr Liqenit Artificial dhe qendr\u00ebs s\u00eb Tiran\u00ebs, gjat\u00eb vitit 2022 nj\u00eb duzin\u00eb kompanish nd\u00ebrtimi shkel\u00ebn lejet e nd\u00ebrtimit duke shtuar kate pa leje mbi pallate shum\u00ebkat\u00ebshe.<\/p>\n<p>Pavar\u00ebsisht se punimet zgjat\u00ebn p\u00ebr muaj me radh\u00eb, nd\u00ebrtuesit vazhduan pun\u00eb t\u00eb pashqet\u00ebsuar deri n\u00eb vjesht\u00eb t\u00eb vitit 2022, kur qeveria miratoi nj\u00eb vendim t\u00eb debatuesh\u00ebm p\u00ebr t\u2019i konfiskuar shtesat q\u00eb deri n\u00eb at\u00eb moment i kishin shp\u00ebtuar vigjilenc\u00ebs s\u00eb inspektor\u00ebve me t\u00eb cil\u00ebn p\u00ebrballen qytetar\u00ebt e thjesht\u00eb.<\/p>\n<p>Ndryshe nga qytetar\u00ebt, nd\u00ebrtuesve t\u00eb m\u00ebdhenj qeveria u hapi nj\u00eb shteg, q\u00eb sipas ekspert\u00ebve dhe opozit\u00ebs u mund\u00ebson atyre nj\u00eb legalizim t\u00eb kateve shtes\u00eb t\u00eb paligjshme, fillimisht duke i konfiskuar dhe m\u00eb von\u00eb duke ia shitur ato vet\u00eb shkel\u00ebsve t\u00eb ligjit.<\/p>\n<p>Por, nd\u00ebrsa K\u00ebshilli i Ministrave n\u00eb let\u00ebr parashikonte nj\u00eb pages\u00eb me \u00e7mim tregu p\u00ebr k\u00ebto shtesa \u2013 q\u00eb n\u00eb Tiran\u00eb shkon disa mij\u00ebra euro p\u00ebr met\u00ebr katror, BIRN zbuloi se ato u vler\u00ebsuan mesatarisht me \u00e7mimin 223 euro p\u00ebr met\u00ebr katror.<\/p>\n<p>Ekspert\u00ebt e nd\u00ebrtimit dhe p\u00ebrfaq\u00ebsues t\u00eb opozit\u00ebs e shohin procedur\u00ebn si nj\u00eb shkelje t\u00eb hapur t\u00eb barazis\u00eb para ligjit. Jorida Tabaku, deputete e Partis\u00eb Demokratike, tha se procedura tregon duksh\u00ebm favorizimin e nd\u00ebrtuesve t\u00eb m\u00ebdhenj.<\/p>\n<p>\u201cK\u00ebta tregohen t\u00eb fort\u00eb me t\u00eb dob\u00ebtit, me nd\u00ebrtimet pa leje, me mas\u00ebn q\u00eb u mor para ca vitesh q\u00eb njer\u00ebzit shkuan n\u00eb burg p\u00ebr nj\u00eb dritare, p\u00ebr nj\u00eb avlli, p\u00ebr nj\u00eb prag sht\u00ebpie \u2013 kam un\u00eb n\u00eb zon\u00ebn time elektorale pa fund,\u201d tha Tabaku.<\/p>\n<p>Arlind Qori, ish-kandidat p\u00ebr kryetar bashkie p\u00ebr Tiran\u00ebn dhe kryetar i L\u00ebvizjes Bashk\u00eb tha, se ka nj\u00eb \u201chendek skandaloz\u201d mes \u00e7mimit real \u2013 deri n\u00eb 5 mij\u00eb euro p\u00ebr met\u00ebr katror n\u00eb k\u00ebto zona \u2013 dhe \u00e7mimit q\u00eb vler\u00ebsuesit e pun\u00ebsuar nga Ministria e Financave u kan\u00eb dh\u00ebn\u00eb godinave.<\/p>\n<p>\u201cKjo diferenc\u00eb tregon se si qeveria qendrore \u00ebsht\u00eb duke favorizuar duksh\u00ebm nd\u00ebrtuesit e kullave n\u00eb kurriz t\u00eb interesit publik,\u201d tha ai.<\/p>\n<p>N\u00eb p\u00ebrgjigje t\u00eb pyetjeve t\u00eb BIRN, Ministria e Financave ia la p\u00ebrgjegj\u00ebsin\u00eb p\u00ebr \u00e7mimet e ul\u00ebta ekspert\u00ebve vler\u00ebsues, duke lar\u00eb duart nga p\u00ebrgjegj\u00ebsia.<\/p>\n<p>\u201cRaportet e vler\u00ebsimit jan\u00eb hartuar nga ekspert\u00eb t\u00eb licencuar dhe vler\u00ebsimi i objekteve t\u00eb konfiskuara \u00ebsht\u00eb b\u00ebr\u00eb duke p\u00ebrdorur metodat e vler\u00ebsimit t\u00eb objektit, referuar struktur\u00ebs dhe gjendjes s\u00eb tij faktike n\u00eb zbatim t\u00eb legjislacionit n\u00eb fuqi,\u201d tha Ministria n\u00eb nj\u00eb p\u00ebrgjigje me shkrim.<\/p>\n<p><strong>Sa fr\u00ebngu pul\u00ebn?<\/strong><\/p>\n<p>N\u00eb konferenc\u00ebn p\u00ebr shtyp t\u00eb fundvitit, t\u00eb mbajtur m\u00eb 30 dhjetor 2023, kryeministri Edi Rama iu rikthye godinave t\u00eb konfiskuara p\u00ebr shkak t\u00eb shtesave pa leje, t\u00eb cilat po i n\u00ebnshtrohen k\u00ebsaj procedure. Duke iu referuar akteve t\u00eb parablerjes t\u00eb firmosura mes Ministris\u00eb s\u00eb Financave dhe 9 nd\u00ebrtuesve, Rama u mburr se shteti kishte ark\u00ebtuar 3.5 milion\u00eb euro nga 5 godina dhe se n\u00eb total priste t\u00eb merrte 10.5 milion\u00eb euro.<\/p>\n<p>\u201cPra, p\u00ebr \u00e7do met\u00ebr katror t\u00eb b\u00ebr\u00eb pa leje, aty ku \u00ebsht\u00eb konsideruar parablerja nga subjektet, subjektet po paguajn\u00eb dhe do paguajn\u00eb deri n\u00eb fund sa fr\u00ebngu pul\u00ebn \u00e7do met\u00ebr katror q\u00eb kan\u00eb b\u00ebr\u00eb pa leje,\u201d tha kryeministri.<\/p>\n<p>Sipas Ram\u00ebs, ark\u00ebtimet n\u00eb buxhet i p\u00ebrg\u00ebnjeshtronin akuzat ndaj k\u00ebtij procesi q\u00eb, sipas tij, ishin \u201cnj\u00eb zhurm\u00eb e shoq\u00ebruar edhe me shum\u00eb hamend\u00ebsime dhe me shum\u00eb shpifje\u201d.<\/p>\n<p>P\u00ebrmes k\u00ebrkes\u00ebs p\u00ebr t\u00eb drejt\u00eb informimi, BIRN mori nga Ministria e Financave raportet e vler\u00ebsimit p\u00ebr 9 godinat e gjetura n\u00eb shkelje t\u00eb lejes s\u00eb nd\u00ebrtimit.<\/p>\n<p>Nga k\u00ebto nd\u00ebrtime, 6 kan\u00eb shkelur lejen e nd\u00ebrtimit me mbi 10% t\u00eb sip\u00ebrfaqes dhe jan\u00eb konfiskuar plot\u00ebsisht, nd\u00ebrsa nj\u00eb kompani e ka shkelur lejen e nd\u00ebrtimit me 6% \u2013 sipas vendimit t\u00eb KKT-s\u00eb \u2013 dhe \u00ebsht\u00eb konfiskuar vet\u00ebm shtesa. Dy pronat e tjera t\u00eb konfiskuara dhe n\u00eb proces parablerjeje ndodhen n\u00eb Kavaj\u00eb.<\/p>\n<p>Bazuar n\u00eb k\u00ebto raporte vler\u00ebsimi, prej t\u00eb cilave tet\u00eb jan\u00eb bazuar n\u00eb metod\u00ebn e kostos, \u00e7mimi mesatar q\u00eb detyrohen t\u00eb paguajn\u00eb kompanit\u00eb e kapura n\u00eb shkelje t\u00eb lejes s\u00eb nd\u00ebrtimit n\u00eb Tiran\u00eb \u00ebsht\u00eb 223 euro p\u00ebr met\u00ebr katror.<\/p>\n<p>\u00c7mimi m\u00eb i lart\u00eb prej 305,3 euro metri katror i p\u00ebrket godin\u00ebs s\u00eb nd\u00ebrtuar nga kompania \u201cFabri D\u201d n\u00eb rrug\u00ebn Kont Urani, rreth 500 metra nga sheshi Sk\u00ebnderbej. Vlera m\u00eb e ul\u00ebt \u2013 170 euro metri katror \u2013 \u00ebsht\u00eb p\u00ebr godin\u00ebn e nd\u00ebrtuar nga kompania Salillari pran\u00eb Kopshtit Zoologjik. N\u00eb total kompanit\u00eb vler\u00ebsohet se duhet t\u00eb paguajn\u00eb rreth 14.9 milion\u00eb euro p\u00ebr 71 mij\u00eb metra katror\u00eb pa leje n\u00eb kryeqytet.<\/p>\n<p>N\u00eb raportet e vler\u00ebsimit, ekspert\u00ebt pretendojn\u00eb kryesisht se nuk mund t\u00eb p\u00ebrdornin metod\u00eb tjet\u00ebr p\u00ebr shkak se objektet ishin t\u00eb pap\u00ebrfundura dhe se \u201cnuk mund t\u00eb gjejm\u00eb leht\u00ebsisht prona t\u00eb ngjashme n\u00eb treg\u201d.<\/p>\n<p>Vler\u00ebsuesit, t\u00eb cil\u00ebt i referohen Vendimit t\u00eb K\u00ebshillit t\u00eb Ministrave 970\/2020 \u201cp\u00ebr metodologjin\u00eb e p\u00ebrcaktimit t\u00eb vler\u00ebs s\u00eb sendit n\u00eb procesin e ekzekutimit t\u00eb detyruesh\u00ebm\u201d dhe Standardit Evropian t\u00eb Vler\u00ebsimit, e argumentojn\u00eb zgjedhjen e metodologjis\u00eb me faktin se Agjencia Shtet\u00ebrore e Kadastr\u00ebs (ASHK) nuk u dha apo nuk kishte kontrata shitblerje t\u00eb k\u00ebtyre pasurive ose t\u00eb ngjashme me ato.<\/p>\n<p>I vetmi raport vler\u00ebsim q\u00eb i referohet nj\u00eb metode t\u00eb ndryshme nga ajo e kostos \u2013 p\u00ebr nj\u00eb objekt n\u00eb Qerret t\u00eb Kavaj\u00ebs me zhvillues shoq\u00ebrin\u00eb Veizi sh.p.k \u2013 e nxori vler\u00ebn e objektit me 464 euro metri katror, disa her\u00eb m\u00eb t\u00eb lart\u00eb se objektet e vler\u00ebsuara n\u00eb kryeqytet.<\/p>\n<p>Arkitektja Dorina Musai tha p\u00ebr BIRN se metoda e kostos e p\u00ebrdorur p\u00ebr vler\u00ebsimet e tet\u00eb pallateve n\u00eb shkelje t\u00eb lejes s\u00eb nd\u00ebrtimit n\u00eb kryeqytet nuk ishte e p\u00ebrshtatshme dhe nuk p\u00ebrputhej me q\u00ebllimin e caktimit t\u00eb vler\u00ebs s\u00eb tregut p\u00ebr to.<\/p>\n<p>Duke iu referuar faktit q\u00eb tregu i pasurive t\u00eb paluajtshme \u00ebsht\u00eb i hapur dhe \u00e7mimet leht\u00ebsisht t\u00eb verifikueshme, Musai thot\u00eb se ky vler\u00ebsim bie ndesh me Standardin Europian t\u00eb Vler\u00ebsimit q\u00eb e kufizon p\u00ebrdorimin e k\u00ebsaj metode vet\u00ebm kur \u201cka nj\u00eb munges\u00eb totale t\u00eb t\u00eb dh\u00ebnave t\u00eb tregut\u201d.<\/p>\n<p>\u201cN\u00eb vende t\u00eb ndryshme, metoda e kostos si metod\u00eb tregu p\u00ebrdoret rrall\u00eb dhe gjithnj\u00eb e shoq\u00ebruar me nj\u00eb metod\u00eb tjet\u00ebr,\u201d tha Musai.<\/p>\n<p>\u201c\u00cbsht\u00eb e lejueshme t\u00eb p\u00ebrdoret si metod\u00eb tregu, n\u00ebse mungojn\u00eb transaksionet e tregut dhe vler\u00ebsuesi \u00ebsht\u00eb i detyruar t\u00eb p\u00ebrcaktoj\u00eb vler\u00ebn e tregut,\u201d shtoi ajo.<\/p>\n<p>Duke iu referuar rastit n\u00eb fjal\u00eb, Musai theksoi se metoda e duhur do t\u00eb ishte ajo e \u201ckrahasimit t\u00eb drejtp\u00ebrdrejt\u00eb\u201d, sipas t\u00eb cil\u00ebs vler\u00ebsuesi nxjerr \u00e7mimin bazuar n\u00eb shitblerjet e pronave t\u00eb ngjashme n\u00eb zon\u00eb.<\/p>\n<p>P\u00ebrndryshe nga sa pretendohet n\u00eb aktet e vler\u00ebsimit, VKM 970\/2020, e cila merret si baz\u00eb ligjore, u k\u00ebrkon vler\u00ebsuesve q\u00eb t\u00eb nxjerrin \u00e7mimin e nj\u00eb prone bazuar n\u00eb nj\u00eb seri t\u00eb dh\u00ebnash, p\u00ebrfshi kontratat noteriale, t\u00eb dh\u00ebnat nga agjenci imobiliare apo edhe \u00e7mimet e publikuara n\u00eb internet.<\/p>\n<p>Sipas Musait, n\u00eb qend\u00ebr t\u00eb kryeqytetit \u00e7mimet variojn\u00eb nga 3,000 deri 4,500 euro p\u00ebr met\u00ebr katror, n\u00eb disa raste kan\u00eb kapur edhe vlera 7,000 euro p\u00ebr met\u00ebr katror apartamenti. Nd\u00ebrsa p\u00ebr ambientet e sh\u00ebrbimit, variojn\u00eb nga 6,000 deri ne 15,000 euro metri katror.<\/p>\n<p>\u201cPra, tregu \u00ebsht\u00eb nj\u00eb gj\u00eb dhe vlera e vendosur nga qeveria \u00ebsht\u00eb nj\u00eb gj\u00eb tjet\u00ebr,\u201d tha ajo.<\/p>\n<p>Edhe \u00e7mimet e afishuara nga kompanit\u00eb q\u00eb kan\u00eb shkelur lejen, n\u00eb disa raste, jan\u00eb shum\u00eb her\u00eb m\u00eb larta se vler\u00ebsimi i b\u00ebr\u00eb nga Ministria e Financave.<\/p>\n<p>Kryetari i L\u00ebvizjes Bashk\u00eb, Arlind Qori, i tha BIRN se i gjith\u00eb procesi i riblerjes s\u00eb metrave katror\u00eb t\u00eb sekuestruar \u00ebsht\u00eb i padrejt\u00eb, n\u00ebse mbahet n\u00eb konsiderat\u00eb interesi publik.<\/p>\n<p>\u201cP\u00ebrderisa katet e sekuestruara kan\u00eb kaluar n\u00eb pron\u00ebsi t\u00eb shtetit, at\u00ebher\u00eb ky i fundit duhet t\u2019i nxirrte n\u00eb ankand publik k\u00ebto kate dhe t\u2019ua shiste ofruesve t\u00eb \u00e7mimit m\u00eb t\u00eb lart\u00eb, pavar\u00ebsisht se k\u00ebta t\u00eb fundit mund t\u00eb mos ishin pronar\u00ebt fillestar\u00eb t\u00eb nd\u00ebrtes\u00ebs,\u201d tha ai.<\/p>\n<p>P\u00ebr arkitekten Dorina Musai, e gjith\u00eb procedura e p\u00ebrdorur \u00ebsht\u00eb e paligjshme.<\/p>\n<p>\u201cSkema e p\u00ebrdorur p\u00ebr konfiskimin dhe m\u00eb pas shitjen e sip\u00ebrfaqeve t\u00eb nd\u00ebrtuara pa leje t\u00eb nj\u00ebjtave subjekte \u00ebsht\u00eb legalizim jasht\u00eb kushteve te ligjit, duke zhvilluar k\u00ebshtu nj\u00eb skenar t\u00eb diferencuar dhe ekskluziv vet\u00ebm p\u00ebr disa qytetar\u00eb,\u201d shpjegoi ajo.<\/p>\n<p>Megjithat\u00eb, Ministria e Financave k\u00ebmb\u00ebngul se thjesht po zbaton ligjin dhe VKM-n\u00eb p\u00ebrkat\u00ebse.<\/p>\n<p>\u201cProcedurat e ndjekura nga MFE lidhur me konfiskimin p\u00ebr interes publik t\u00eb objekteve t\u00eb nd\u00ebrtuara pa leje jan\u00eb ndjekur konform p\u00ebrcaktimeve t\u00eb VKM-s\u00eb nr. 589, dat\u00eb 07.09.2022 dhe Udh\u00ebzimit nr. 27, dat\u00eb 23.09.2023\u201d, theksoi ajo, duke ju referuar vendimeve t\u00eb K\u00ebshillit t\u00eb Ministrave.<\/p>\n<p><strong>Hetime komplekse<\/strong><\/p>\n<p>Fluturimi, i cili mbuloi sht\u00ebpin\u00eb p\u00ebr t\u2019i shp\u00ebtuar lag\u00ebshtis\u00eb dhe krijoi nj\u00eb streh\u00eb p\u00ebr depozit\u00ebn e ujit, u p\u00ebrfaq\u00ebsua nga nj\u00eb avokat kryesisht n\u00eb gjykat\u00eb. \u00c7\u00ebshtja ishte e \u201ckopsitur\u201d. Para gjykat\u00ebs u vun\u00eb provat, p\u00ebrfshi foto dhe detaje t\u00eb plota t\u00eb punimeve.<\/p>\n<p>\u201cN\u00eb gjykat\u00eb i kishin t\u00eb gjitha, edhe fotot e pastra, dukej edhe ngjyra gri e izoluesit t\u00eb tarrac\u00ebs. Nuk u kishte shp\u00ebtuar asgj\u00eb. T\u00eb diel\u00ebn e shtrova un\u00eb solet\u00ebn, t\u00eb h\u00ebn\u00ebn erdh\u00ebn ata\u201d, thot\u00eb ai.<\/p>\n<p>N\u00eb nj\u00eb proces t\u00eb shkurt\u00ebr, 50-vje\u00e7ari, i cili ende pret legalizimin e sht\u00ebpis\u00eb s\u00eb tij t\u00eb nd\u00ebrtuar n\u00eb vitet 2000, u d\u00ebnua me 6 muaj burg dhe p\u00ebrfitoi 2 muaj ulje p\u00ebr shkak t\u00eb gjykimit t\u00eb shkurtuar.<\/p>\n<p>Para gjykat\u00ebs ai thot\u00eb se pranoi gjith\u00e7ka dhe se nuk ndihej fajtor.<\/p>\n<p>\u201cNuk kam bo asnj\u00eb turp, sht\u00ebpin\u00eb time rregullova,\u201d theksoi ai, nd\u00ebrsa shtoi se ka ndryshim mes tij dhe nd\u00ebrtuesve t\u00eb m\u00ebdhenj n\u00eb kryeqytet.<\/p>\n<p>\u201cAta jan\u00eb oligark\u00eb, paguajn\u00eb kafe, kan\u00eb interesa me nj\u00ebri-tjetrin. Un\u00eb nuk u dhash\u00eb asgj\u00eb. Un\u00eb fukara isha, fukara jam, fukarai budallai\u201d, thot\u00eb ai me nj\u00eb far\u00eb vet\u00eb-ironie.<\/p>\n<p>Ndryshe nga Fluturimi dhe qindra syresh t\u00eb tjer\u00eb, proceset penale ndaj t\u00eb cil\u00ebve zgjasin vet\u00ebm disa muaj, nd\u00ebrtuesit e m\u00ebdhenj ende nuk jan\u00eb par\u00eb n\u00eb gjykat\u00eb.<\/p>\n<p>Madje, ata vijuan t\u00eb punonin n\u00eb godinat pa leje edhe pasi k\u00ebto ishin t\u00eb konfiskuara si prona publike dhe n\u00eb dukje nuk i druheshin ndonj\u00eb nd\u00ebshkimi nga sistemi i drejt\u00ebsis\u00eb.<\/p>\n<p>Sipas Prokuroris\u00eb s\u00eb Tiran\u00ebs, hetimet e filluara p\u00ebr pallatet e nd\u00ebrtuara n\u00eb shkelje t\u00eb lejes jan\u00eb ende n\u00eb vijim.
