Kund\u00ebr k\u00ebtyre ndryshimeve opozita ka depozituar k\u00ebrkes\u00eb n\u00eb Gjykat\u00ebn Kushtetuese dhe kjo gjykat\u00eb do ta shqyrtoj\u00eb k\u00ebt\u00eb \u00e7\u00ebshtje s\u00eb shpejti.<\/p>\n<p>Edhe pa k\u00ebto ndryshime, ligji p\u00ebr komisionet hetimore parlamentare nuk k\u00ebnaqte g\u00ebrm\u00ebn dhe frym\u00ebn e Kushtetut\u00ebs. B\u00ebr\u00eb p\u00ebr her\u00eb t\u00eb par\u00eb n\u00eb vitin 2002, komisionet hetimore nuk dallonin thuajse fare p\u00ebr nga organizimi dhe procedura vendimmarr\u00ebse nga komisionet e zakonshme parlamentare dhe shumica parlamentare, duke pasur gjithnj\u00eb shumic\u00ebn n\u00eb komision, mund ta pengonte sa her\u00eb t\u00eb donte hetimin opozitar.<\/p>\n<p>Ligjit me koh\u00eb iu b\u00ebn\u00eb disa ndryshime q\u00eb ndihmonin disi vijimin e pand\u00ebrprer\u00eb t\u00eb pun\u00ebs hetimore, si p.sh., pranimi pa votim n\u00eb komision i k\u00ebrkesave drejtuar institucioneve dhe subjekteve t\u00eb ndryshme p\u00ebr t\u00eb dh\u00ebna e dokumente por mund\u00ebsia e mazhoranc\u00ebs s\u00eb koh\u00ebs t\u00eb bllokonte hetimin e opozit\u00ebs s\u00eb koh\u00ebs ishte gjithnj\u00eb prezente.<\/p>\n<p>N\u00eb k\u00ebrkes\u00ebn p\u00ebr hetimin e zgjedhjeve 2009 mazhoranca demokrate u dakordesua p\u00ebr 9 nga 10 pikat hetimore t\u00eb k\u00ebrkuara nga opozita, duke respektuar vendimet e deriat\u00ebhershme t\u00eb Gjykat\u00ebs Kushtetuese e, p\u00ebr m\u00eb tep\u00ebr, i ofroi opozit\u00ebs socialiste t\u00eb koh\u00ebs edhe mazhoranc\u00ebn e komisionit (krahas kryetarit q\u00eb e g\u00ebzonin drejtp\u00ebrdrejt nga ligji) duke ju dh\u00ebn\u00eb garanci totale se hetimi opozitar nuk do t\u00eb bllokohej a devijohej n\u00eb proces e sip\u00ebr. Socialist\u00ebt zgjodh\u00ebn propagand\u00ebn dhe jo hetimin dhe ndon\u00ebse Kuvendi mori vendim, ai hetim nuk u krye asnj\u00ebher\u00eb p\u00ebr shkak t\u00eb bojkotit opozitar.<\/p>\n<p>Me amendimet m\u00eb t\u00eb fundit t\u00eb ligjit mazhoranca e komisionit hetimor mund t\u00eb vonoj\u00eb, devijoj\u00eb, pengoj\u00eb e bllokoj\u00eb hap-pas-hapi pun\u00ebn hetimore. Natyrisht q\u00eb kjo ndodh kur komisioni hetimor k\u00ebrkohet nga opozita sepse kur ai k\u00ebrkohet nga mazhoranca ata kan\u00eb edhe kryetarin edhe mazhoranc\u00ebn n\u00eb komision, pra edhe gurin edhe arr\u00ebn, d.m.th. nj\u00eb asimimetri totale mund\u00ebsisht hetimore n\u00eb d\u00ebm t\u00eb opozit\u00ebs.<\/p>\n<p>Me gjasa, edhe n\u00eb k\u00ebto kushte, k\u00ebrkesa p\u00ebr hetim parlamentar nga opozita ka vler\u00eb sepse, n\u00eb rast se arrihet t\u00eb hetohet at\u00ebher\u00eb demaskohet regjimi e n\u00eb rast se regjimi nuk lejon hetimin ai v\u00ebrteton natyr\u00ebn e vet. N\u00eb t\u00eb dy komisionet aktuale hetimore po ndodh kjo e dyta dhe pra, me pengimin hap-pas-hapi, regjimi po provon natyr\u00ebn e vet t\u00eb v\u00ebrtet\u00eb e kjo ka n\u00eb vetvete vler\u00eb politike t\u00eb lart\u00eb. Ngjarjet n\u00eb t\u00eb dy komisionet jan\u00eb gjithashtu t\u00eb dh\u00ebna e prova t\u00eb dobishme n\u00eb sh\u00ebrbim t\u00eb argumentimit opozitar n\u00eb Gjykat\u00ebn Kushtetuese p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje.<\/p>\n<p>Kushtetuta \u00ebsht\u00eb shum\u00eb e qart\u00eb n\u00eb rastin e hetimit parlamentar kur k\u00ebt\u00eb e k\u00ebrkojn\u00eb t\u00eb pakt\u00ebn 35 deputet\u00eb: komisioni ngrihet vetiu; Kuvendi \u00ebsht\u00eb i detyruar ta miratoje ngritjen; mund t\u00eb diskutohet objekti i hetimit vet\u00ebm n\u00ebse haptazi dhunon kushtetut\u00ebn; mazhoranca, n\u00ebse ka kund\u00ebrshti, duhet t\u00eb propozoj\u00eb konkretisht ndryshime n\u00eb objekt por pa d\u00ebmtuar a shtremb\u00ebruar thelbin e objektit hetimor t\u00eb k\u00ebrkuar.<\/p>\n<p>Kur Kushtetuta urdh\u00ebron se hetimi parlamentar nuk mund t\u00eb pengohet n\u00eb nisje, af\u00ebrmendsh q\u00eb ajo (n\u00ebn)kupton se hetimi parlamentar\u00a0 nuk mund t\u00eb pengohet as n\u00eb vijim e as n\u00eb p\u00ebrfundim. Ligji i m\u00ebhersh\u00ebm kishte ca mjete penguese n\u00eb proces, n\u00eb thelb edhe ai nuk ishte n\u00eb harmoni me Kushtetut\u00ebn, nd\u00ebrsa amendimet m\u00eb t\u00eb fundit i japin mazhoranc\u00ebs mjete penguese edhe n\u00eb fillim t\u00eb procesit kur krijohet komisioni, si dhe shtojn\u00eb e p\u00ebrforcojn\u00eb mjetet penguese, deformuese e bllokuese n\u00eb proces.<\/p>\n<p>N\u00eb k\u00ebto rrethana zgjidhja nuk mund t\u00eb jet\u00eb q\u00eb n\u00eb \u00e7do hap t\u00eb procesit hetimor t\u00eb \u00e7do komisioni opozita t\u00eb ankohet n\u00eb Gjykat\u00ebn Kushtetuese. Edhe rr\u00ebzimi i amendamenteve me t\u00eb fundit nga Gjykata Kushtetuese, n\u00ebse ndodh, nuk mjafton p\u00ebr ta sjell\u00eb n\u00eb terezi hetimin parlamentar.<\/p>\n<p>Tashm\u00eb \u00ebsht\u00eb e qart\u00eb q\u00eb n\u00ebse duam me te v\u00ebrtet\u00eb hetim parlamentar n\u00eb p\u00ebrputhje me Kushtetut\u00ebn duhet nj\u00eb koncept tjet\u00ebr komisioni dhe procesi hetimor q\u00eb nuk e pengon hetimin as n\u00eb fillim as n\u00eb mes e as n\u00eb fund. Ndaj, e vetmja zgjidhje duket se \u00ebsht\u00eb ajo q\u00eb komisioni t\u00eb p\u00ebrb\u00ebhet, t\u00eb pakt\u00ebn n\u00eb shumic\u00eb, e pse jo edhe t\u00ebr\u00ebsisht, vet\u00ebm nga nism\u00ebtar\u00ebt, e t\u00eb drejtohet prej tyre.<\/p>\n<p>N\u00eb k\u00ebt\u00eb rast duhen evidentuar vet\u00ebm ato pak \u00e7\u00ebshtje shum\u00eb, shum\u00eb kardinale, veprime konkrete hetimore t\u00eb komisionit q\u00eb mund t\u00eb cenonin n\u00eb thelb, r\u00ebnd\u00eb a pa kthim, t\u00eb drejtat e subjekteve t\u00eb tjera, e q\u00eb domosdoshm\u00ebrisht k\u00ebrkojn\u00eb nj\u00eb mekaniz\u00ebm balancues q\u00eb mund t\u2019i besohej ose pakic\u00ebs bllokuese t\u00eb an\u00ebtar\u00ebve t\u00eb komisionit, ose nj\u00eb organi tjet\u00ebr t\u00eb Kuvendit ose gjykat\u00ebs.<\/p>\n<p>N\u00eb rastin e hetimit penal t\u00eb prokuroris\u00eb kjo \u00ebsht\u00eb e detyruar t\u00eb marr\u00eb miratimin e gjykat\u00ebs si kund\u00ebrbalanc\u00eb p\u00ebr disa veprime kardinale hetimore nd\u00ebrsa \u00ebsht\u00eb e lir\u00eb t\u00eb nd\u00ebrmarr\u00eb t\u00eb gjitha veprimet e vendimet e tjera lirsh\u00ebm n\u00eb sh\u00ebrbim t\u00eb procesit hetimor.<\/p>\n<p>Di\u00e7ka e ngjashme mund t\u00eb adoptohet edhe n\u00eb rastin e komisioneve hetimore parlamentare p\u00ebrkundrejt nj\u00eb trupe kund\u00ebrbalancuese e, n\u00eb fakt, \u00e7\u00ebshtja nuk \u00ebsht\u00eb e komplikuar p\u00ebr asfare. N\u00eb hetimin parlamentar zakonisht nuk merren vendime as p\u00ebr masa sigurie e as vendime t\u00eb tjera me pesh\u00eb p\u00ebr cenimin n\u00eb thelb, t\u00eb r\u00ebnd\u00eb a pa kthim t\u00eb t\u00eb drejtave t\u00eb subjekteve. Komisioni hetimor parlamentar ka vet\u00ebm dy instrumente n\u00eb dispozicion: k\u00ebrkon dokumente nga institucione dhe subjekte t\u00eb tjera; therret p\u00ebr d\u00ebshmi persona t\u00eb cil\u00ebt mund t\u00eb shoq\u00ebrohen me avokat dhe g\u00ebzojn\u00eb t\u00eb gjitha t\u00eb drejtat q\u00eb g\u00ebzojn\u00eb n\u00eb procesin penal.
