Ligji p\u00ebr shpron\u00ebsimet u ndryshua n\u00eb vitin 2016 n\u00eb favor t\u00eb investitor\u00ebve strategjik\u00eb, duke u leht\u00ebsuar atyre procesin e shpron\u00ebsimit, por qytetar\u00ebt e thjesht\u00eb nuk p\u00ebrfituan s\u00ebrish asnj\u00eb leht\u00ebsi.<\/p>\n<p>N\u00eb fund t\u00eb vitit t\u00eb kaluar banesa tre kat\u00ebshe e Dashamir Vocit n\u00eb fshatin B\u00ebrxull\u00eb, u shemb nga fadromat e IKMT, pasi u prek nga projekti i nd\u00ebrtimit t\u00eb rrug\u00ebs Thuman\u00eb \u2013 Kashar. Autostrada po ashtu i mori edhe 1700 m2 tok\u00eb. Megjith\u00ebse mbeti pa sht\u00ebpi dhe pa tok\u00eb ai nuk p\u00ebrfitoi d\u00ebmshp\u00ebrblim, pasi asnj\u00ebra prej pronave nuk ishte legalizuar.<\/p>\n<p>\u201cEksperti e vler\u00ebsoi 360 mij\u00eb euro d\u00ebmin q\u00eb mu b\u00eb p\u00ebr t\u00eb dy pronat, ndaj kam nisur nj\u00eb proces gjyq\u00ebsor\u201d, \u2013 rr\u00ebfen Dashamiri p\u00ebr Citizens.al, q\u00eb thot\u00eb se sht\u00ebpin\u00eb e p\u00ebrfundoi s\u00eb nd\u00ebrtuari n\u00eb vitin 2002<\/p>\n<p>Rrug\u00ebn p\u00ebr legalizimin e banes\u00ebs, e nisi dy dekada m\u00eb par\u00eb, por si pasoj\u00eb e ndryshimeve t\u00eb shpeshta ligjore, ai nuk mundi asnj\u00ebher\u00eb t\u00eb merrte cerftifikat\u00ebn e pron\u00ebsis\u00eb.<\/p>\n<p>\u201cSapo doli ligji i legalizimit, aplikova n\u00eb 2005-\u00ebn. N\u00eb 2009 erdh\u00ebn vet\u00eb dhe e plot\u00ebsuam s\u00ebrish aplikimin, n\u00eb 2016-\u00ebn erdh\u00ebn prap\u00eb p\u00ebr aplikim, por nuk mora asnj\u00eb p\u00ebrgjigje.\u201d, \u2013 rr\u00ebfen ai p\u00ebr Citizens.<\/p>\n<p><span style=\"font-style: inherit; font-weight: inherit;\">Pas 23 vitesh p\u00ebrpjekje p\u00ebr t\u00eb ligj\u00ebruar pron\u00ebn, ai pretendon se u skualifikua nga procesi i legalizimit, menj\u00ebher\u00eb sapo u b\u00eb publik projekti i nd\u00ebrtimit t\u00eb rrug\u00ebs Thuman\u00eb-Kashar.<\/span><\/p>\n<p>\u201cE gjith\u00eb loja u b\u00eb se filloi gjurma e projektit. Kam dokumente, nj\u00eb her\u00eb n\u00eb 2018 dhe nj\u00eb her\u00eb n\u00eb 2021 q\u00eb isha n\u00eb proces legalizimi. M\u00eb 2023, kur doli projekti m\u00eb njoftuan q\u00eb isha skualifikuar nga legalizimi. Madje koh\u00ebt e fundit m\u00eb than\u00eb q\u00eb ka humbur dosja, nga Kadastra, por m\u00eb von\u00eb rezultoi se ishte aty\u201d ,- akuzon Dashamir Voci.<\/p>\n<p>Projekti Thuman\u00eb Kashar ka kushtuar 226 mln euro, por nd\u00ebrtimi i rrug\u00ebs vet\u00ebm n\u00eb zon\u00ebn e B\u00ebrxull\u00ebs ka sjell\u00eb shembjen e 19 banesave. 11 prej tyre nuk kan\u00eb p\u00ebrfituar d\u00ebmshp\u00ebrblim pasi ishin n\u00eb process legalizimi.<\/p>\n<p>Sa u p\u00ebrket tokave, jan\u00eb d\u00ebmtuar rreth 98 familje, por vet\u00ebm 30 prej tyre kan\u00eb p\u00ebrfituar d\u00ebmshp\u00ebrblim. 68 familje jan\u00eb skualifikuar nga procesi i d\u00ebmshp\u00ebrblimit edhe pse ishin n\u00eb pritje t\u00eb certifikat\u00ebs s\u00eb pron\u00ebsis\u00eb.<\/p>\n<p>Nj\u00eb pjes\u00eb e konsiderueshme e pronave t\u00eb prekura nga projekte t\u00eb m\u00ebdha infrastrukturore, n\u00eb t\u00eb gjith\u00eb vendin, jan\u00eb skualifikuar pa p\u00ebrfituar asnj\u00eb d\u00ebmshp\u00ebrblim, p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb legalizimit.<\/p>\n<p>Procedur\u00eb kjo q\u00eb garantohet nga ligji nr. 9482 p\u00ebr \u201cLegalizimin, urbanizimin dhe integrimin e nd\u00ebrtimeve pa leje\u201d. I miratuar dy dekada m\u00eb par\u00eb, n\u00eb vitin 2004, ky ligj ka ndryshuar 7 her\u00eb deri n\u00eb vitin 2015.<\/p>\n<p>\u201cT\u00eb gjith\u00eb pronat q\u00eb kan\u00eb qen\u00eb me AMTP (Akti i Marrjes s\u00eb Tok\u00ebs n\u00eb Pron\u00ebsi) dhe t\u00eb aplikuara n\u00eb ASHK p\u00ebr certifikata, t\u00eb gjith\u00eb i kan\u00eb skualifikuar dhe nuk kan\u00eb dh\u00ebn\u00eb asnj\u00eb lek. Jan\u00eb mbi 50 familje q\u00eb nuk kan\u00eb marr\u00eb asnj\u00eb qindark\u00eb\u201d- thot\u00eb Muharrem Koni, banor i fshatit B\u00ebrxull\u00eb, nj\u00ebherazi edhe kryeplak i zon\u00ebs.<\/p>\n<p><strong style=\"font-style: inherit;\">Ng\u00ebr\u00e7i me ligjin e shpron\u00ebsimeve<\/strong><\/p>\n<p>Shpron\u00ebsimi p\u00ebr interes publik rregullohet me ligjin e vitit 1994 \u201cP\u00ebr shpron\u00ebsimet dhe marrjen n\u00eb p\u00ebrdorim t\u00eb p\u00ebrkohsh\u00ebm t\u00eb pasuris\u00eb pron\u00eb private p\u00ebr interes publik\u201d. Por edhe ky ligj ka ndryshuar disa her\u00eb, duke i b\u00ebr\u00eb t\u00eb paqarta rregullat e loj\u00ebs n\u00eb mes t\u00eb procesit. Vet\u00eb deputet\u00ebt, me kartonat e t\u00eb cil\u00ebve miratohet \u00e7do ndryshim ligjor, i konsiderojn\u00eb arbitrare nd\u00ebrhyrjet n\u00eb kuadrin ligjor rregullator.<\/p>\n<p>\u201cD\u00ebmshp\u00ebrblimi i pronave \u00ebsht\u00eb kthyer nga nj\u00eb proces n\u00eb respekt t\u00eb pron\u00ebs, tek nj\u00eb proces q\u00eb ka n\u00eb thelb arbitraritetin\u201d, \u2013 thot\u00eb deputetja e PD, Jorida Tabaku.<\/p>\n<p>Enkelejda Olldashi, pedagoge pran\u00eb fakultetit Juridik, thot\u00eb se shteti nuk ka vendosur rregulla t\u00eb qarta p\u00ebr m\u00ebnyr\u00ebn se si do t\u00eb ligj\u00ebrohet prona, pasi ka p\u00ebrplasje mes ligjit t\u00eb shpron\u00ebsimeve dhe atij t\u00eb legalizimit.<\/p>\n<p>\u201cJo vet\u00ebm q\u00eb regjistrimi i pronave nuk ka p\u00ebrfunduar, por shteti shqiptar nuk ka mundur ende t\u00eb formalizoj\u00eb nj\u00eb regjist\u00ebr t\u00eb tok\u00ebs, q\u00eb do t\u00eb pasqyronte vler\u00ebn e saj\u201d, \u2013 thot\u00eb Olldashi.<\/p>\n<p>\u201cRealizimi i procesit t\u00eb shpron\u00ebsimit p\u00ebr interes publik nd\u00ebrkoh\u00eb q\u00eb ende nuk ka p\u00ebrfunduar procesi i regjistrimit t\u00eb pasurive t\u00eb paluajtshme, sigurisht q\u00eb do t\u00eb gjeneroj\u00eb probleme\u201d, \u2013 thot\u00eb Olldashi.<\/p>\n<p>\u201cThemeli mbi t\u00eb cilin bazohet shpron\u00ebsimi i pronave \u00ebsht\u00eb interesi publik dhe kompensimi me nj\u00eb shp\u00ebrblim t\u00eb drejt\u00eb i tyre\u201d, sqarohet n\u00eb nenin 41.1 t\u00eb Kushtetut\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/p>\n<p>Viti 1994 ishte zanafilla e ligjit p\u00ebr shpron\u00ebsimet. Me ndryshimin e sistemit politik n\u00eb vitin 1992, m\u00eb 25 korrik t\u00eb vitit 1994 u miratua ligji nr.7848, \u201cP\u00ebr shpron\u00ebsimet p\u00ebr interes publik dhe marrjen n\u00eb p\u00ebrdorim t\u00eb p\u00ebrkohsh\u00ebm t\u00eb pasuris\u00eb s\u00eb paluajtshme\u201d. Ky ligj ka qen\u00eb n\u00eb fuqi deri n\u00eb miratimin m\u00eb 22 dhjetor t\u00eb 1999, t\u00eb ligjit nr Nr.8561 \u201cP\u00ebr shpron\u00ebsimet dhe marrjen n\u00eb p\u00ebrdorim t\u00eb p\u00ebrkohsh\u00ebm t\u00eb pasuris\u00eb pron\u00eb private p\u00ebr interes publik\u201d.<\/p>\n<p>Ligj mbeti i pandryshuar p\u00ebr shum\u00eb vite, derisa p\u00ebsoi dy nd\u00ebrhyrje gjat\u00eb periudh\u00ebs s\u00eb qeverisjes s\u00eb kryeministrit aktual, Edi Rama. Ndryshimi I par\u00eb \u00ebsht\u00eb miratuar m\u00eb ligjin nr. 20\/2016, dat\u00eb 10.3.2016, dhe ndryshimi dyt\u00eb me ligjin nr. 11\/2020, dat\u00eb 12.2.2020). Nd\u00ebrhyrja erdhi si rezultat i problemeve t\u00eb hasura n\u00eb praktik\u00eb, gjat\u00eb implementimit t\u00eb ligjit aktual p\u00ebr shpron\u00ebsimet dhe synonte rregullmin e procedurave t\u00eb shpron\u00ebsimit.<\/p>\n<p>Miratimi i k\u00ebtyre ndryshimeve nuk ishte e planifikuar n\u00eb programin analitik t\u00eb projekt akteve t\u00eb K\u00ebshillit t\u00eb Ministrave dhe ligjet e reja prodhuan nj\u00eb situat\u00eb edhe m\u00eb konfliktuale.<\/p>\n<p>\u201cNdryshimet ligjore u shit\u00ebn si nj\u00eb m\u00ebnyr\u00eb p\u00ebr t\u2019i ikur problemeve q\u00eb kishin krijuar shpron\u00ebsimet p\u00ebr arsye publike tek pronar\u00ebt. N\u00eb t\u00eb v\u00ebrtet\u00eb m\u00ebnyra se si u ndryshuan dhe \u00e7far\u00eb u ndryshua qe d\u00ebshmi q\u00eb shteti p\u00ebrdori k\u00ebto ndryshime p\u00ebr t\u00eb abuzuar me shp\u00ebrblimin p\u00ebr tok\u00ebn e marr\u00eb\u201d, \u2013komenton Jorida Tabaku.<\/p>\n<p>Me ndryshimet e miratuara, n\u00eb nenin 7 u shtuan si objekte t\u00eb shpron\u00ebsimit edhe kulturat bujq\u00ebsore, duke c\u00ebnuar drejtp\u00ebrdrejt t\u00eb ardhmen e qytetar\u00ebve q\u00eb e bazojn\u00eb jet\u00ebs\u00ebn tek bujq\u00ebsia.<\/p>\n<p>Nj\u00eb nd\u00ebr nd\u00ebrhyrjet m\u00eb flagrante n\u00eb k\u00ebt\u00eb ligj, ishte prekja e nenit 8, ku p\u00ebrcaktohen shkaqet e shpron\u00ebsimit. Me ligjin 20\/2016, dat\u00eb 10.3.2016 pika F, \u00ebsht\u00eb shtuar shpron\u00ebsimi p\u00ebr arsye investimi strategjik, sipas legjislacionit p\u00ebr investitorin strategjik.<\/p>\n<p>Nenit 9, ku p\u00ebrcaktohen subjektet p\u00ebr t\u00eb cil\u00ebt mund t\u00eb b\u00ebhet shpron\u00ebsimi, i \u00ebsht\u00eb ndryshuar p\u00ebrmbajtja me ligjin nr. 20\/2016, duke shtuar si subjekte dhe investitor\u00ebt strategjik\u00eb.<\/p>\n<p>P\u00ebrmes l\u00ebvizjeve t\u00eb tilla dhe ndryshimeve ligjore, q\u00eb n\u00eb thelb kan\u00eb \u201cinvestitor\u00ebt strategjik\u00eb\u201d, qeveria leht\u00ebsoi procesin e shpron\u00ebsimit n\u00eb favor t\u00eb klient\u00ebve t\u00eb ashtuquajtur \u201cinvestitor\u00eb strategjik\u00eb\u201d, por qytetar\u00ebt e thjesht\u00eb nuk p\u00ebrfituan asnj\u00eb leht\u00ebsi.<\/p>\n<p>\u201cLigji i investimeve strategjike ka r\u00ebnduar situat\u00ebn e pronar\u00ebve n\u00eb vendin ton\u00eb pasi shpron\u00ebsimet p\u00ebr \u00e7\u00ebshtje t\u00eb tilla tanim\u00eb jan\u00eb kthyer n\u00eb skem\u00eb abuzimi me d\u00ebmshp\u00ebrblimin\u201d, \u2013 mendon Jorida Tabaku.<\/p>\n<p>Sipas saj, n\u00eb k\u00ebt\u00eb rast, korrupsioni b\u00ebhet me ligje duke p\u00ebrfshir\u00eb n\u00eb loj\u00eb edhe parlamentin.<\/p>\n<p>\u201cNuk kam d\u00ebgjuar asnj\u00ebher\u00eb ndonj\u00eb koleg t\u00eb mazhoranc\u00ebs socialiste q\u00eb t\u00eb angazhohet n\u00eb sjelljen e nj\u00eb ligji p\u00ebr t\u00eb rritur shp\u00ebrblimin ndaj pronave q\u00eb meren p\u00ebr nd\u00ebrtime publike, n\u00eb t\u00eb kund\u00ebrt gjithmon\u00eb shohim ata deputet\u00eb q\u00eb t\u00eb angazhohen n\u00eb mbrojtje t\u00eb interesit t\u00eb t\u00eb dyshuarve t\u00eb p\u00ebrhersh\u00ebm\u201d- thot\u00eb Tabaku.<\/p>\n<p>N\u00eb vitin 2020 u b\u00eb s\u00ebrish nj\u00eb nd\u00ebrhyrje. Ndryshimet e reja p\u00ebrcaktojn\u00eb funskionimin n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrhershme t\u00eb nj\u00eb institucioni qeveritar q\u00eb \u00ebsht\u00eb Agencia Shtet\u00ebrore e shpron\u00ebsimeve, teksa ligji i m\u00ebparsh\u00ebm p\u00ebrcaktonte ngritjen e komisioneve t\u00eb p\u00ebrkohshme.<\/p>\n<p><strong style=\"font-style: inherit;\">Legalizimet, ndryshime t\u00eb shpeshta<\/strong><\/p>\n<p>Andi Gjoka, pronar i nj\u00eb biznesi lulesh ka refuzuar t\u00eb firmos\u00eb dhe nuk ka pranuar shum\u00ebn e ofruar, por e ka d\u00ebrguar \u00e7\u00ebshtjen e d\u00ebmshp\u00ebrblimit n\u00eb Gjykat\u00eb Administrative.<\/p>\n<p>\u201cM\u00eb jan\u00eb d\u00ebmtuar 5000 met\u00ebr katror\u00eb tok\u00eb q\u00eb e kam p\u00ebrdorur p\u00ebr biznes, kisha mbjell\u00eb lulet q\u00eb tregtoj\u201d- thot\u00eb Andi Gjoka, banor i Kruj\u00ebs.<\/p>\n<p>Qytetar\u00ebt e preku nga ky projekt kan\u00eb pretendime edhe p\u00ebr vler\u00ebn e shpron\u00ebsimeve. P\u00ebr ta, vlera e ofruar \u00ebsht\u00eb qesharake.<\/p>\n<p>\u201cToka bujq\u00ebsore ishte vendosur t\u00eb shpron\u00ebsohej me vler\u00eb 448 lek\u00eb metri katror, nd\u00ebrsa 51 500 lek\u00eb \u00ebsht\u00eb vlera e shpron\u00ebsimit p\u00ebr metrin katror t\u00eb sht\u00ebpis\u00eb. Nj\u00eb vler\u00eb qesharake\u201d- sqaron Muharrem Koni.<\/p>\n<p>Vlera e d\u00ebmshp\u00ebrblimit kryhen sipas nj\u00eb formule q\u00eb p\u00ebrllogaritet nga Agjencia Shtet\u00ebrore e Shpron\u00ebsimit, por q\u00eb ekspert\u00ebt sugjerojn\u00eb se nuk p\u00ebrputhet me vler\u00ebn e tregut.<\/p>\n<p>\u201cShpron\u00ebsimet p\u00ebr interes publik b\u00ebhen nga Agjencia Shtet\u00ebrore p\u00ebr Shpron\u00ebsim. Por n\u00eb 80% t\u00eb rasteve \u00ebsht\u00eb shkelur neni 41 i Kushtetut\u00ebs p\u00ebr nj\u00eb shp\u00ebrblim t\u00eb drejt\u00eb. Shpron\u00ebsimet n\u00eb tokat bujq\u00ebsore jan\u00eb b\u00ebr\u00eb sipas \u00e7mimit t\u00eb referenc\u00ebs nga ASHK (Agjencia Shtet\u00ebrore e Kadastr\u00ebs) me \u00e7mime qesharake deri n\u00eb 200 lek\u00eb metri, por \u00e7mimi i tregut \u00ebsht\u00eb 100 euro metri.\u201d- thot\u00eb avokatiKujtim Ibraj, i cili e ka ndjekur k\u00ebt\u00eb proces.<\/p>\n<p>Ekspert\u00ebt e ligjit thon\u00eb se n\u00eb zon\u00ebn e Rinasit \u00e7mimi i referenc\u00ebs s\u00eb tok\u00ebs bujq\u00ebsore \u00ebsht\u00eb qesharak, nd\u00ebrkoh\u00eb q\u00eb \u00e7mimi i tregut \u00ebsht\u00eb 100-fish me i lart\u00eb se sa vlera q\u00eb qytetar\u00ebt marrin nga shpron\u00ebsimet publike.<\/p>\n<p>\u201cAgjencia llogarit vler\u00ebn \u2018qesharake\u2019 dhe e d\u00ebrgon p\u00ebr VKM. Shum\u00eb qytetar\u00eb kund\u00ebrshtojn\u00eb k\u00ebto VKM n\u00eb rrug\u00eb gjyq\u00ebsore n\u00eb nj\u00eb kalvar pa fund n\u00eb dyert e gjykatave\u201d, \u2013 shprehet avokati Kujtim Ibraj<\/p>\n<p>\u201cK\u00ebto \u00e7\u00ebshtje duhen adresuar me kujdes, me procese transparente, kompensim t\u00eb drejt\u00eb dhe angazhim dometh\u00ebn\u00ebs dhe mi\u00ebrkuptim\u201d, \u2013 sugjeron Haxhimali.<\/p>\n<ol>\n<li>Dervishi nuk e ka legalizuar sht\u00ebpin\u00eb q\u00eb e nd\u00ebrtoi n\u00eb vitin 2009 mbi rr\u00ebnojat e sht\u00ebpis\u00eb s\u00eb vjet\u00ebr q\u00eb iu shemb nga shp\u00ebrthimi n\u00eb G\u00ebrdec, edhe ajo e palegalizuar.<\/li>\n<\/ol>\n<p>\u201cUn\u00eb kam pron\u00ebn me Aktin e marrjes s\u00eb tapis\u00eb n\u00eb dor\u00ebzim, kam b\u00ebr\u00eb mbi 100 Gen-pane, por Hipoteka mi kthente mbrapsht.
