Nga procesi i auditimit kan\u00eb rezultuar mosp\u00ebrputhje dhe devijime ligjore, si pasoj\u00eb e shkeljeve t\u00eb dispozitave ligjore n\u00eb procedurat e prokurimit publik, t\u00eb cilat kan\u00eb cenuar barazin\u00eb e pjes\u00ebmarr\u00ebsve dhe operator\u00ebve ekonomik n\u00eb k\u00ebt\u00eb procedur\u00eb dhe nj\u00ebkoh\u00ebsisht rritje t\u00eb paargumentuar t\u00eb vler\u00ebs s\u00eb kostove t\u00eb nd\u00ebrtimit dhe kostove t\u00eb projektimit n\u00eb procedur\u00ebn e prokurimit me objekt \u201cStudim, Projektim i disa objekteve t\u00eb Policis\u00eb s\u00eb Shtetit\u201d, ku p\u00ebrfshihen Drejtoria Vendore e Policis\u00eb Vlor\u00eb, Komisariati i Policis\u00eb Nr.4 Tiran\u00eb, Komisariati i Policis\u00eb Pogradec, Komisariati i Policis\u00eb Mirdit\u00eb. Kontrolli i Lart\u00eb i Shtetit n\u00eb lidhje me k\u00ebto shkelje ka depozituar n\u00eb Prokurorin\u00eb e Posa\u00e7me Kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar kall\u00ebzim penal ndaj 5 funksionar\u00ebve t\u00eb Ministris\u00eb s\u00eb Brendshme, p\u00ebrgjegj\u00ebs p\u00ebr vler\u00ebsimin e ofertave n\u00eb procedur\u00ebn e prokurimit me objekt \u201cStudim, Projektim i disa objekteve t\u00eb Policis\u00eb s\u00eb Shtetit\u201d p\u00ebr vepr\u00ebn penale t\u00eb \u201cShkelja e barazis\u00eb s\u00eb pjes\u00ebmarr\u00ebsve n\u00eb tendera apo ankande publike\u201d parashikuar nga neni 258 i Kodit Penal,\u201d<\/em>-shkruhej n\u00eb kall\u00ebzimin e KLSH q\u00eb iu dor\u00ebzua SPAK-ut n\u00eb korrik t\u00eb vitit 2021.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>Edhe pse sot iu komunikua zyrtarisht akuza, Ndreca nuk shkoi vet\u00eb sot n\u00eb SPAK, por d\u00ebrgoi avokatin e tij p\u00ebr t\u2019u njohur me p\u00ebrfundimin e Prokuroris\u00eb s\u00eb Posa\u00e7me kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar.<\/p>\n<p><strong>Por \u00e7far\u00eb shkeljesh gjeti KLSH n\u00eb auditin e kryer 3 vite m\u00eb par\u00eb?<\/strong><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-1459600\" src=\"https:\/\/boldnews.al\/wp-content\/uploads\/2024\/10\/900-0-1729868180x1jpg-160-640x620.jpg\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" srcset=\"https:\/\/boldnews.al\/wp-content\/uploads\/2024\/10\/900-0-1729868180x1jpg-160-640x620.jpg 640w, https:\/\/boldnews.al\/wp-content\/uploads\/2024\/10\/900-0-1729868180x1jpg-160-750x727.jpg 750w, https:\/\/boldnews.al\/wp-content\/uploads\/2024\/10\/900-0-1729868180x1jpg-160.jpg 900w\" alt=\"\" width=\"640\" height=\"620\" data-pin-no-hover=\"true\" \/><\/p>\n<p>M\u00eb 30 dhjetor 2019, BOE \u201cDe.-E\u201d, \u201cA.P.E\u201d (i p\u00ebrzgjedhur si kandidati fitues i faz\u00ebs II), plot\u00ebson kriteret kualifikuese me ofert\u00ebn e tij 54,238,000\u00a0lek\u00eb pa TVSH. Po at\u00eb dat\u00eb miratohet procedura e tenderit. Pasi departamenti i Financ\u00ebs n\u00eb Ministrin\u00eb e Brendshme merr informacion p\u00ebr procedur\u00ebn, njofton se nuk ka fonde dhe nuk mund t\u00eb operohet n\u00eb vijim me marrjen e angazhimeve financiare.<\/p>\n<p><em>\u201cP\u00ebr k\u00ebt\u00eb arsye i b\u00ebhet me dije Sekretarit t\u00eb\u00a0P\u00ebrgjithsh\u00ebm (pra Plarent Ndrec\u00ebs) se nuk mund t\u00eb vazhdojn\u00eb procedurat e\u00a0lidhjes s\u00eb kontrat\u00ebs dhe \u00ebsht\u00eb konfirmuar se nuk t\u00eb mbulohet efekti financiar t\u00eb marrjes s\u00eb angazhimit financiar me vler\u00eb 54,238,000 lek\u00eb pa TVSH, deri n\u00eb momentin q\u00eb fondet t\u00eb jen\u00eb n\u00eb llogarin\u00eb e \u201cAK\u201d.\u201d,\u201d-<\/em>shkruhet n\u00eb raportin e KLSH.\u00a0Pavar\u00ebsisht lajm\u00ebrimit t\u00eb Financ\u00ebs, t\u00eb nes\u00ebrmen n\u00ebnshkruhet kontrata e sh\u00ebrbimit midis BOE \u201cDe.-E\u201d,\u00a0\u201cA.P.E\u201d, dhe Sekretarit t\u00eb P\u00ebrgjithsh\u00ebm t\u00eb Ministris\u00eb s\u00eb Brendshme.<\/p>\n<p><em>\u201cNga auditimi tipologjive t\u00eb komisariateve u konstatua keq llogaritje e kostove t\u00eb nd\u00ebrtimit dhe rrjedhimisht edhe kostove t\u00eb projektimit. Gabimi kryesor n\u00eb llogaritje \u00ebsht\u00eb n\u00eb vendosjen 2 her\u00eb t\u00eb pajisjeve, duke rritur koston e nd\u00ebrtimit dhe p\u00ebrllogaritja e tarifave \u00ebsht\u00eb ber\u00eb me TVSH, ku rrjedhimit vlera rezulton me TVSH. Nd\u00ebrkoh\u00eb, n\u00eb formularin e njoftimit t\u00eb fituesit dhe n\u00eb kontrat\u00ebn nr. 10373\/4 prot. Dat\u00eb 31.12.2019, vlerat e\u00a0projektimit t\u00eb komisariateve jan\u00eb n\u00ebnshkruar pa TVSH. P\u00ebr veprimet e rritjes n\u00eb m\u00ebnyr\u00eb artificiale ose fiktive t\u00eb tarifave t\u00eb projektimit nga BOE, sip\u00ebrmarr\u00ebsi ka p\u00ebrfituar padrejt\u00ebsisht vlera ekomomike n\u00eb d\u00ebm t\u00eb Buxhetit t\u00eb Shtetit. Bazuar keq llogaritjeve apo gabime t\u00eb tarifave, BOE \u201cDe.-E\u201d, \u201cA.P.E\u201d, jo vet\u00ebm q\u00eb duhej t\u00eb skualifikohej nga procedura tenderuese, ku duhej t\u00eb vler\u00ebsohej me \u201c0\u201d pik\u00eb, por do t\u00eb ndryshonte t\u00ebr\u00ebsisht edhe rezultati i vler\u00ebsimit, ku \u201cSt. Re.\u201d shpk, do t\u00eb ishte shpallur fitues,\u201d<\/em>-shtohet n\u00eb raportin e KLSH-s\u00eb.<\/p>\n<p>Sipas KLSH, vlera totale e p\u00ebrfituar padrejt\u00ebsisht \u00ebsht\u00eb diferenca e Komisariatit Vlor\u00eb dhe Mir\u00ebdit\u00eb (6,222,960 + 2,044,980) = 8,267,940 lek\u00eb pa TVSH ose\u00a0<strong>9,922 mij\u00eb lek\u00eb\u00a0me TVSH.<\/strong><\/p>\n<p>Sipas nenit 4 t\u00eb kontrat\u00ebs \u201cVlera e Kontrat\u00ebs\u201d, p\u00ebrcaktohet vlera n\u00eb lidhje me hartimin e projekt zbatimit sipas tipologjive t\u00eb objekteve: 1. Drejtori Vendore Policie + Komisariat\u00a0<strong>Vlor\u00eb<\/strong>:<strong>\u00a021,744,370<\/strong>\u00a0lek\u00eb 2. Komisariati Policis\u00eb\u00a0<strong>nr. 4<\/strong>\u00a0<strong>Tiran\u00eb<\/strong>:\u00a0<strong>13,533,385 lek\u00eb<\/strong>\u00a03. Komisariati Policis\u00eb\u00a0<strong>Pogradec<\/strong>:\u00a0<strong>13,153,196 lek\u00eb<\/strong>\u00a04. Komisariati Policis\u00eb\u00a0<strong>Mirdit\u00eb<\/strong>:\u00a0<strong>6,807,332 lek\u00eb<\/strong><\/p>\n<p><strong>Total: 55,238,283 lek\u00eb.<\/strong><\/p>\n<p><strong>PJES\u00cb NGA AUDITI I KLSH:<\/strong><\/p>\n<p><em><strong>Gjetjet e KLSH<\/strong>: Me procesverbalin e shqyrtimit t\u00eb ofertave dat\u00eb 30.12.2019, me objekt \u201cStudim Projektim p\u00ebr disa projekte\u00a0tip objekte t\u00eb Policis\u00eb s\u00eb Shtetit\u201d u konstatua se BOE \u201cDe.-E\u201d, \u201cA.P.E\u201d (i p\u00ebrzgjedhur si kandidati fitues i faz\u00ebs II ), plot\u00ebson kriteret kualifikuese me ofert\u00ebn e tij 54,238,000\u00a0lek\u00eb pa TVSH. Me raportin p\u00ebrmbledh\u00ebs nr. 10373\/2 prot. Dat\u00eb 30.12.2019 miratohet procedura e tenderit. Me<\/em><br \/>\n<em>Memon e nj\u00ebsis\u00eb s\u00eb prokurimit dat\u00eb 31.12.2019 drejtuar\u00a0Sekretarit t\u00eb P\u00ebrgjithsh\u00ebm, njofton se nj\u00ebsia e prokurimit vijon me lidhjen e kontrat\u00ebs vet\u00ebm pasi fondi do t\u00eb jet\u00eb n\u00eb dispozicion n\u00eb llogarin\u00eb p\u00ebrkat\u00ebse. Njoftimi i nj\u00ebsis\u00eb s\u00eb\u00a0prokurimit bazohet n\u00eb nenin 58 t\u00eb ligjit 9643 dat\u00eb 20.11.2006 \u201cP\u00ebr Prokurimin Publik\u201d, i ndryshuar dhe VKM Nr. 914, dat\u00eb 29.12.2014 \u201cRregullat e Prokurimit Publik\u201d neni 70, \u201cLidhja e Kontrat\u00ebs\u201d ku p\u00ebrcaktohet se: \u201cZhvillimi\u00a0i procedur\u00ebs s\u00eb prokurimit do t\u00eb b\u00ebhet deri n\u00eb momentin e shpalljes s\u00eb njoftimit t\u00eb fituesit, nd\u00ebrsa lidhja e kontrat\u00ebs do t\u00eb b\u00ebhet n\u00eb p\u00ebrputhje me afatet e p\u00ebrcaktuara n\u00eb pik\u00ebn 3, t\u00eb nenit 21, t\u00eb k\u00ebtyre rregullave, dhe vet\u00ebm pasi fondi do t\u00eb jet\u00eb n\u00eb dispozicion (n\u00eb llogarin\u00eb p\u00ebrkat\u00ebse) t\u00eb autoritetit kontraktor\u201d.<\/em><\/p>\n<p><em>Nj\u00ebsia e prokurimit ka kryer komunikime me\u00a0email me drejtorin e financ\u00ebs, nga e cila \u00ebsht\u00eb sqaruar n\u00eb\u00a0memot p\u00ebrkat\u00ebse se fondet nuk jan\u00eb disponib\u00ebl dhe se nuk mund t\u00eb operohet n\u00eb vijim me marrjen e angazhimeve financiare. P\u00ebr k\u00ebt\u00eb arsye i b\u00ebhet me dije Sekretarit t\u00eb\u00a0P\u00ebrgjithsh\u00ebm se nuk mund t\u00eb vazhdojn\u00eb procedurat e\u00a0lidhjes s\u00eb kontrat\u00ebs dhe \u00ebsht\u00eb konfirmuar se nuk t\u00eb mbulohet efekti financiar t\u00eb marrjes s\u00eb angazhimit financiar me vler\u00eb 54,238,000 lek\u00eb pa TVSH, deri n\u00eb momentin q\u00eb fondet t\u00eb jen\u00eb n\u00eb llogarin\u00eb e \u201cAK\u201d.<\/em><\/p>\n<p><em><strong>Nd\u00ebrkoh\u00eb, Kontrata e sh\u00ebrbimit n\u00ebnshkruhet me nr.<\/strong>10373\/4 prot.\u00a0<strong>Dat\u00eb 31.12.2019<\/strong>\u00a0midis BOE \u201cDe.-E\u201d,\u00a0\u201cA.P.E\u201d, dhe Sekretarit t\u00eb P\u00ebrgjithsh\u00ebm t\u00eb MB. P\u00ebr shkak t\u00eb disponibilitetit t\u00eb fondeve, mos marrjes s\u00eb angazhimeve financiare dhe legjislacionit t\u00eb prokurimit publik mbi kontratat, n\u00eb nenin 16.1 t\u00eb kontrat\u00ebs p\u00ebrcaktohet se \u00e7mimi i kontrat\u00ebs duhet t\u00eb jet\u00eb \u00e7mimi i ofertuar nga kontraktuesi dhe i miratuar nga AK, Drejtoris\u00eb vendore t\u00eb Policis\u00eb Vlor\u00eb 21,740,000 pa TVSH dhe Komisariati i Mir\u00ebdit\u00ebs 6,800,000 lek\u00eb pa TVSH. Neni 16.2 p\u00ebrcakton \u00e7mimin total\u00a0t\u00eb kontrat\u00ebs 28,540,000 pa TVSH dhe 34,248,000 me TVSH.<\/em><\/p>\n<p><em><strong>(Pra, 2 komisariatet e tjer\u00eb nuk do t\u00eb realizohen p\u00ebr\u00a0munges\u00eb fondesh).<\/strong><\/em><\/p>\n<p><em>-Nga dokumentacioni i v\u00ebn\u00eb n\u00eb dispozicion, burimet zyrtare t\u00eb propozimit financiar t\u00eb BOE De.-E\u201d, \u201cA.P.E\u201d sipas shtojc\u00ebs 3 dat\u00eb 24.10.2019, t\u00eb n\u00ebnshkruara dhe t\u00eb miratuara nga drejtuesi ligjor i operatorit ekonomik, u konstatua se: -Propozimi ekonomik\/ financiar i procedur\u00ebs \u201cStudim Projektim p\u00ebr disa projekte tip objekte t\u00eb Policis\u00eb s\u00eb Shtetit\u201d bazohet n\u00eb VKM 354 dat\u00eb 11.05.2016 \u201cMiratimi i manualit t\u00eb tarifave p\u00ebr sh\u00ebrbime n\u00eb planifikim territori, projektim, mbik\u00ebqyrje dhe kolaudim\u201d. Tarifa e projektimit llogaritet mbi baz\u00eb e kostove t\u00eb kalkulueshme ku p\u00ebrfshihen kostot e nd\u00ebrtimit (materiale e nd\u00ebrtimit) plus pun\u00ebtorin\u00eb.<strong>\u00a0Fillimisht BOE ka ber\u00eb vler\u00ebsim t\u00eb kostove t\u00eb kalkulueshme t\u00eb nd\u00ebrtimit dhe mbi baz\u00ebn e k\u00ebtyre kostove, \u00ebsht\u00eb llogaritur tarifa p\u00ebr projektim<\/strong>. Bashk\u00eblidhur shtojc\u00ebs\u00a03 dat\u00eb 24.10.2019 \u201cPropozimi ekonomik\u201d, gjendet tabela llogarit\u00ebse e sh\u00ebrbimit t\u00eb projektimit e ndar\u00eb n\u00eb faza, e\u00a0marr\u00eb nga referenca e legjislacionit shqiptar VKM 354 dat\u00eb\u00a011.05.2016 \u201cMiratimi i manualit t\u00eb tarifave p\u00ebr sh\u00ebrbime n\u00eb\u00a0planifikim territori, projektim, mbik\u00ebqyrje dhe kolaudim\u201d.<\/em><\/p>\n<p><em>-Nga auditimi Tipologjive t\u00eb komisariateve u konstatua keq llogaritje e kostove t\u00eb nd\u00ebrtimit dhe rrjedhimisht edhe kostove t\u00eb projektimit. Gabimi kryesor n\u00eb llogaritje \u00ebsht\u00eb n\u00eb vendosjen 2 her\u00eb t\u00eb pajisjeve, duke rritur koston e nd\u00ebrtimit dhe p\u00ebrllogaritja e tarifave \u00ebsht\u00eb ber\u00eb me TVSH, ku rrjedhimit vlera rezulton me TVSH.\u00a0P\u00ebr veprimet e rritjes n\u00eb m\u00ebnyr\u00eb artificiale ose fiktive t\u00eb tarifave t\u00eb projektimit nga BOE, sip\u00ebrmarr\u00ebsi ka p\u00ebrfituar padrejt\u00ebsisht vlera ekomomike n\u00eb d\u00ebm t\u00eb Buxhetit t\u00eb Shtetit.\u00a0<strong>Bazuar keq llogaritjeve apo gabime t\u00eb tarifave, BOE \u201cDe.-E\u201d, \u201cA.P.E\u201d, jo vet\u00ebm q\u00eb duhej t\u00eb s\u2019kualifikohej nga procedura tenderuese<\/strong>, ku duhej t\u00eb vler\u00ebsohej me \u201c0\u201d pik\u00eb, por do t\u00eb ndryshonte t\u00ebr\u00ebsisht edhe rezultati i vler\u00ebsimit, ku \u201cS R\u201d shpk, do t\u00eb ishte shpallur fitues. Vlera Totale e p\u00ebrfituar padrejt\u00ebsisht bazuar kontrat\u00ebs s\u00eb sh\u00ebrbimit nr. 10373\/4 prot. Dat\u00eb 31.12.2019, \u00ebsht\u00eb diferenca e\u00a0Komisariatit Vlor\u00eb dhe Mir\u00ebdit\u00eb (6,222,960 + 2,044,980) = 8,267,940 lek\u00eb pa TVSH ose 9,922\u00a0mij\u00eb lek\u00eb me TVSH. P\u00ebr projektin e investimit me objekt \u201cStudim Projektim p\u00ebr disa projekte tip objekte t\u00eb Policis\u00eb s\u00eb Shtetit\u201d, u konstatua keq llogaritje e kostove t\u00eb nd\u00ebrtimit dhe rrjedhimisht edhe kostove t\u00eb<\/em><\/p>\n<p><em>Projekti i zbatimit dhe preventivi p\u00ebrfundimtar\u00eb p\u00ebrmbajn\u00eb vizatimet, raportin teknik p\u00ebrfundimtar, preventiv (me dhe pa cmime), specifikime teknike, grafikun e punimeve dhe raportin e VNM. Sa m\u00eb sip\u00ebr mbi marrjen e projektit n\u00eb dor\u00ebzim, konstatohet se nuk \u00ebsht\u00eb ndjekur apo reskpektuar asnj\u00eb faz\u00eb e dor\u00ebzimit t\u00eb tij, n\u00eb kund\u00ebshrtim me nenin 5 dhe nenin 4 t\u00eb kontrat\u00ebs s\u00eb sh\u00ebrbimit. Konstatohet se nuk jan\u00eb kordinuar komponent\u00ebt e projektit me Drejtorin\u00eb e Policis\u00eb s\u00eb Shtetit dhe jan\u00eb shmangur plot\u00ebsisht vler\u00ebsimet dhe miratimet e fazave t\u00eb Projektit nga Drejtoria e Policis\u00eb s\u00eb Shtetit, duke c\u00ebnuar cil\u00ebsin\u00eb, apo k\u00ebrkesat e p\u00ebrfituesit. P\u00ebr veprimet e m\u00ebsip\u00ebrme mbajn\u00eb\u00a0p\u00ebrgjegj\u00ebsi grupi i marrjes n\u00eb dor\u00ebzim.<\/em><\/p>\n<p><em><strong>Kontrata e sh\u00ebrbimit n\u00ebnshkruhet me nr. 1480\/17 prot. Dat\u00eb 24.12.2019 midis BOE \u201cD.-E\u201d , \u201cA.P.E\u201d, p\u00ebrfaq\u00ebsues i \u201cDe.-E\u201d B. D., p\u00ebrfaq\u00ebsues i \u201cA.P.E\u201d A. M. dhe Sekretarit t\u00eb P\u00ebrgjithsh\u00ebm t\u00eb MB P. N..<\/strong><\/em><\/p>\n<p><em>Sipas nenit 4 t\u00eb kontrat\u00ebs \u201cVlera e Kontrat\u00ebs\u201d, p\u00ebrcaktohet vlera n\u00eb lidhje me hartimin e projekt zbatimit sipas tipologjive t\u00eb objekteve: 1. Drejtori Vendore Policie + Komisariat Vlor\u00eb: 21,744,370 lek\u00eb 2. Komisariati Policis\u00eb nr. 4 Tiran\u00eb: 13,533,385 lek\u00eb 3. Komisariati Policis\u00eb Pogradec: 13,153,196 lek\u00eb 4. Komisariati Policis\u00eb Mirdit\u00eb: 6,807,332 lek\u00eb Total: 55,238,283 lek\u00eb. T\u00eb dh\u00ebnat e projekt-ides\u00eb sipas nenit 5 t\u00eb kontrat\u00ebs jan\u00eb d\u00ebrguar n\u00eb faz\u00ebn e vler\u00ebsimit t\u00eb faz\u00ebs s\u00eb dyt\u00eb t\u00eb konkurs projketimit, e cila sqarohet n\u00eb vij\u00ebmsi t\u00eb akt konstatimit.<\/em><\/p>\n<p><em>\u2013 Me urdhrin e prokurimit nr. 10373 prot.
