K\u00ebtu del n\u00eb pah hiookrizia e madhe e Autoritetit t\u00eb Konkurrenc\u00ebs dhe prodhuesve t\u00eb bulmetit, pasi t\u00eb gjitha produktet e kompanive t\u00eb tyre prodhohen me qum\u00ebsht pluhur ose me qum\u00ebsht t\u00eb importuar nga Serbia.<\/strong><\/p>\n<p><strong>D\u00ebshmitar\u00eb q\u00eb produktet e bulmetit t\u00eb kompanive shqiptare kan\u00eb n\u00eb p\u00ebrb\u00ebrjen e tyre qum\u00ebsht pluhur jan\u00eb \u00e7do konsumator shqiptar. Ky fakt \u00ebsht\u00eb i dalluesh\u00ebm q\u00eb n\u00eb shije e nuk \u00ebsht\u00eb nevoja q\u00eb k\u00ebta prodhues ta deklarojn\u00eb n\u00eb etiket\u00ebn e p\u00ebrb\u00ebr\u00ebsve\u2026 por megjithat\u00eb qum\u00ebshti i importuar serb vjen shum\u00eb her\u00eb m\u00eb lir\u00eb se ai vendas dhe \u00ebsht\u00eb produkt baz\u00eb p\u00ebr prodhimin e bulmetit shqiptar, pavar\u00ebsisht se k\u00ebta oligark\u00eb ia faturojn\u00eb rritjen e \u00e7mimit dy komponent\u00ebve zinxhir.<\/strong><\/p>\n<p><strong>Si mashtron Autoriteti i Konkurrenc\u00ebs<\/strong><\/p>\n<p>Autoriteti i Konkurrenc\u00ebs ka mbyllur hetimin e thelluar ndaj nd\u00ebrmarrjeve q\u00eb prodhojn\u00eb bulmetra si Erzeni, Gjirofarma, Luftra dhe Shaka Boboshtic\u00eb p\u00ebr rritjen e \u00e7mimit t\u00eb qm\u00ebshtit dhe n\u00ebnprodukteve t\u00eb tij.<\/p>\n<p>Pas hetimit Konkurrenca ka dal\u00eb n\u00eb p\u00ebrfundimin se arsyeja kryesore e shtrenjtimit t\u00eb bulmetrave jan\u00eb fermer\u00ebt, t\u00eb cil\u00ebt kan\u00eb rritur \u00e7mimin e qum\u00ebshtit t\u00eb fresk\u00ebt. Po k\u00ebshtu, Konkurrenca thot\u00eb se nd\u00ebrmarrjet e p\u00ebrpunimit t\u00eb qum\u00ebshtit nuk shfaqin shenja t\u00eb koordinimit mes tyre duke mos v\u00ebrejtur shenja t\u00eb nj\u00eb marr\u00ebveshje ose sjellje t\u00eb bashk\u00ebrenduar midis tyre.<\/p>\n<p><strong>Njoftimi i plot\u00eb i Konkurrenc\u00ebs<\/strong><\/p>\n<p><em>N\u00eb dat\u00ebn 07.11.2024 Autoriteti i Konkurrenc\u00ebs, mbylli procedur\u00ebn e hetimit t\u00eb thelluar ndaj nd\u00ebrmarrjeve Erzeni SHPK, Gjirofarma SHA, ADG SHPK (Lufra), SHAKA Boboshtic\u00eb SHPK n\u00eb tregun e prodhimit dhe tregtimit me shumic\u00eb t\u00eb n\u00ebnprodukteve t\u00eb qum\u00ebshtit (djath\u00eb dhe gjalp\u00eb)\u201d. Gjat\u00eb periudh\u00ebs s\u00eb hetimit pas analizimit t\u00eb t\u00eb dh\u00ebnave t\u00eb shumta u konstatua se:<\/em><\/p>\n<p><em>Nuk ekzistojn\u00eb barriera ligjore p\u00ebr n\u00eb k\u00ebt\u00eb treg t\u00eb nd\u00ebrmarrjeve t\u00eb reja. \u00c7do nd\u00ebrmarrje q\u00eb zot\u00ebron mund\u00ebsi ekonomike \u00ebsht\u00eb e lir\u00eb t\u00eb hyj\u00eb n\u00eb treg dhe t\u00eb konkurroj\u00eb dhe aktualisht asnj\u00eb nd\u00ebrmarrje nuk ka pozit\u00eb dominuese n\u00eb tregun p\u00ebrkat\u00ebs. N\u00eb n\u00ebn tregjet e shitjes s\u00eb djathit dhe gjalpit konstatohet ekzistenca e konkurrenc\u00ebs potenciale me fuqi kund\u00ebrvepruese t\u00eb bler\u00ebsve;<\/em><\/p>\n<p><em>P\u00ebr vitin 2023[1], referuar anket\u00ebs s\u00eb vrojtimit t\u00eb qum\u00ebshtit dhe n\u00ebnprodukteve t\u00eb tij, t\u00eb publikuar nga INSTAT, vihet re se sasia gjithsej e qum\u00ebshtit t\u00eb grumbulluar nga t\u00eb gjitha llojet e bag\u00ebtive \u00ebsht\u00eb rreth 101 mij\u00eb ton\u00eb, nga t\u00eb cilat 80 mij\u00eb ton jan\u00eb qum\u00ebsht lope, 13 mij\u00eb ton qum\u00ebsht dele dhe rreth 8 mij\u00eb ton jan\u00eb qum\u00ebsht dhie.<\/em><\/p>\n<p><em>Nga krahasimi i t\u00eb dh\u00ebnave konstatohet se ka nj\u00eb ulje t\u00eb sasis\u00eb s\u00eb grumbulluar t\u00eb qum\u00ebshtit t\u00eb lop\u00ebs, sasi e cila p\u00ebr vitin 2023 ka p\u00ebsuar nj\u00eb r\u00ebnie me rreth 14 mij\u00eb ton referuar vitit 2021. Nd\u00ebrsa p\u00ebr vitin 2023, krahasuar me vitin 2022, qum\u00ebshti i lop\u00ebs ka nj\u00eb r\u00ebnie sipas sasis\u00eb s\u00eb grumbulluar me 7 mij\u00eb ton, ose rreth 9%. Nga t\u00eb dh\u00ebnat e analizuara n\u00eb procedur\u00ebn hetimore konstatohet se, p\u00ebr prodhimin e 1 kg djath\u00eb (t\u00eb bardh\u00eb ose ka\u00e7kavall) duhen 8 deri n\u00eb 9 litra qum\u00ebsht. Kjo sasi p\u00ebrb\u00ebn dhe 80% t\u00eb kostos s\u00eb prodhimit t\u00eb k\u00ebtij n\u00ebnprodukti.<\/em><\/p>\n<p><em>Sasia totale e qum\u00ebshtit pluhur t\u00eb importuar p\u00ebr vitin 2022 \u00ebsht\u00eb 1,290,875 kg p\u00ebr vitin 2023 \u00ebsht\u00eb 997,650 kg dhe janar-qershor 2024, \u00ebsht\u00eb 317,689 kg. Nga konstatimet gjat\u00eb inspektimeve rezulton se nd\u00ebrmarrjet n\u00ebn hetim nuk p\u00ebrdorin ose p\u00ebrdorin shum\u00eb pak qum\u00ebsht pluhur p\u00ebr n\u00ebnprodukte t\u00eb tjera t\u00eb qum\u00ebshtit q\u00eb nuk jan\u00eb objekt i k\u00ebtij hetimi (kos me fruta, salc\u00eb kosi etj.);<\/em><\/p>\n<p><em>P\u00ebr produktin djath\u00eb nga qum\u00ebshti i lop\u00ebs nd\u00ebrmarrjet n\u00ebn hetim z\u00ebn\u00eb rreth 9.7% p\u00ebr vitin 2022 dhe rreth 15% p\u00ebr vitin 2023 t\u00eb sasis\u00eb s\u00eb prodhuar t\u00eb tregut n\u00eb nivel komb\u00ebtar; p\u00ebr produktin djath\u00eb nga qum\u00ebshti i deles, rreth 18 % p\u00ebr vitin 2022 dhe rreth 17% p\u00ebr vitin 2023 t\u00eb sasis\u00eb s\u00eb prodhuar t\u00eb tregut n\u00eb nivel komb\u00ebtar; p\u00ebr produktin djath\u00eb nga qum\u00ebshti i dhis\u00eb, rreth 33% p\u00ebr vitin 2022 dhe rreth 24% p\u00ebr vitin 2023 t\u00eb sasis\u00eb s\u00eb prodhuar t\u00eb tregut n\u00eb nivel komb\u00ebtar, nd\u00ebrsa p\u00ebr produktin gjalp\u00eb, nd\u00ebrmarrjet n\u00ebn hetim z\u00ebn\u00eb rreth 28% p\u00ebr vitin 2022 dhe rreth 52% p\u00ebr vitin 2023 t\u00eb sasis\u00eb s\u00eb prodhuar t\u00eb tregut n\u00eb nivel komb\u00ebtar. Duhet theksuar se p\u00ebrtej p\u00ebrqindjeve t\u00eb m\u00ebsip\u00ebrme informaliteti i lart\u00eb n\u00eb k\u00ebt\u00eb industri (rreth 89% sipas Shoqat\u00ebs \u201cIndustria e P\u00ebrpunimit t\u00eb Qum\u00ebshtit\u201d) \u00ebsht\u00eb nj\u00eb faktor serioz q\u00eb pengon vler\u00ebsimin sa m\u00eb efektiv t\u00eb konkurrenc\u00ebs n\u00eb pamund\u00ebsi t\u00eb gjurmueshm\u00ebris\u00eb s\u00eb produktit;<\/em><\/p>\n<p><em>N\u00eb lidhje me rritjen e \u00e7mimit (kryesisht gjat\u00eb vitit 2022) konkludohet se arsyeja kryesore e rritjes s\u00eb \u00e7mimit t\u00eb n\u00ebnprodukteve t\u00eb qum\u00ebshtit \u00ebsht\u00eb rritja e \u00e7mimit t\u00eb qum\u00ebshtit t\u00eb fresk\u00ebt nga fermer\u00ebt, i cili \u00ebsht\u00eb l\u00ebnd\u00eb e par\u00eb p\u00ebr n\u00ebnproduktet q\u00eb prodhohen.<\/em><\/p>\n<p><em>Sipas fermer\u00ebve arsyet e rritjes s\u00eb \u00e7mimit t\u00eb qum\u00ebshtit jan\u00eb: rritja e kostos s\u00eb baz\u00ebs ushqimore t\u00eb bag\u00ebtive; zvog\u00eblimi i numrit t\u00eb krer\u00ebve, e cila konfirmohet dhe nga statistikat e INSTAT, sepse ka r\u00ebn\u00eb numri i krer\u00ebve q\u00eb mbar\u00ebshtohen n\u00eb vendin ton\u00eb; rritja e \u00e7mimit t\u00eb plastik\u00ebs (ambalazhi), karburantit, gazit dhe energjis\u00eb elektrike. Pavar\u00ebsisht sa m\u00eb sip\u00ebr n\u00eb vler\u00ebsimin e \u00e7mimit mesatar mujor t\u00eb blerjes nga nd\u00ebrmarrjet Erzeni shpk, Gjirofarma sha dhe Shaka Boboshtic\u00eb shpk rezulton t\u00eb ket\u00eb \u00e7mime t\u00eb p\u00ebraf\u00ebrta (ndryshon n\u00eb intervalin nga 1.1 lek deri n\u00eb 4.58 lek ) gjat\u00eb muajve Janar, Shkurt, Mars t\u00eb vitit 2022.<\/em><\/p>\n<p><em>N\u00eb Qershor, Korrik dhe Tetor t\u00eb vitit 2022 dhe n\u00eb N\u00ebntor t\u00eb 2023 vihet re nj\u00eb \u00e7mim shum\u00eb i p\u00ebraf\u00ebrt blerje (ndryshon n\u00eb intervalin nga 0.6 deri n\u00eb 1.7 lek) nga nd\u00ebrmarrjet Shaka Boboshtic\u00eb dhe ADG. N\u00eb Shkurt dhe Dhjetor t\u00eb vitit 2023 vihet re nj\u00eb \u00e7mim shum\u00eb i p\u00ebraf\u00ebrt (ndryshon n\u00eb intervalin nga 0.3 lek deri n\u00eb 1.3 lek) blerje nga nd\u00ebrmarrjet Gjirofarma dhe ADG. P\u00ebr periudh\u00ebn janar-qershor 2024 vihet re q\u00eb n\u00eb muajin qershor t\u00eb gjitha nd\u00ebrmarrjet kan\u00eb \u00e7mimin bler\u00ebs m\u00eb t\u00eb lir\u00eb p\u00ebr vitin. Nga analiza e \u00e7mimeve mesatare mujore t\u00eb blerjes s\u00eb qum\u00ebshtit t\u00eb lop\u00ebs dhe dhis\u00eb p\u00ebr nd\u00ebrmarrjet Erzeni SHPK, ADG SHPK, SHAKA Boboshtic\u00eb SHPK dhe Gjirofarma SHA vihet re se jan\u00eb t\u00eb ndryshme nga nj\u00ebra \u2013 tjetra me diferenca q\u00eb kan\u00eb variuar nga 0,3 \u2013 46% p\u00ebr qum\u00ebshtin e lop\u00ebs dhe nga 0.3 % \u2013 27 % p\u00ebr qum\u00ebshtin e dhis\u00eb p\u00ebrgjat\u00eb periudh\u00ebs hetimore, duke mos v\u00ebrejtur shenja t\u00eb nj\u00eb sjellje t\u00eb bashk\u00ebrenduar n\u00eb kuptim t\u00eb nenit 4 t\u00eb ligjit nr. 9121\/2003 \u201cP\u00ebr mbrojtjen e konkurrenc\u00ebs\u201d;<\/em><\/p>\n<p><em>Nd\u00ebrmarrjet n\u00ebn hetim p\u00ebr periudh\u00ebn hetimore furnizimin me l\u00ebnd\u00eb t\u00eb par\u00eb qum\u00ebsht e kan\u00eb realizuar tek fermer\u00eb t\u00eb ndrysh\u00ebm n\u00eb zona t\u00eb ndryshme gjeografike dhe si rezultat nuk kan\u00eb p\u00ebrdorur furnizime t\u00eb p\u00ebrbashk\u00ebta n\u00eb kuptim t\u00eb nenit 4 pika b, c t\u00eb ligjit nr. 9121\/2003;<\/em><\/p>\n<p><em>N\u00eb lidhje me norm\u00ebn e fitimit p\u00ebr vitin 2023 nd\u00ebrmarrjet q\u00eb operojn\u00eb n\u00eb n\u00ebn tregjet e prodhimit dhe shitjes s\u00eb produkteve djath\u00eb dhe gjalp\u00eb kan\u00eb nj\u00eb norm\u00eb fitimi deri ne 13.8%, nd\u00ebrkoh\u00eb q\u00eb nd\u00ebrmarrjet n\u00ebn hetim: ERZENI SHPK, ADG SHPK, GJIROFARMA SHA, SHAKA BOBOSHTIC\u00cb SHPK rezultojn\u00eb me norm\u00eb fitimi nga 2% deri n\u00eb 7%, pra m\u00eb t\u00eb vog\u00ebl se 10%;<\/em><br \/>\n<em>N\u00eb lidhje me \u00e7mimet mesatare mujore t\u00eb shitjes s\u00eb produktit djath\u00eb ka\u00e7kavall dele, t\u00eb aplikuara nga nd\u00ebrmarrjet ERZENI SHPK, ADG SHPK, SHAKA BOBOSHTIC\u00cb SHPK dhe GJIROFARM SHA, analiza e realizuar konfirmon se jan\u00eb t\u00eb ndryshme nga nj\u00ebra \u2013 tjetra me diferenca q\u00eb kan\u00eb variuar nga 1% \u2013 64% p\u00ebrgjat\u00eb periudh\u00ebs hetimore dhe ritmi i ndryshimit t\u00eb tyre \u00ebsht\u00eb i ndrysh\u00ebm; n\u00ebp\u00ebrmjet t\u00eb nj\u00ebjt\u00ebs analiz\u00eb rezulton gjithashtu se \u00e7mimet mesatare mujore t\u00eb shitjes s\u00eb produktit djath\u00eb i bardh\u00eb dele t\u00eb aplikuara nga nd\u00ebrmarrjet Erzeni SHPK, Shaka Boboshtic\u00eb SHPK dhe Gjirofarm SHA jan\u00eb t\u00eb ndryshme nga nj\u00ebra \u2013 tjetra p\u00ebrgjat\u00eb periudh\u00ebs hetimore dhe ritmi i ndryshimit t\u00eb tyre \u00ebsht\u00eb i ndrysh\u00ebm, duke mos v\u00ebrejtur shenja t\u00eb nj\u00eb sjellje t\u00eb bashk\u00ebrenduar n\u00eb kuptim t\u00eb nenit 4 t\u00eb ligjit nr. 9121\/2003 \u201cP\u00ebr mbrojtjen e konkurrenc\u00ebs\u201d.<\/em><\/p>\n<p><em>N\u00eb p\u00ebrfundim t\u00eb hetimit t\u00eb thelluar, pas vler\u00ebsimit t\u00eb gjith\u00eb dokumentacionit t\u00eb administruar gjat\u00eb procedur\u00ebs hetimore si dhe analiz\u00ebs s\u00eb sjelljes s\u00eb nd\u00ebrmarrjeve q\u00eb ushtrojn\u00eb veprimtari n\u00eb tregun e prodhimit dhe shitjes me shumic\u00eb t\u00eb produkteve djath\u00eb i bardh\u00eb lope, djath\u00eb i bardh\u00eb dele, djath\u00eb i bardh\u00eb dhie, djath\u00eb ka\u00e7kavall lope, djath\u00eb ka\u00e7kavall dele dhe gjalp\u00eb lope, p\u00ebr sa i p\u00ebrket analiz\u00ebs s\u00eb konkurrenc\u00ebs: struktur\u00ebs s\u00eb tregut, \u00e7mimeve t\u00eb shitjes me shumic\u00eb dhe fuqis\u00eb ekonomike financiare, rezulton se nuk jan\u00eb gjetur evidenca direkte dhe indirekte t\u00eb bashk\u00ebpunimit midis nd\u00ebrmarrjeve, duke mos v\u00ebrejtur shenja t\u00eb nj\u00eb marr\u00ebveshje ose sjellje t\u00eb bashk\u00ebrenduar midis tyre, sipas parashikimeve t\u00eb nenit 4 t\u00eb ligjit nr. 9121, dat\u00eb 28.07.2003 \u201cP\u00ebr mbrojtjen e konkurrenc\u00ebs\u201d.<\/em><\/p>\n<p><em>Gjithashtu, duke marr\u00eb parasysh kriteret e vler\u00ebsimit t\u00eb pozit\u00ebs dominuese, si: pjes\u00ebn e tregut t\u00eb nd\u00ebrmarrjeve, barrierat p\u00ebr hyrjen n\u00eb treg, konkurrenc\u00ebn potenciale, fuqin\u00eb kund\u00ebrvepruese t\u00eb bler\u00ebsve, fuqin\u00eb ekonomike dhe financiare t\u00eb nd\u00ebrmarrjeve, bazuar n\u00eb nenin 8 t\u00eb ligjit nr. 9121\/2003, rezulton se nuk ka nd\u00ebrmarrje me pozit\u00eb dominuese n\u00eb tregun p\u00ebrkat\u00ebs, p\u00ebr rrjedhoje nuk jemi n\u00eb kushtet e zbatimit t\u00eb nenit 9 t\u00eb ligjit nr. 9121\/2003. Pavar\u00ebsisht sa m\u00eb sip\u00ebr, problematikat e ndeshura gjat\u00eb hetimit k\u00ebrkojn\u00eb marrjen e disa masave nga institucionet p\u00ebrkat\u00ebse. P\u00ebr k\u00ebt\u00eb arsye, Komisioni i Konkurrenc\u00ebs me vendimin nr. 1131, n\u00eb vijim t\u00eb mbylljes s\u00eb hetimit, vendosi edhe:<\/em><\/p>\n<p><em>T\u2019i rekomandoj\u00eb Autoritetit Komb\u00ebtar t\u00eb Ushqimit:<\/em><\/p>\n<p><em>T\u00eb p\u00ebrforcoj\u00eb rolin e tij p\u00ebr zbatimin me rigorozitet t\u00eb kontrolleve p\u00ebrsa i p\u00ebrket cil\u00ebsis\u00eb dhe parametrave mikrobiologjik\u00eb t\u00eb qum\u00ebshtit si l\u00ebnd\u00eb e par\u00eb.<\/em><br \/>\n<em>T\u2019i rekomandoj\u00eb Ministris\u00eb s\u00eb Financave:<\/em><br \/>\n<em>T\u00eb nd\u00ebrmarr\u00eb nisma p\u00ebr nj\u00eb \u201cStrategji t\u00eb integruar n\u00eb luft\u00ebn kund\u00ebr informalitetit\u201d si institucioni kompetent dhe p\u00ebrgjegj\u00ebs p\u00ebr parandalimin dhe luftimin e informalitetit n\u00eb treg.<\/em><br \/>\n<em>T\u2019i rekomandoj\u00eb Ministris\u00eb s\u00eb Bujq\u00ebsis\u00eb dhe Zhvillimit Rural q\u00eb:<\/em><br \/>\n<em>T\u00eb nd\u00ebrmarr\u00eb nism\u00ebn p\u00ebr hartimin dhe rishikimin e akteve n\u00ebnligjore t\u00eb dala n\u00eb zbatim t\u00eb ligjit nr. 9441, dat\u00eb 11.11.2005, me q\u00ebllim rregullimin e tyre dhe rritjen e konkurrenc\u00ebs n\u00eb treg, bazuar n\u00eb problematikat e konstatuara n\u00eb tregun e prodhimit dhe tregtimit t\u00eb qum\u00ebshtit dhe n\u00ebnprodukteve t\u00eb tij;<\/em><br \/>\n<em>T\u00eb nd\u00ebrmarr\u00eb nism\u00ebn p\u00ebr krijimin e nj\u00eb baze t\u00eb dh\u00ebnash p\u00ebr monitorimin e \u00e7mimeve me pakic\u00eb t\u00eb produkteve t\u00eb shport\u00ebs (n\u00ebnprodukteve t\u00eb qum\u00ebshtit), me q\u00ebllim rritjen e konkurrenc\u00ebn p\u00ebrmes transparenc\u00ebs dhe krahasueshm\u00ebris\u00eb m\u00eb t\u00eb mir\u00eb t\u00eb k\u00ebtyre \u00e7mimeve online.<\/em><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Oligark\u00ebt e bulmetit kishin paralajm\u00ebruar trenjtimin e produkteve q\u00eb shesin-qum\u00ebshtit q\u00eb do ua shesin fermer\u00ebt shtrenjt\u00eb, me zanafill\u00eb n\u00eb rritjen e \u00e7mimit t\u00eb naft\u00ebs.
